HomeMy WebLinkAbout11-13-1991 Regular Meeting1247 STATE OF ALABAMA COUNTY OF BALDWIN The City Council, City of Fairhope, met in regular session at 5:30 p.m.; Fairhope Municipal Complex Council Chamber; 161 N. Section Street; Fairhope, Alabama 36532; on Wednesday, 13 November 1991. Present were Mayor James P. Nix; Councilmembers Roy C. White, Jeanette Puckett, Michael A. Ford, John Duck, David E. Bishop; Ctty Attorney Marion E. Wynne and Acting City Clerk Betty Rivenbark. There being a quorum present, Mayor Nix called the meeting to order. Minutes of the 28 October 1991 regular session were duly approved. Mrs. Willie Tate addressed the Council telling she had sought from 11 Mayors in the area signed Proclamations proclaiming December 16 as Special Needs Children Day and that she is next going to approach the Commission and then the Governor. That this program involved mentally retarded children who are taught from birth to 5 years and, there were 50 volunteers working with the 25-30 children. That this year they are planning a party December 16th and she is inviting the Mayor and Council and that they will use the funds she raises to buy equipment for the teaching of these children. After listening to this presentation Councilwoman Puckett made a motion to adopt the Proclamation for Special Needs Children Day. Councilman Ford seconded and motion carried unanimously. Council reviewed a Beer Off -Premises License application by Linda Laycock dba Big B Drugs #426 located at 51 So. Greeno Road. Proof of publications was received and the police had given a favorable report, and no one was present to oppose the issuance of the license. Councilman Ford moved to approve the license. Seconded by Councilman Duck , motion passed unanimously. A hearing, as requested by property owner Wesley Overton, was held to hear Mr. Overton's request regarding his situation under Ordinance No.860(Dangerous Buildings) and the Colonial Inn. Mr. Lunsford had posted notice October 7 that the owners had 60 days during which time they can either vacate or demolish these buildings. Mr. Overton talked at length telling the Council that he would like to restore the building and had met over the last 10 months with different people in an effort to pursue what this would entail and also have it done in keep- ing with the ambiance of Fairhope. He said he would like to request they be given an additional 60 days. He said he has been considering every conceivable option and that what it has come down to is a parking problem. He said he can get 25 parking spaces but that that would not be enough to run a 13 Nov 1991 1248 business. He was requesting that the City work with the Overtons to have a viable business in this spot and he said that if he was granted the 60 day extension he would like to ask the City to make on the North side of Cliff Drive 20 public parking spaces. Mr. Overton was told that we would like to see it restored but that there had been complaints from the neighbors and that we were duty bound to act on the complaints. Mr. Overton said that the place had been boarded up, there was no electricity and no gas and that it was structurally sound. That someone could break into it, that a fire could happen again but they had taken precautions to keep that from happening. Further discussion, in which Mr. Overton said they would either raze, fix the building or build something else, led to a motion by David E. Bishop to grant the 60 days requested. Councilman Ford seconded. Discussion on the motion raised the question as to when the 60 days would begin. Mr. Bishop said he thought they were acting on from tonight. Mr. Overton said he was requesting from the December 7th date. Councilman White said that he personally thought it had been dangerous since the fire but also this had been the condition for a long period of time and he thought 60 days was too long. He said he would be willing to split the difference, say 30 days. Councilman Ford said because of the holidays it would be difficult to get things worked out and asked Mr. Overton if January 15th would be an agreeable date. Mr. Overton said yes. At this time Councilman Bishop withdrew his earlier motion, Councilman Ford withdrew his second, Councilman Bishop made a new motion that he be granted an extension until January 15th as long as in that time a decision is made like he promised that they will either raze, restore the building or build something else in that spot. Councilman Ford seconded this motion and it carried unanimously. Mayor Nix told him that the Council since this was not on the agenda for tonight, could not act on the parking re- quest but he needed to get with the F.S.T.C. and get their blessing on his idea as we did have an agreement that we would not use this for anything but park land. A request was received from the Eastern Shore Optimist Club to use the City's property for their Christmas tree lot once again this year. It was noted that they always put back into the community the money they raise and that theirs is truly a worthy cause. A motion was made by Coun- cilman White, seconded by John Duck to allow this use. Motion carried unanimously. Councilman Roy White moved to appoint Paul Ring as an Alternate to the Board of Adjustments & Appeals, a 3 year term. Councilwoman Jeanette Puckett moved that the nominations be closed and Councilman David Bishop seconded the motion and Mr. Ring was unanimously appointed. 13 Nov 1991 1249 Councilman Duck introduced and moved for the adoption of the following resolution. Seconded by Councilman Ford, motion passed unanimously: Resolution No. 357-91 WHEREAS, workmens compensation costs have increased dramatically during the last few years, and WHEREAS, good safety practices can result in a reduc- tion of on-the-job injuries, NOW, THEREFORE, BE IT RESOLVED by the Governing Body' of the City of Fairhope as follows: 1. The City of Fairhope recognizes the importance of safety in the workplace and is dedicated to its commitment to safety consciousness. 2. Aaron Norris is hereby appointed as Safety Coor- dinator with the responsibility of implementing an effec- tive safety program for all employees of the City of Fairhope. Seconded by Councilman Duck, motion passed unanimously: Resolution No. 358-91 BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF FAIR - HOPE, ALABAMA, THAT Mayor James P. Nix is hereby authorized to execute a contract between the City and BCM Enaineers. Inc.. for engineering services to prepare storm water drainage per- mits for the City's Wastewater Treatment Facility and Munici- pal Solid Waste Transfer Station; Maximum project fees shall not exceed $8,500 without prior written approval. Councilman Duck moved to accept the low bid provided that all specifi- cations are met. Seconded by Councilman Ford motion passed unanimously. It was noted that we had received agreements from all the residents involved but that the promissory notes had not been executed yet. At this time William Richmond brought to the Council again a request to put a canopy at the outside entrance of Julwin's. This had been brought up several meetings back and discussion had led to the request being withdrawn at that time. One of the objections had been there was not enough space on the side- walk with the benches/flowerboxes already there. Since that time the benches have been removed. Mr. Richmond said that there is an ongoing effort to remodel the building and this is what they desire to have at the front. Councilman White moved to allow the canopy as with the removal of the benches more space is available for pedestrian passage. Councilman Duck seconded and motion passed unanimously. Sue Mason,Chairman of the Airport Board, addressed the Council about the FBO situation at the airport. She said there is an opportunity for the city to acquire the buildings since the old lease is now null and void, that the Airport Board had met Tuesday and they feel it is in the city's best interest to acquire the buildings if we can and further recommend to the Council that they try to do so. Further discussion led to a motion by Councilman Bishop to authorize the Mayor to negotiate the best terms and interest for Fairhope in seeking to acquire these buildings. Councilman Duck seconded and motion carried with Councilwoman Puckett abstaining. Mayor Nix said he will come back to the Council after talking with the bank. 13 Nov 1991 1251 Councilman Mike Ford moved to pay bills as presented.
