The City Council, City of Fairhope, met in regular session
at 5:30 pm; Fairhope Municipal Complex Council Chamber ;
161 North Section Street; Fairhope, Alabama 36532; on
Monday. 28 October 1991.
Present were Mayor James P. Nix; Councilmembers Roy C. White,
Jeanette Puckett, David E. Bishop, Michael A. Ford, and
John V. Duck; City Attorney Marion E. Wynne and City Clerk Evelyn
Phillips. No one was absent.
There being a quorum present, Mayor Nix called the meeting
to order. Minutes of 14 October regular session and
22 October 1991 special session were duly approved.
. A public hearing was held, as advertised, on a rezoning re-
quest by Diane Martinere, Fairhope Single Tax Colony property
leaseholder, to rezone property from RA Rural Agriculture to
R2 Medium Density Single Family Residential; property located
on west side of County Road 27 about 3/8 mile south of
Windmill Road. The Planning & Zoning Commission recommended
approval of the request. No one present was opposed to the
request. Councilman Bishop introduced ORDINANCE NO. 886, an
ordinance to rezone the property as requested. In order to
take immediate action, Councilman Duck moved to suspend the
rules. Seconded by Councilman Bishop, motion to suspend passed
unanimously by the following vote: AYE -White, Puckett, Nix,
Bishop, Ford, and Duck. NAY -none. Councilman Duck then moved
for final adoption of ORDINANCE NO. 886. Seconded by
Councilman Ford, motion for final adoption passed unanimously
by the following vote: AYE -White, Puckett, Nix, Bishop, Ford,
and Duck. NAY -none.
Councilman Duck introduced, and moved for the adoption of,
the following resolution. Seconded by Councilman Bishop,
motion passed unanimously:

Councilman Ford introduced, and moved for the adoption of,
the following resolution. Seconded by Councilman Duck, motion
passed unanimously:
RESOLUTION NO. 355-91
BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF FAIRHOPE,
ALABAMA, That the Mayor is hereby authorized to execute
Contract No. 40300, Service Agreement G, between UNITED GAS
PIPELINE COMPANY and the CITY OF FAIRHOPE, for the purchase
of and delivery of natural gas to the City's Gas Distribution
System; term of said agreement to be effective 1 October 1991
and shall continue and remain in force and effect until the
earlier of (i) 1 April 1993, or (ii) such date United Gas is
required to place revised tariff sheets and new rates into
effect, said date shall in no event be earlier than 1 Nov 1992.

Councilman Ford moved to authorize the Mayor to begin
financing negotiations on an issue to refinance the 1983 bond
issue, do some street improvements, and construct the Marlow
Water line. Seconded by Councilman Duck, motion passed
unanimously.
Mayor Nix announced that the City was not successful in
the recent CDBG (ADECA) grant applications for the purchase
of recreational land and for housing rehabilitation.
Meeting was duly adjourned at S:37 pm.
