NOTICE AND CALL OF SPECIAL MEETING
Notice is hereby given of a special meeting of the
City Council of the City of Fairhope, Alabama, to
be held at the Fairhope Municipal Complex on
(3 etb b-L.L, 7 1991, at 6.'10 pm, for the purpose of
hearing a request by the Airport Board.

CONSENT TO HOLDING OF MEETING
The undersigned members of the City Council of the
City of Fairhope, Alabama, do hereby acknowledge
service of the Notice and Call of Special Meeting
hereinabove set forth and do hereby consent to
the holding of such meeting at such time and in
such place and for the purpose set forth therein.

The City Council, City of Fairhope, met in special
session at 5:20 p.m.; Fairhope Municipal Complex Mayor's
Conference Room; 161 North Section Street; Fairhope, Alabama
36532; on Monday, 7 October 1991.
Present were Mayor James P. Nix; Councilmembers
Roy C. White, Jeanette Puckett, David E. Bishop, Michael
A. Ford, and John V. Duck; City Attorney Marion E. Wynne
and Acting City Clerk Betty Rivenbark, Sue Mason Airport Bd.Chm.
The purpose of this meeting was to discuss with the
Airport Board a new lease concept for a General Fixed
Base Operator at the Fairhope Municipal Airport.
There being a quorum present, Mayor Nix called the
meeting to order.
Tut Wynne addessed the Council telling them that the
present FBO at the airport is in default. He outlined the
steps he has taken in trying to rectify the situation with
the FBO, but received no response from him. He told of
initial letter 6/25 notifying him that he had 90 days in
which to come into compliance with lease agreement. He
wrote subsequent letters 8/20/91; 9/18/91 and 10/01/91.
Letter on 10/01/91 told him he had 10 days to vacate
premises. After that ten days has expired he will file
unlawful detainer. He said he wished to bring the Council
up to date on what has happened and ask for their comments
and advice. He further related that the bank has padlocked
the buildings and put a security guard out there.(FBO is in
default on $500,000 loan with them). Secondly, he is asking
the Council to go along with getting a new lease for the FBO.
It was related that the lease we had with Fairhope Aero was
a lease that actually started in 1978 that he has assumed
and is only making a percentage payment on fuel sales. That
we now wish to establish lease with monthly ground rent pay-
ments. Mayor Nix related that the airport is still open,
although it is unattended in that we have no one to sell
fuel, do maintenance. Sue Mason explained that in a case like
this we sent a NOTAM which tells of the conditions at the
airport. Tut noted that we are trying to work together with
the bank to get someone in there as soon as possible. That
unless we give them definite idea as to lease they don't know
what is facing them. The Airport Board is recommending a
modification to the lease they now have with the special FBO
adding a portion regarding maintenance, insurance and a couple
of other paragraphs that would not apply to special FBO. Tut
also pointed out that there are minimum standards that are
incorporated in the lease. David Ed Bishop about the terms
the lease would be. Tut responded 5 years, with 5- 5 year
renewable options. All questions answered satisfactorily
John Duck moved, Mike Ford seconded to authorize the city
attorney to proceed with unlawful detainer suit. Motion passed

with Councilwoman Puckett abstaining to vote. A second
motion was made by David Ed Bishop to approve in princi-
pal the proposed lease and the term offered. John Duck
seconded motion and it carried with Councilwoman Puckett
abstaining to vote.
There being no further business, meeting was duly adjourned.
