HomeMy WebLinkAbout09-23-1991 Regular Meeting1225 STATE OF ALABAMA Z COUNTY OF BALDWIN X The City Council, City of Fairhope, met in regular session at 5:30 pm; Fairhope Municipal Complex Council Chamber; 161 North Section Street; Fairhope, Alabama 36532; on Monday, 23 September 1991. Present were Mayor James P. Nix; Councilmembers Roy C. White, Jeanette Puckett, David E. Bishop, Michael A. Ford, and John V. Duck; City Clerk Evelyn P. Phillips. City Attorney Marion E. Wynne was absent. There being a quorum present, Mayor Nix called the meeting to order. Minutes of the 9 September 1991 reguar session were dult approved. Fire Chief Tim Kant addressed the council on the subject of Fire Prevention Week. The Volunteers will be making calls on various area schoolstelling the children about the importance of fire prevention and asking that the week of October 6 - 12 be proclaimed Fire Prevention Week. So moved Councilman White. Seconded by Councilman Duck, motion passed unanimously. A letter from Cindy McBrearty, Chairman of the Bay Area Arts Council, was read and discussed. Ms. McBrearty asked that the Council approve the concept of the formation of a private foundation for the purpose of planning and arranging funding for an outdoor amphitheatre, stage and acoustical shell to be constructed on the beach below the bluff and south of the fountain and parking oval at the foot of Fairhope Avenue. The Foundation would be composed of members of the Bay Area Arts Council, city representatives, representatives from the Fairhope Single Tax Colony, and citizens at large; it would invite proposals for facility siting and design, recommend a design to the City and Colony, raise funds for construction, and act as the facility's managing authority with the City. The facility would be funded largely with private funds and it would, upon completion, become a City -owned facility with the City responsible for its operating and maintenance costs. Councilman Bishop moved to approve the concept, but not the details without more information. Seconded by Councilwoman Puckett, motion passed unanimously. Councilman Duck moved to approve the closing of Church Street from De La Mare Avenue to Morphy Avenue on November 16th, for NOVEMBERFEST, a festival to benefit the Parents,Teachers, $ Students Association (PTSA) for Fairhope Kindergarten, Inter- mediate, and Elementary schools. Seconded by Councilman Ford, motion passed unanimously. 23 September 1991 1226 Councilman Ford introduced, in writing, the following resolution and moved for its adoption. Seconded by Councilman Duck, motion passed unanimously: RESOLUTION NO. 347-91 WHEREAS, The national news media has announced the possible deactivation of a number of National Guard Units; and WHEREAS, we are desirous of making our congressional delegates at the national level aware of how we feel about out local National Guard unit; and WHEREAS, we support our local unit; and we have been supported in many ways over the years by our unit, as a group and by its individual members; NOW, THEREFORE BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF FAIRHOPE, ALABAMA, That we h reby go on record strongly in favor of keeping DETACHMENT 1, 640t[I ORDNANCE COMPANY, ALABAMA ARMY NATIONAL GUARD active; and we respectfully ask Senator Heflin, Senator Shelby, and Congressman Callahan to exert every effort to keep our local unit active and in Fairhope. Seconded by Council- woman Puckett, motion passed unanimously" (Resolution No. 348-91 on next page.....) 23 September 1991 1227 RESOLUTION NO. 348-91 WHEREAS, The leaders of business and industry in Baldwin County recognize the importance of U.S. Congressional re- districting in deference to changes in population in the State of Alabama; and WHEREAS, these changes will so seriously impact the business community and the quality of life in America and in Baldwin County, Alabama; and WHEREAS, the two counties of Baldwin and Mobile represent a blend of natural and human resources unique within the State, e.g. the economy of both Baldwin and Mobile Counties are dependent upon common industries such as timber, oil and gas, agriculture, seafood, tourism; and WHEREAS, these two southernmost counties are Alabama's seacoast, the terminus of Alabama's river flows into the Gulf of Mexico, and the counties are joined by the Tensaw River Delta system and they both have extensive waterways so that Baldwin and Mobile Counties share common special environ- mental concerns; and WHEREAS, the two counties share an interchangeable labor force in the Metropolitan Statistical Area; NOW, THEREFORE BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF FAIRHOPE, ALABAMA, That we implore and ask the Permanent Legislative Committee on ReApportionment of the Alabama Legislature and the Legislature itself to select a plan that allows: 1) BALDWIN AND MOBILE COUNTIES TO REMAIN TOGETHER IN ENTIRETY IN ONE DISTRICT; 2) THE INTEGRITY OF THE PRESENT DISTRICT I BE MAINTAINED AS CLOSELY AS POSSIBLE TO ITS CURRENT CONFIGURATION; and 3) THE COMMITTEE ATTEMPT TO DETERMINE A PLAN FOR THE WHOLE STATE OF ALABAMA THAT MINIMIZES THE NUMBER OF COUNTIES THAT HAVE TO BE SPLIT. ADOPTED THIS 23rd DAY OF SEPTEMBER, 1991. a es Nix, Mayor City Cl rk Councilwoman Puckett moved to amend the current year's budget to show total revenues at $12,337,937 and total expenditures at $12,047,287, with an excess of revenues of $290,650. Seconded by Councilman Ford, motion passed unanimously. 23 September 1991 1228 Councilman White moved to up -date the Volunteer Firemen's roster by deleting Barto Stewart. Seconded by Councilwoman Puckett, motion passed unanimously. Councilman Bishop moved to authorize the write-off of $15,657.00 in uncollectible utility accounts for the year 1988-1989. Seconded by Councilman Duck, motion passed unan- imously. Council took the following action on bid items: FOR A STREET SWEEPER Vendor Sansom Equipment Co Birmingham Joe Money Machinery Birmingham Truck Equipment Sales Mobile Alternate LeasePurchase Total Price Price $ 94,733.00 $ 79,550.00 $106,737.00 $ 99,870.25 $ 113,167.80 $ 93,780.00 $ 127,S72.00 $ 119,365.20 Gulf Shores Turf Supply, Pensacola, Florida; and Ingram Equipment Company, Birmingham, Alabama, sent in "no bid"s. It is recommended to accept the next lowest bid by Sansom Equipment Company as low -bidder Joe Money Machinery did not meet specifications.--T.Kant--W.Smith Street Dept Purchasing Agt. Councilman Duck moved to accept the lowest acceptable bid by Sansom Equipment Company, provided all specifications are met; and to purchase the sweeper on the Lease Purchase plan. Seconded by Councilman Ford, motion passed unanimously. Councilwoman Puckett moved to accept the low bid, provided all specifications are met. Seconded by Councilman White, motion passed unanimously. 23 September 1991 1229 Councilwoman Puckett moved to approve paying SO% of the cost of a new Top Dresser machine for the Recreation Board out of the Recreation Capital Improvements fund; and, even though the cost is expected to be less than $5,000.00, to go out on bid. Seconded by Councilman Bishop, motion passed unanimously. Councilman Ford reported for his committee on the proposed bulkhead to help fight beach erosion between Nichols Avenue northward to the Bay Winds apartment complex. The cost will run $90.00 per bay front foot. After some discussion, it was decided to offer the six property owners involved the option of paying for the project in cash or in ten equal annual installments, plus 8% annual interest, with the first payment due upon project completion. The installment plan would require a promissory note from each one, as the land is leased from the Single Tax Colony and cannot be liened. The Mayor is to write each of the following leaseholders, outlining this offer: Dr. David G. Walsh, 300 So. Mobile; Emmett J. Evans, 220 So. Mobile; H.J. Miller, 302 So. Mobile; Thomas S. Dekhle, 300 So. Mobile; O.K. Cummings, 304 So. Mobile; and Thomas S. Millett, 306 So. Mobile; So moved by Councilman Ford. Seconded by Councilman Duck, motion passed unanimously.
