The City Council, City of Fairhope, met in regular
session at 5:30 pm; Fairhope Municipal Complex Council Chamber ;
161 North Section Street; Fairhope, Alabama 36532; on
Monday, 9 September 1991.
Present were Mayor James P. Nix; Councilmembers Roy C. White,
Jeanette Puckett, David E. Bishop, Michael A. Ford, and
John V. Duck; City Attorney Marion E. Wynne and City Clerk Evelyn
Phillips. No one was absent.
There being a quorum present, Mayor Nix called the meeting
to order. Minutes of the 26 August 1991 regular session
were duly approved.
Council took the following action on bids:

Pensacola, Florida; sent in a No Bid reply.
It is recommended to accept the low bid by Terra International
of Summerdale, Alabama.--T.Mitchell--W.Smith

Councilman Duck moved to accept the low bid, provided all
specifications are met. Seconded by Councilman White, motion
passed unanimously.
Councilman Bishop introduced, and moved for the adoption
of, the following resolution. Seconded by Councilwoman Puckett,
motion passed unanimously:

Councilwoman Puckett moved to authorize bid requests on
two underground fuel tanks. The tanks will be used to store
diesel and gasoline at the warehouse location. The City
will still be using natural gas fuel in as many vehicles as
possible. Seconded by Councilman Ford, motion passed unanimously.
Mayor Nix advised that the South Alabama British Car Club,
which has already received approval to close the south beach
area to vehicular traffic during their car show on October 5th,
has now asked to also close the north beach area. Council-
woman Puckett moved to approve the request. Seconded by Council-
man Duck, motion passed unanimously.
The City has received a permit from the US Corps of Engineers
to erect a bulkhead only to correct the beach erosion problem
in the White Avenue -Nichols Street beach area. They did not
approve any dredging or other work. This is the project requested
by some six property owners who agreed they would pay some
of the costs. The frontage involved is approximately 548 feet
long, with approximately 165 feet belonging to the City. Mayor
Nix reported the estimated costs might run $80-$100 per foot.
He then appointed Councilmembers Ford and White and General
Superintendent Rutherford to serve as a committee to work
out the erosion project details and make a report to the Council
as soon as possible.
Mayor Nix reported that the recycling program is showing
some good results: Last year's payments through the end of
July totaled $41,715.60; this year's total is $31,331.00,
which shows a goodly reduction in tonnage sent to the County
Landfill. While this is good news, more citizen participation
is needed.
Councilman Ford moved to pay bills as presented. Seconded
by Councilman Duck, motion passed unanimously.
Meeting was duly adjourned at 5:50 pm.

RESOLUTION NO. 345-91
BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF FAIRHOPE, ALABAMA,
That Mayor James P. Nix is hereby authorized to execute a joint Agree-
ment between the CITY OF FAIRHOPE, the CITY OF DAPHNE, the BALDWIN
COUNTY COMMISSION (client); and BCM ENGINEERS, INC., (engineer), to
perform the services for preparing a PERMIT APPLICATION for
STORM WATER DISCHARGE.
BE IT FURTHER RESOLVED That the City of Fairhope agrees to pay not more
than one-third of the cost of $35,000 or less.
ADOPTED THIS 9TH DAY OF SEPTEMBER, 1991.

Subject to Planning & Zoning Commission approval and the
installation of one inlet, Councilman Ford introduced, and
moved for the adoption of, the following resolution. Seconded
by Councilman Duck, motion passed unanimously:
RESOLUTION NO. 346-91
WHEREAS, the owners of EASTGATE SUBDIVISION, UNIT IV, are desirous of having
streets and utilities therein accepted for maintenance by the City Council
in order that building permits may lawfully issue; and
WHEREAS, the General Superintendent of the City represents that the physical
improvements in the nature of streets, drainage, and utilities have been
installed in substantial conformity with City requirements; and
WHEREAS, the Building/Zoning Officer of the City represents that he has
received Engineers Certified As -Built Plans, test reports, and lateral
locations as required by Chapter 19 of the Code of Ordinances; and
WHEREAS, the City Clerk has on file a two-year Maintenance Bond as required
by said Chapter 19; and
WHEREAS, extenuating circumstances exist which require the Owners to begin
residential construction with all haste; THEN, THEREFORE
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FAIRHOPE, ALABAMA, That
the streets and utilities within EASTGATE SUBDIVISION, UNIT IV, be accepted
for maintenance and that such acceptance shall occur and shall be effective
simultaneously with the dedication of rights -of -way upon the act of recording
the official plat of said Eastgate Subdividion Unit IV.
