NOTICE AND CALL OF SPECIAL MEETING
Notice is hereby given of a special meeting of the
City Council of the City of Fairhope, Alabama, to
be held at the Fairhope Municipal Complex on
Thursday, 2 May 1991, for the purpose of (1)
review an application by Doris P. Cecil for a
Beer Off -Premises and a Wine Off -Premises license;
and (2) discuss the Management -Maintenance Agree-
ments offered by Point Clear -Twin Beach Sewer
Authority.

CONSENT TO HOLDING OF MEETING
The undersigned members of the City Council of the
City of Fairhope, Alabama, do hereby acknowledge
service of the Notice and Call of Special Meeting
hereinabove set forth and do hereby consent to
the holding of such meeting at such time and in

The City Council, City of Fairhope, met in special session
at 5:00 pm; Fairhope Municipal Complex Mayor's Office ;
161 North Section Street; Fairhope, Alabama 36532; on
Thursday, 2 May 1991.
Present were Mayor James P. Nix; Councilmembers Roy C.
White, Jeanette Puckett, David E. Bishop, Michael A. Ford,
and John V. Duck; City Attorney Marion E. Wynne and City
Clerk Evelyn Phillips. No one was absent.
The purpose of the meeting was to review an application for
a Beer Off -Premises License and a Wine Off -Premises License
by Doris P. Cecil, dba UNCLE DADDY'S #391, at the corner of
Twin Beach Road and Section Street; and to review a Management
Agreement and a Maintenance Agreement between the City and
the Point Clear -Twin Beach Sewer Authority, Inc.
There being a quorum present, Mayor Nix called the meeting
to order.
Council reviewed the application by Ms. Cecil. No one
was opposed to the licenses. There was police approval of
the applicant. Councilman Duck moved to approve the appli-
cation. Seconded by Councilman White, motion passed unanimously
Council then reviewed, page by page, the two Agreements
offered by the Sewer Authority. City Attorney Wynne took
notes on each change and/or amendment as they went through
the document. He is to have the Agreements rewritten incorpo-
rating the changes asked for by the City. Among the changes
having to do with "right-of-way", taps, cut-offs for non-
payment, use of the word "effluent", etc.; the major change
requested was that the Agreements must be a three -party document:
between the City, the Point Clear -Twin Beach Sewer Authority,
Inc., and the Baldwin County Commission as guarantor. The
Council agreed to meet again, in special session if necessary,
to again consider the Agreements after they have been rewritten.
Meeting was duly adjourned at 6:10 pm.
