The City Council, City of Fairhope, met in regular session
at 5:30 pm; Fairhope Municipal Complex Council Chamber;
161 North Section Street; Fairhope, Alabama 36532; on
Monday, 8 April 1991.
Present were Mayor James P. Nix; Councilmembers Roy C.
White, Jeanette Puckett, David E. Bishop, Michael A. Ford,
and John V. Duck; City Attorney Marion E. Wynne and City Clerk
Evelyn Phillips. No one was absent.
There being a quorum present, Mayor Nix called the meeting
to order. Minutes of the 25 March 1991 regular session and
the 4 April 1991 special session were duly approved.
Councilwoman Puckett introduced, and moved for the adoption
of, the following resolution. Seconded by Councilman Duck,
motion passed unanimously:
RESOLUTION NO. 334-91
WHEREAS, the City of Fairhope has received notification of funding approval
for a FY 1990-1991 Community Development Block Grant, Economic Development
Infrastructure Grant, by letter of Governor Guy Hunt dated 4 April 1991; and
WHEREAS, said grant funds in the amount of $46,785.00, will be made avail-
able by the Alabama Department of Economic and Community Affairs to provide
a gravity -flow sanitary sewer line to serve the expansion of the Hoover
Group, Container Services Division, facility at the Fairhope Airport In-
dustrial Park; and
WHEREAS, the City of Fairhope has solicited telephone quotes and proposals
for the provision of administrative services, said solicitation being con-
ducted in conformance with ADECA Policy Letter No. 1, Rev. 3, dtd 10/16/89; and
WHEREAS, the proposal and quote from Phillip Roth & Associates is considered
reasonable and in the best interest of the City of Fairhope; NOW, THEREFORE
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FAIRHOPE, ALABAMA, as follows:
Section 1. That the City of Fairhope enter into a contract with Phillip Roth
and Associates for the provision of administrative services for the implementation
of a FY 1990-1991 CDBG Economic Development Infrastructure Grant to install
sanitary sewer service to the Hoover Group, Container Services Division,
expansion at the Fairhope Airport Industrial Park.
Section 2. That said contract and contract price is determined reasonable
and in the best interest of the City of Fairhope.
Section 3. That James P. Nix, in his capacity as Mayor, is hereby authorized
and directed to execute said agreement on behalf of the City of Fairhope.

Councilman Bishop introduced, and

RESOLUTION NO. 335-91
moved for the adoption of,

BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF FAIRHOPE,
ALABAMA, That HARMON, MOORE & ASSOCIATES, INC., of Fairhope,
is hereby retained as the City's consulting engineer on the
relocation of water, sewer, and gas lines on Greeno Road
(State Highway) project. Compensation for these services
will be as per State Highway Department rules as the City
will be reimbursed for the engineering cost by the State
Highway Department.

Council discussed the retention of Electrical Engineer
Steven Mothershed as the City's consulting engineer on the re-
location of electrical lines on the above Greeno Road project.
Electric Superintendent Aaron Norris presented a proposal from
Mr. Mothershed based on approximately 700 hours at $45.00/hour.
Councilman Bishop moved to retain Mr. Mothershed contingent
upon State Highway Department approval of the hourly rate.
Seconded by Councilman Duck, motion passed unanimously.
Council reviewed a written proposal from Colonial Bank
and The Harbor Shop (Bill Baldwin) offering to lease to the
City the "Fairhope Avenue Courtyard" located between the two
business locations on Fairhope Avenue, as a City Park. The
owners mentioned a 10-year term with a 10-year renewal option,
at $1.00/year, with all maintenance to be the city's responsibility.
Council will consider the offer for action at a later date.
Councilman Ford presented a written list of recommendations
for action by the City on the beach erosion problem between
Bay Winds Condominiums and Nichols Street on Mobile Bay. Council-
man Ford, as chairman of a committee composed of himself, Council -
members Duck and Bishop, and General Supt. Rutherford, suggested
(1) the city immediately seek a permit from the Army Corps
of Engineers for dredging, bulkhead construction, rip -rap,
and/or a combination of one or more method; (2) the city obtain
bids on a 650' bulkhead, on rip -rap and backfill, on dredging,
and on a portable dredge; (3) the City, after receiving bids,
make a decision on the scope of the work; and (4) recommend
a method of assessing the property owners for the costs be
found after the scope of work is determined.

Councilman Ford moved to take the actions outlined in the
Committee's memo. Seconded by Councilman Duck, motion passed
unanimously.
Councilman Duck moved to pay bills as presented. Seconded
by Councilwoman Puckett, motion passed unanimously.
Meeting was duly adjourned at 5:50 pm.
