The City Council, City of Fairhope, met in regular session
at 5:30 pm; Fairhope Municipal Complex Council Chamber;
161 North Section Street; Fairhope, Alabama 36532; on
Monday. 11 February 1991.
Present were Mayor James P. Nix; Councilmembers Roy C. White,
Jeanette Puckett, David E. Bishop, Michael A. Ford, and
John V. Duck; and City Clerk Evelyn Phillips. City Attorney
Marion E. Wynne was absent.
There being a quorum present, Mayor Nix called the meeting
to order. Minutes of the 28 January 1991 regular session
were duly approved.
Ms. Gay Lord, replacing Ms. Debbie Quinn as representative
from the Eastern Shore Junior Auxiliary, asked that February 10-16
be proclamed CHILD PASSENGER SAFETY AWARENESS WEEK. On motion
by Councilwoman Puckett, seconded by Councilman Ford and unani-
mously approved, Mayor Nix signed the proclamation requested.
Councilman Duck moved to accept the only bid received
to provide the recycling truck with a used tractor trailer,
Ward International Trucks of Mobile at $8,750.00. Seconded
by Councilwoman Puckett, motion passed unanimously.
Councilman Ford moved to authorize bid requests on a screen
for the wastewater treatment plant. The cost is estimated
at approximately $50,000 and was not in the current year's
budget. This equipment has not been replaced since 1973.
After discussion, Councilman Duck seconded the motion which
passed unanimously.
Councilman Ford moved to accept the 1989-90 Audit Report
prepared by Hartmann, Blackmon & Kilgore, PC, (formerly
S. F. Parker $ Company.) Seconded by Councilman Bishop, motion
passed unanimously.
Council reviewed a Declaration of Vacation of side lot
drainage and utility easements in South Rolling Oaks Sub -
Division, signed by all the owners. After discussion, Councilman
Bishop introduced, and moved for the adoption of, the following
resolution. Seconded by Councilman Duck, motion passed unanimously:

RESOLUTION NO..330-91
WHEREAS, a Declaration of Vacation signed by MABRY V. STONE, JR.,
(PRESIDENT, MABRY STONE BUILDERS, INC.), WILLIAM C. AND JEAN
CORWIN, MARK F. AND CANDACE ANN DURRETT, ARNOLD RICHARD AND
BROWNIE SUE CAIN, and ALMA L. PERRY, all the OWNERS of the land
upon which the following described side lot drainage and utility
easements are located; and which are situated in the City of
Fairhope, County of Baldwin, State of Alabama, has been duly
presented to the Mayor and Council of the City of Fairhope, Alabama,
on 11 FEBRUARY 1991 for the assent and approval of said governing
body; said Declaration with maps attached thereto and marked
"Exhibit All and made a part hereof; and
WHEREAS, the side lot drainage and utility easements above referred
to are more particularly described as follows:
Side Lot drainage and utility easements
on plat of Rolling Oak South Subdivision
encompassing Lots 1, 2, 3, 4, 5, 6, 71 8,
9, 10, 11, 12, 13; also the east side of
L o t 14 ; NV„
as shown on
Slide 1122-B in the Office of the Judge
of Probate, Baldwin County, Alabama.
WHEREAS, it appears to the Mayor and Council of the City of Fairhope,
Alabama, that the vacation of the said side lot drainage and utility
easements is in order and that no useful public purpose is served
in their continuance; NOW, THEREFORE
BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF FAIRHOPE, ALABAMA,
That the vacation of the hereinabove described side lot drainage and
utility easements is assented to and approved and the same is
hereby vacated.
ADOPTED THIS 11TH DAY OF FEBRUARY 1991.

Councilman Duck introduced, and moved for the adoption
of, the following resolution. Seconded by Councilman Ford,
motion passed unanimously:
RESOLUTION NO. 931- 91
WHEREAS, the Alabama Department of Economic and Community Affairs makes
grant funds available to units of local government to partially finance
public infrastructure improvements to serve new or expanding industries
that generate new employment that principally benefits low -and -moderate
income persons, and
WHEREAS, The Hoover Group, Inc., Container Services Division desires to
expand its Fairhope facility provided sanitary sewer is made available to
them to serve their existing and proposed expanded facility, and
WHEREAS, the expansion project will result in the addition of a minimum of
22 new full-time positions at the facility.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Fairhope, Alabama, as follows:
Section 1. That the City of Fairhope make application to the Alabama
Department of Economic and Community Affairs for a F.Y. 1991 Community De-
velopment Block Grant Economic Development Infrastructure grant for the
amount of $46,785.00 for the construction of approximately 2,750 L.F. of
sanitary sewer line to serve The Hoover Group, Inc., Container Services
Division and their expansion project that will result in the construction
of 10,400 S.F. of building addition and 22 new full-time employees.
Section 2. That the City of Fairhope hereby commits local match toward
project implementation of no less than $12,350.00 to consist of a combina-
tion of cash and in -kind labor and equipment.
Section 3. That James P. Nix, in his capacity as Mayor, is hereby author-
ized and directed to execute all required application forms and certifica-
tions on behalf of the City of Fairhope, and submit said application for
funding consideration.

Mayor Nix announced the Mobile Rose Society will be at
the Rose Garden, (Municipal Pier Fountain), on Saturday,
February 23rd, to give a free demonstration on the care and
pruning of roses. Cuttings will be given away.
The city will celebrate Arbor Day on Wednesday, February 27th,
at the Civic Center. Free seedlings will be given away to
Fairhope residents and the Beautification Committee will make
awards.
The city auction is scheduled for 9:00 am, Saturday,
February 16th. Auction authorized several meetings back.
Councilman Ford reported on the recycling program. We
are selling paper, glass, and aluminum but have not yet found
a buyer for plastics. Ford said we need more participants.
The meeting held on the City Museum project was well attended
according to Councilman Ford.
Several hundred trees have been donated to the city by
Mason McGowin. Plantings are now being carried out all over
town.
Councilwoman Puckett moved to pay bills as presented.
Seconded by Councilman White, motion passed unanimoualy.
There being no other business to come before the Council,
meeting was duly adjourned at 5:46 pm.
