HomeMy WebLinkAbout01-28-1991 Regular Meeting1160 STATE OF ALABAMA X COUNTY OF BALDWIN Z The City Council, City of Fairhope, met in regular session at 5:30 pm; Fairhope Municipal Complex Council Chamber; 161 North Section Str.eet; Fairhope, Alabama 36532; on Monday, 28 January 1991. Present were Mayor James P. Nix; Councilmembers Roy C. White, Jeanette Puckett, David E. Bishop, Michael A. Ford, and John V. Duck; City Attorney Marion E. Wynne and City Clerk Evelyn Phillips. No one was absent. There being a quorum present, Mayor Nix called the meeting to order. Minutes of the 14 January 1991 regular session were duly approved. Representatives from the Baldwin County Electric Membership Corporation were present and presented a $5,470.80 check in payment of their privilege license. A Publice Hearing was held for the second time as advertised on the proposed CDBG grant from ADECA to extend a sewer line at the Fairhope Industrial Park. No one present had any comment. Councilman White moved for final adoption of ORDINANCE NO. 871, an ordinance introduced at the last regular session, to a�utiorize the Building/Zoning Official to assign property numbers. Seconded by Councilman Duck, motion passed unanimously. Councilman Duck moved for final adoption of ORDINANCE NO. 872, an ordinance introduced at the last regular session, to establish speed limits within the city. Seconded by Council- woman Puckett, motion passed unanimously. Councilman Bishop moved for final adoption of ORDINANCE NO. 873, an ordinance introduced at the last regular session, to adopt local amendments to the National Electric Code. Seconded by Councilman Duck, motion passed unanimously. A Public Hearing was held as advertised on a proposed ordinance to amend the Zoning Ordinance-- Section 7.6153 and 7.6154 (Accessory Buildings), Section 8.9 (Penalties), and to add a new Section: 5.7 Parking District P1. Mayor Nix advised the Planning & Zoning Commission recommends adoption of this proposed ordinance. No one present was opposed. After some discussion, Councilman White introduced ORDINANCE NO. 874. In order to take immediate action on this ordinance, Councilman Bishop moved to suspend the rules. Seconded by Councilman Duck, motion to suspend passed unanimously by the following vote: AYE -White, Puckett, Nix, Bishop, Ford, and Duck. NAY - none. Councilman Duck then moved for final adoption of 28 January 1991 1161 ORDINANCE NO. 874. Seconded by Councilman Bishop, motion to final a opt passed unanimously by the following vote: AYE -White, Puckett, Nix, Bishop, Ford, and Duck. NAY -none. Councilwoman Puckett introduced, and moved for the adoption of, the following resolution. Seconded by Councilman Ford, motion passed unanimously: RESOLUTION NO. 329-91 WHEREAS, An adequate road system is essential to the traveling public for their safety and convenience as well as the orderly growth and development of the community; and WHEREAS, US 98 from Highway 104 to Barnwell is a heavily -traveled, overcrowded, unsafe two-lane highway; and WHEREAS, The Mayor and Council of the City of Fairhope have been on record for a great number of years asking for and supporting the four-laning of US 98 through Fairhope; and WHEREAS, now Federal Funds have been obtained for the four-laning of this highway; NOW, THEREFORE BE IT RESOLVED That the Mayor and City Council of the City of Fairhope strongly urge and request that the four-laning of this highway proceed immediately and that this project be given top priority by the State Highway Department; and BE IT FURTHER RESOLVED That the least amount of right-of-way that is necessary for the four-laning of this road be obtained so as to cause the least amount of disruption and inconvenience to the resi- dents and businesses in this area; and BE IT FURTHER RESOLVED That the Mayor and City Council go on record as favoring a five -lane urban type highway with curbs and guttering being installed at least through the City of Fairhope with the fifth lane, where not used as a turning lane or stacking lane, not be paved so the City can landscape the medium. After some discussion, Councilman Bishop moved to allow the meetings to be televised so long as commercials are not aired or kept to a minimum before and after the meetings, and that no structural accommodations are required. Seconded by Councilman Duck, motion passed unanimously. 28 January 1991 1162 Council reviewed a Beer Off -Premises License application by Warren L. Finch, dba POINT CLEAR GROCERY, located at 14730 Scenic Highway 98 in Point Clear. This location has a Beer Off -Premises License under the former owner. There was police approval of the applicant. No one present was opposed to the license. Councilman White moved for approval of the license. Seconded by Councilwoman Puckett, motion to approve passed unanimously. There being no further business, meeting was duly adjourned at 5:40 pm. , Mayor
