HomeMy WebLinkAbout01-14-1991 Regular Meeting1156 STATE OF ALABAMA X COUNTY OF BALDWIN Z The City Council, City of Fairhope, met in regular session at 5:30 pm; Fairhope Municipal Complex Council Chamber; 161 North Section Street; Fairhope, Alabama 36532; on Monday. 14 January 1991. Present were Mayor James P. Nix; Councilmembers Roy C. White, David E. Bishop, Michael A. Ford, and John V. Duck; City Attorney Marion E. Wynne and City Clerk Evelyn P. Phillips. Councilwoman Jeanette Puckett was absent. There being a quorum present, Mayor Nix called the meeting to order. Minutes of the 17 December 1990 regular session were duly approved. Mayor Nix was sad to announce that long-time faithful attendee, Mr. Johnny Matthews, passed away this morning. Councilman Duck moved for final adoption of ORDINANCE NO. 869, an ordinance introduced at the last regular session concerning limited access to Quail Creek Drive. Seconded by Councilman Bishop, motion to adopt passed unanimously. Councilman Ford moved for final adoption of ORDINANCE NO. 870, an ordinance introduced at the last regular session concerning the theft of recyclable materials placed outside for city pickup, such theft to be a misdemeanor. Seconded by Councilman Duck, motion to adopt passed unanimously. Mr. Carl McKeown came before Council to request permission to put a basketball goal on the end of Laurel Street. He had a signed statement from all the neighbors saying they did not object to the kids practicing in the street. City Attorney Wynne said he could only recommend that this permission not be given by the Council because it would make the City very liable for any accident. Mr. McKeown asked if all the neighbors signed a hold -harmless agreement, would that make a difference. It was explained that a point of law was involved and such agreements would be void if an accident occurred. No one offered to make a motion, request for permission therefore is denied. Councilman White introduced an ordinance in writing desig- nating the Building/Zoning Official as the official having jurisdiction to assign, re -assign or adjust property numbers within the city as provided therein. This ordinance will be given final consideration at the next regular Council session. 14 January 1991 1157 Councilman Duck introduced an ordinance in writing to amend City of Fairhope Code of Ordinances, Sections 20-5 and 20-6 concerning speed limits within the City. This ordinance will be given final consideration at the next regular Council session. Councilman Bishop introduced an ordinance in writing to adopt local amendments to the 1991 National Electrical code; said local amendments set out in booklet form entitled "CITY OF FAIRHOPE ELECTRICAL CODE 1991." This ordinance will be given final consideration at the next regular Council session. Mayor Nix advised that Mr. Eddy Hagler of Rudy's Automotive Parts had sent in a request for the Council to establish private parking space at his downtown store. Councilman White commented he would be glad to provide private parking if a way could be shown to provide private spaces for all the downtown merchants. Request denied due to lack of a motion. Councilman Ford moved to accept the low bid as recommended, provided all specifications are met. Seconded by Councilman White, motion passed unanimously. Councilman Bishop moved to accept the low bid as recommended, provided all specifications are met. Seconded by Councilman Duck, motion passed unanimously. 14 January 1991 1159 Ms. Kolleen Crandall, Eastern Shore Chamber of Commerce, made a presentation of several plaques to first -and -second place winners in various categories for floats in the recent Christmas parade. Ms. Crandall thanked the city and all the employees who were so helpful during the holidays. Councilman White reported that he, Councilwoman Puckett, and Building Official Lunsford had met with the Flag Committee, Fairhope First organization, to discuss their offer to provide flags for the City's use. Fairhope First proposes to donate funds to the city to have made several flags saying "Welcome to Fairhope" for use on special occasions or for placement at the entrances to Fairhope. Councilman White moved that we accept the funds with the provision that the city is to designate the colors of the flags, and where and when the flags are to be flown. Seconded by Councilman Bishop, motion passed unanimously. Councilman Ford reported the recycling project is doing well and that more bins will be available about January 23rd. Councilman Bishop moved to hear the following business not on the Agenda. Seconded by Councilman Duck, motion passed unanimously: Councilman Duck moved to approve application for a CDBG grant from ADECA (approximately $47,000) to extend a sewer line at the Industrial Park to allow The Hoover Group, Inc., to expand and make available nineteen additional jobs. Seconded by Councilman Ford, motion passed unanimously. As already advertised, a Public Hearing was immediately held for any public comments on this project. Another Public Hearing will be held on January 28th. No one spoke. The Spring Fever Chase organization requested permission to erect a tent at the Municipal Pier on March 15th (Arts & Crafts weekend) for use in making their awards presentations. So moved by Councilman White. Seconded by Councilman Duck, motion passed unanimously. Councilman Duck moved to pay bills as presented. Seconded by Councilman Ford, motion passed unanimously. Senior Bowl football practice is again being held at the Fairhope Stadium this week. State of the City address by Mayor Nix is scheduled for Sunday, January 20th, at 2:00 pm.
