The City Council, City of Fairhope, met in regular session
at 5:30 pm; Fairhope Municipal Complex Council Chamber,
161 North Section Street; Fairhope, Alabama 36532, on
Monday, 14 September 1987.
Present were Mayor James P. Nix; Councilmembers Roy C. White,
Michael A. Ford, and Barney L. Shull; City Attorney James H.
Reid and City Clerk Evelyn P. Phillips. Absent were Council -
members Jeanette Puckett and David E. Bishop.
There being a quorum present, Mayor Nix called the meeting
to order. Minutes of the 24 August 1987 regular session were
duly approved.
Mayor Nix introduced Jack Thomas and John Sledge of the
Baldwin County Historical Development Committee who advised
Council that the inventory of historical homes in Fairhope
is now complete. The inventory has been sent to Montgomery
for approval and then will go on to Washington for the addition
to the National Register. A sketch of the plaque to be used
on each home was displayed, and a copy of the inventory was
presented to the City.
Mayor Nix introduced Mr. Bob Young of the Frazer -Lanier
Company of Montgomery, the City's fiscal agents. Mr. Young
advised Council of the good reception of the City's new bonds
for the 1987-88 Public Improvements Assessments project, that
the City again received an "A" rating from Standard $ Poor's,
and that the average interest rate will be 6.790.
Councilman Shull introduced Ordinance No. 798 in writing,
an ordinance to provide for the issuance of $590,000 principal
amount of General Obligation Warrants, dated 1 September 1987,
of the City of Fairhope. Councilman White moved that unanimous
consent be given for immediate consideration of and action on
said ordinance, which motion was seconded by Councilman Ford
and, upon said motion being put to vote, the following vote was
recorded: AYE - Nix, Ford, Shull, White. NAY - none. Mayor
Nix thereupon declared that the motion for unanimous consent
for immediate consideration of and action on said ordinance was
unanimously carried. Councilman Shull thereupon moved that
Ordinance No. 798 be finally adopted, which motion was seconded
by Councilman Ford and, upon the said motion being put to vote,
the following vote was recorded: AYE - Nix, Ford, Shull, White.
NAY - none. The Mayor thereupon announced that the motion for
adoption of said ordinance had been unanimously carried.
Council reviewed an application for a Wine On/Off Premises
License by Trisha Lo Porto, dba LO PORTO FOODS, located at
410 Fairhope Avenue. No one present was opposed to the license.
There was police approval. Councilman Shull moved for approval

of the application. Seconded by Councilman Ford, motion passed '
unanimously.
Council reviewed an application for a Beer Off -Premises License
and a Wine Off -Premises License by Robert Word, dba JOY'S
PATIO, located at 9 North Church Street. No one present was
opposed to the licenses. There was police approval. Councilman
White moved for approval of the application. Seconded by
Councilman Ford, motion passed unanimously.
Councilman Ford introduced, and moved for the adoption of,
the following resolution. Seconded by Councilman Shull, motion
passed unanimously:
RESOLUTION NO. 230-87
WHEREAS, a certain Court Decision recently opened the way for
possible additional General Revenue Sharing Funds to
be distributed to all prior recipients; and
WHEREAS, the City of Fairhope has used its General Revenue
Sharing Funds to fund the Public Library appropriation
which is currently funded in whole by the general
funds of the City;
THEN, THEREFORE, If the City of Fairhope does receive any additional
General.Revenue Sharing Funds,
BE IT RESOLVED that such funds shall be used for the Fairhope
Public Library just as has been done in the past.
ADOPTED THIS 14th DAY OF SEPTEMBER, 1987.

Councilman Shull introduced, and moved for the adoption of,
the following resolution. Seconded by Councilman Ford,
motion passed unanimously:

RESOLUTION NO. 231-87
BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF FAIRHOPE
That:
That certain street known as ECHO LANE WEST located in Unit 5
of Covered Bridge Estates in the City of Fairhope, Alabama,
is hereby accepted for maintenance by the City of Fairhope on
recommendation of the Design Engineer (Moore Engineering
Associates) as per Section 19-2, Fairhope Code of Ordinances.
ADOPTED THIS 14th DAY OF SEPTEMBER, 1987.
Councilman White moved to authorize the Mayor to receive bids
on a Leaf and Straw Vacuum Machine for the Street Department.
Seconded by Councilman Shull, motion passed unanimously.
Councilman Ford moved to delete Jeff Thompson and James A.
Sisk from the Police Reserve roster. Seconded by Councilman
White, motion passed unanimously.
Upon receipt of written notice from the Eastern Shore Chamber
of Commerce, Councilman Shull moved to confirm that the Chamber
will be in charge of the Fourth of July Celebration in 1988.
Seconded by Councilman Ford, motion passed unanimously.
Mayor Nix announced that Mason McGowen and the Airport Board
are working hard on the Air Show to be held at the Municipal
Airport on Saturday, September 19th, to dedicate the new runway.
Admission is free, show will begin at 1:00 pm.
Councilman White moved to pay bills as presented. Seconded
by Councilman Shull, motion passed unanimously.
