COUNTY OF BALDWIN X
The City Council, City of Fairhope, met in regular session
at 5:30 pm; Fairhope Municipal Complex Council Chamber,
161 North Section Street,.Fairhope, Alabama 36532 on
Monday, 10 August 1987.
Present were Mayor James P. Nix; Councilmembers Roy C.
White, Michael A. Ford, and Barney L. Shull; City Attorney
James Reid and City Clerk Evelyn Phillips. Councilmembers
Jeanette Puckett and David E. Bishop were absent.
There being a quorum present, Mayor Nix called the meeting
to order. Minutes of the 27 July 1987 regular session were
duly approved.
Councilman White moved for final adoption of Ordinance
No. 795, an ordinance amending City Code Section 7-6 by
redefining Fire District #1, which had been introduced at
the last regular session. Seconded by Councilman Ford, motion
passed unanimously.
A public hearing was held on a Beer and a Wine Off -Premises
License application by Paul Buck, dba TWIN BEACH GROCERY located
in the police jurisdiction at the intersection of County roads
#44 and #3. No one present was opposed to the licenses. There
was police approval. Councilman Shull moved to approve the
licenses. Seconded by Councilman Ford, motion passed unanimously.
Councilman Ford moved to approve a payroll -deduction plan
for donations to the South Baldwin United Way group. Seconded
by Councilman White, motion passed unanimously. -
Council discussed a letter from the Eastern Shore Chamber
of Commerce which requested approval of the Chamber's plan to
turn the Fourth of July celebration over to the Jaycees.
Councilman Ford questioned whether or not any other civic
group had been asked or had shown an interest in this project.
It was decided to hold the request over to the next regular
meeting for action.
Councilman White introduced, and moved for the adoption of,
the following resolution authorizing a contract between the
City and the Baldwin County Commission for weekly mosquito
spraying but with a provision that the City protests the County's
charging $63.00 per hour for the service. The Mayor is to write
the Commissioners and ask them to reconsider their position --
City residents pay county tax as do county residents --Why can't
City be sprayed at no charge at least as many times as is the
County? --Isn't this double taxation? Seconded by Councilman
Ford, motion passed unanimously:

RESOLUTION NO. 228-87
BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF FAIRHOPE
THAT we confirm and authorize a contract between the City and
the BALDWIN COUNTY COPMISSION for the spraying of public streets
with mosquito spray by the Commission's Department of Parks.
and Land Management in the City of Fairhope. This work shall
commence within two weeks of the date of this contract (7/23/87)
and continue through October, 1987. Spraying shall be on a
weekly basis at a rate of $63.00* per hour. Any and all other
terms shall be as described in said contract date 23 July 1987.
*under protest.

As recommended by the city auditors, Councilman White
moved to authorize the write-off of $5,782.42 in returned
checks which date back to 1979. Seconded by Councilman Ford,
motion passed unanimously.
Councilman Shull introduced an ordinance to amend the
"Holidays" list in Chapter V, Section 2, of the Personnel Rules
and Regulations (delete Mardi Gras Day and insert Memorial Day);
a section of the ordinance will also confirm Council action
taken in February, 1987, under Resolution No. 216-87, amending
Section 3, "Annual Leave". This ordinance will be given
final consideration at the next regular meeting.
Councilman White introduced, and moved for the adoption of,
the following resolution. Seconded by Councilman Ford, motion
passed unanimously:
RESOLUTION NO. 229-87
BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF FAIRHOPE
THAT the Mayor is authorized to execute a contract between
the City and ZINDER MANAGEMENT SERVICES, INC., for services
as listed in said contract; said services to assist the City
Utilities in complying with the OSHA Act of 1970 and in estab-
lishing and maintaining an effective on -going accident pre-
vention program. Basic fees to be $154.00 per month plus travel
and outofpocket expenses. Term is for one year from date of
contract with an automatic one-year renewel; termination, however,
can be by either party upon a 30-day written notice.

Councilman Ford introduced an ordinance to amend Court
Costs by raising Traffic Costs to $34.00 per case and Non -
Traffic Costs to $44.00 per case. (Bond forfeiture costs did
not increase, remained $17.00 per case.). This new cost is
effective August 17, 1987, in compliance with state law. In
order to immediately consider this ordinance, Councilman Shull
moved to suspend the rules. Seconded by Councilman White,
motion passed unanimously by the following vote: AYE - White,
Nix, Ford, Shull. NAY - none. Councilman Ford then moved
for final adoption of Ordinance No. 796. Seconded by Councilman
Shull, motion passed unanimously by t e following vote: AYE -
White, Nix, Ford, Shull. NAY - none.
Councilman Shull moved to authorize the Mayor to contact
Frazer -Lanier Company for the financing of the 1987-1988 Public
Improvements Assessments Project. Frazer -Lanier already had
most of the information needed from the 1986-87 PIA Project
which just concluded this past April. Seconded by Councilman
Ford, motion passed unanimously.
Mr. William Nolte advised Council of a sewer drain problem
at his home at 103 North Street. Street Supt. Kant said they
know about the problem and it is on the list to be fixed.
Mrs. Walter E. Johnson asked Council if anything could be
done about the new electrical line being installed in her
neighborhood. She and her neighbors are upset about utility
poles being installed in front of their homes on Ingleside.
Mrs. Johnson asked that someone meet with her group to discuss
moving the line behind their property.
Mayor Nix asked the media to help get the word out that
people are riding horses and three-wheelers on the new golf
course and this must stop. Anyone caught will face a stiff
fine.
Council discussed the plans recently submitted to the
Planning $ Zoning Commission and reported in the local news
on the proposed new Post Office to be constructed on Fairhope
Avenue. Everyone agreed that they dislike the proposed building.
Councilman Ford moved that the Mayor write to the Post Office
officials in Atlanta, with a copy to local Congressmen and
Senators, and ask for a change in the building exterior. Seconded
by Councilman Shull, motion passed unanimously.
Councilman Shull moved to pay bills as presented. Seconded
by Councilman White, motion passed unanimously.
Meeting was duly adjourned at 6:21 pm.
