The City Council, City of Fairhope, met in regular session
at 5:30 pm; Fairhope Municipal Complex Council Chamber,
161 North Section Street, Fairhope, Alabama 36532, on
Monday, 13 July 1987.
Present were Mayor James P. Nix; Councilmembers Roy C.
White, Jeanette Puckett, David E. Bishop, Michael A. Ford,
and Barney L. Shull; City Attorney James Reid and City Clerk
Evelyn Phillips. No one was absent.
There being a quorum present, Mayor Nix called the meeting
to order. Minutes of the 22 June regular session and the
29 June special session were duly approved.
The following bids were opened by Moore Engineering Con-
sultants on July loth as advertised. This is to do the work
on the 1987-1988 Public Improvements Assessment Project:

Councilman Bishop introduced, and moved for the adoption of,
the following resolution. Seconded by Councilman Shull,
motion passed unanimously:

BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF FAIRHOPE
ALABAMA AS FOLLOWS:
Section 1. That the bid of TEMCO, INC.,.of Bay Minette, Al.,
or the sum of $496,215.57 for the construction of the im-
provements described in Improvements Ordinance No. 789 be and
the same hereby is accepted, this being the lowest responsible
bid submitted.
Section 2. That the Council has investigated and ascertained
and hereby finds .that Temco, Inc., is duly licensed and is a
qualified bidder under the terms of.the Notice to Contractors
published in the EASTERN SHORE COURIER, a newspaper of general
circulation in the City of Fairhope, in the issues of 1: July
and 8 July 1987, and that its bid was accompanied by a bid
bond in a sum not less than 5% of the total bid price.
Section 3. That contract for the improvements described in
Improvements Ordinance No. 789 be awarded to Temco, Inc.,
on submission of surety bond for the faithful completion of
said improvements according to contract in the full amount of
the bid price, executed by a bonding company licensed to do
business in the State of Alabama.

Councilman Shull moved for final adoption of Ordinance
No. 792, an ordinance making several amendments to the
Zoning Ordinance. Seconded by Councilwoman Puckett,
motion passed unanimously.
Councilwoman Puckett moved for final adoption of
Ordinance No. 793, an ordinance amending Section 19-2(a)
of the City of Fairhope Code of Ordinances having to do
with paving specifications. Seconded by Councilman Shull,
motion passed unanimously.
Council discussed a proposed ordinance to amend the
Harbor Board section of the City Code (Sec. 6-6). Council-
man White asked that the phrase "of the following year" be
inserted in Section One, paragraph (B), after the words
"14 August"; and that the phrase "after a 30-day notification
from the Harbor Board" be inserted in Section One, paragraph
(E), after the words "Harbor Board." With these changes,
Councilman White introduced the ordinance which will be
considered for final adoption at the next regular session.
Mayor Nix advised that he would like to nominate William
L. (Buddy) Richmond for appointment to the Planning and
Zoning Commission to complete the unexpired term of the
late E. B. Gwin (to May, 1988). There being no other nomi-
nations, Councilman Shull moved to close the nominations and
to appoint Mr. Richmond by acclamation. Seconded by
Councilman Ford, motion passed unanimously.
Council reviewed the following bid openings by the

Councilman Bishop moved to accept the low bid, provided all
specifications are met. Seconded by Councilwoman Puckett,
motion passed unanimously.

Councilman Shull moved to pay bills as presented. Seconded
by Councilman Ford, motion passed unanimously.
Meeting was duly adjourned at 5:58 pm.
