Nix, Mayor CONSENT TO HOLDING OF MEETING The undersigned members of the City Council of the City of Fairhope, Alabama, do hereby acknowledge service of the Notice and Call of Special Meeting hereinabove set forth and do hereby consent to the holding of such meeting at such time and in such place and for the purpose set forth therein. 857 STATE OF ALABAMA COUNTY OF BALDWIN X The City Council, City of Fairhope, met in special session at 5:30 pm; Fairhope.Municipal Complex Council Chamber, 161 North Section Street, Fairhope, Alabama 36532 on Monday, 29 June 1987. The purpose of this meeting was to hear a petition to vacate an alley by Fairhope Single Tax Corporation; to hear a request to transfer Fairhope Aviation Services, Inc., Lease to Fairhope Aero, Inc., as recommended by the Airport Board; and to hear a report on bids opened by the Fairhope Recreation Board for the Municipal Golf Course. Present were Mayor James P. Nix; Councilmembers Roy C. White, Jeanette Puckett, David E. Bishop, Michael A. Ford, and Barney L. Shull; Attorney James Smith for City Attorney Reid and City Clerk Evelyn Phillips. No one was absent. There being a quorum present, Mayor Nix called the meeting to order. A public hearing was held on the Fairhope Single Tax Corpo- ration (and its leaseholders) request to vacate an alley located between Fairhope and Stimpson Avenues and Brown & School Streets. Proof of required advertisements was presented. No one present was opposed to the vacation. After discussion, Councilman Bishop introduced, and moved for the adoption of, the following resolution. Seconded by Councilman Ford, motion passed unanimously: Resolution on following page. RESOLUTION N0: oU. '-P WHEREAS, Fairhope Single Tax Corporation heretofore filed with the City of Fairhope, Alabama, a Petition asking that it assent to the vacation of a portion of an alley situated in Block C of Division 3 of the lands of Fair - hope Single Tax Corporation, which said portion of said alley is hereinafter described and which is located within the corporate limits of the City of Fairhope, Alabama; and WHEREAS, the City Council of the City of Fairhope, Alabama., did appoint the 29th day of June, 1987, as the date for the hearing of said Petition;. and WHEREAS, all notices required by law of the.filing of -said Petition and of the date set for the hearing of the same have been given and proof thereof has--been-made-to-the City of Fairhope, Alabama; and WHEREAS, the City of Fairhope, Alabama, has determined, and does hereby de- termine, that all of the owners of the property and leasehold interests and security interest in improvements located on all of the property abutting said alley have executed a Declaration of Vacation which was presented to the City along with said Petition and that no other owner of any land or leasehold interest in lands located in the immediate vicinity of the por- tion of the alley sought to be vacated will be cut off from access to their property or leasehold as a result of the vacation of the portion of the alley hereinafter described; and WHEREAS, it has been brought to the attention of the City of Fairhope, Alabama, that a portion of its sanitary sewer'system.is located in the west six (6) feet of a portion of the alley sought to be vacated and the City of Fairhope must of necessity retain the right of access to said portion of the sani- tary sewer system; and WHEREAS, it has been made to appear to the City of Fairhope, Alabama, that the United States'Postal Service proposes to acquire the lands abutting the portion of the alley sought to be vacated and the improvements located thereon and to erect a post office on the property to be acquired and that it would be to the best interest of the City of Fairhope, Alabama, and to its citizens to assent to the vacation of said portion of said alley; NOW, THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FAIRHOPE, ALABAMA, in special session duly assembled that it does hereby assent to and approves the vacation of the following described portion of the alley located in Block C of Division 4 of the lands of Fairhope Single Tax Corporation, to -wit: All of the alley shown on the map or plat of Block C, Division 4, according to the replat of a portion of the lands of Fairhope Single Tax Corporation, recorded - in Map Book 1, page 134, in the Office of the. Judge of Probate of Baldwin County, Alabama, EXCEPT the west 132 feet thereof, and subject to the right of the City of Fairhope to own, operate and maintain a part of its sanitary sewer system in the west six (6) feet of the vacated portion of said alley. ADOPTED THIS 29th DAY OF JUNE, 1987. A ST J b P. Nix, Mayor OCity Clerk 29 June 1987 859 Councilwoman Puckett moved to approve a transfer of lease from Fairhope Aviation Services, Inc., to Fairhope Aero, Inc., as requested by the Airport Board. Seconded by Councilman Shull, motion passed unanimously. Council reviewed the following bids on work at the Golf Course, opened by the Recreation Board on June 16th as adver- tised: PAVING Vendor Total Cost H. 0. Mobile, Al Total Cost $ 9,000.00 $ 15,000.00 Total Cost $ 93,941.00 base bid $ 131,133.00 base bid Councilman White moved to accept the low bid on the paving by Weaver $ Sons, less revisions (deductions), making the low bid $57,497.00; and rejecting all bids on the moving and renovations of existing building.
