HomeMy WebLinkAbout02-09-1987 Regular Meeting817 STATE OF ALABAMA X COUNTY OF BALDWIN X The City Council, City of Fairhope, met in regular session at 5:30, p.m.; Fairhope Municipal Complex Council Chamber; 161 North Section Street; Fairhope, Alabama 36532; on Monday, 9 February 1987. Present were James P. Nix; Councilmembers Roy C. White, Jeanette Puckett, David E. Bishop, Michael A. Ford, and Barney L. Shull; City Attorney James Reid and City Clerk Evelyn Phillips. No one was absent. There being a quorum present, Mayor Nix called the meeting to order. Minutes of the 26 January 1987 regular session were duly approved. Mayor Nix reopened the public hearing, continued from the 12 January 1987 regular session, on rezoning requests by Vernon Bodden and Tom Brown. The Planning & Zoning Commission recommendation on Mr. Brown's request was to approve the re- zoning from R1 to B4 with two provisions: (1) a 40-foot right-of-way reserve, and (2) ingress and egress to be on Estelle Drive only. No one present spoke in favor of or in opposition to this rezoning. Councilman Bishop introduced an Ordinance to rezone as requested. This ordinance will be considered for final adoption at the next regular Council session. The Planning & Zoning Commission recommendation on Mr. Bodden's request was for denial. Mr. and Mrs. Bodden were present and asked the Council to rezone their property as requested. No one present spoke in opposition. After discussion, the request was denied due to lack of action by any councilmember. Mr. Bodden asked if the Council would send a request to the Planning & Zoning Commission to allow him to reapply for rezoning under the 12-month rule with the beginning date of July (he thought), 1986, instead of from this date, since action had been delayed for an extended time. Mayor Nix advised that Council could not take such an action since the Planning $ Zoning Commission would be the proper party for Mr. Bodden to present -his request and their rules and regulations would determine their reply. Mr. Bodden asked that his request be entered in the minutes of this meeting. Council reviewed a proposal by the Eastern Shore Chamber of Commerce for the funding of an Economic Development Project. After some discussion, Councilman White introduced, and moved for the adoption of, the following resolution. Seconded by Councilwoman Puckett, motion passed unanimously: 9 February 1987 818 RESOLUTION NO. 214-87 WHEREAS, the Eastern Shore Chamber of Commerce has presented a well -planned outline for an Economic Development Project to assess and market the Eastern Shore area to ensure its economic future and prosperity; and WHEREAS, we, the governing body of the City of Fair - hope, are in agreement with the goals and methods of this Project and consider it a vital step toward the continued well-being of our community; and WHEREAS, the Chamber estimates the Project funding at $8,200.00; THEN THEREFORE BE IT RESOLVED that the City of Fairhope is hereby authorizedby its governing body to enter into a con- tract with the Eastern Shore Chamber of Commerce for the successful completion of its proposed Economic Development Project; and BE IT FURTHER RESOLVED that the Miyor;and.the City Clerk are authorized to transfer to the Chamber the total sum of Two Thousand Dollars ($2,000) from the General Funds of the City for this important undertaking. ADOPTED THIS 9th DAY OF FEBRUARY, 1987. Councilman Ford introduced, and moved for the adoption of, the following resolution. Seconded by Councilman Shull, motion passed unanimously: RESOLUTION NO. 215-87 BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF FAIRHOPE, ALABAMA, as follows: That certain street designated LILLIAN CIRCLE, in Deep Tree Forest SubDivision, 4th Addition, and dedicated by official plat at Map Book 10,.page 33, in the Probate Records of Baldwin County, Alabama; be, and the same hereby is, accepted and designated as a public thoroughfare of the City of Fair - hope and is to be maintained by the City. ADOPTED THIS 9th DAY OF FEBRUARY, 1987. 9 February 1987 819 Councilman Ford introduced, and moved for the adoption of, the following resolution. Seconded by Councilman Shull, motion passed unanimously: RESOLUTION NO. 216-87 BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF FAIRHOPE, ALABAMA, as follows: I. Personnel Rules & Regulations, Chapter V. Leaves of Absence, Section 3 - ANNUAL LEAVE, is hereby amended to read as follows: "Salaried employees of the City of Fairhope who have been in continuous employment of the City for twelve (12) months or longer shall be entitled to two (2) weeks vacation each year with pay, those who have been in continuous employment of the City for ten (10) years or longer shall be entitled to three (3) weeks vacation each year with pay, and those who have been in continuous employment of the City for twenty (20) years or longer shall be entitled to four (4) weeks vacation each year with pay." (Section 3 [a] Scheduling - remains as written with appropriate changes of 1S years to 10 years, and 2S years to 20 years.) II. This resolution shall take effect immediately but is not to be implemented retroactively. Each employee's annual leave days will be adjusted according to this new policy by the Personnel Director on each Anniver- sary Date next following the adoption date of this resolution. ADOPTED THIS 9th DAY OF FEBRUARY, 1987. Councilman Shull moved to approve the Mayor's writing a letter to Fairhope Aviation Services, Inc., advising that a taxiway easement will be given for Rohr Aero Services as requested, with a hold -harmless clause and a revisionary clause to be included. Seconded by Councilwoman Puckett, motion passed unanimously. Council reviewed the report on the following bid opening for 24 Class 2 70-ft Utility Poles: 9 February 1987 820 Vendor Cost Delivery Thomasson Lumber Co Philadelphia, Ms $ 10,560.00 30 days Hatfield $ Co Mobile, Al $ 11,256.00 14 days Stallworth Timber Co Beatrice, Al $ 123,060.00 45 days Huxford Pole & Timber Huxford, Al No Bid Treated Timber Products Pensacola, Fl $ 11,736.00 28 days Philadelphia Products Mobile, Al $ 11,238.24 21 days Baldwin Pole & Piling Bay Minette, Al No Bid Councilman Bishop moved to accept the low bid from Thomasson Lumber Company, provided all specifications are met. Seconded by Councilman Ford, motion passed unanimously. Mayor Nix announced that Arbor Day will be celebrated on Wednesday, 25 February 1987. A program will be presented at 10:00 that morning at the Municipal Pier. Councilman Shull moved to hear the following two items of business not on the Agenda. Seconded by Councilman Bishop, motion passed unanimously: Due to'a number of complaints about traffic, Councilman Bishop moved to have installed a 4-way Stop Sign at the intersection of Nichols and Church Street. Seconded by Councilman Shull, motion passed unanimously. Councilman Shull moved to request bids on two new police cars. Seconded by Councilwoman Puckett, motion passed unanimously.
