The City Council, City of Fairhope, met in regular session
at 5:30 o'clock, P.M., Fairhope Municipal Complex Council Chamber,
161 North Section Street, Fairhope, Alabama 36532, on
Thursday, 27 December 1984.
Present were Mayor James P. Nix; Councilmembers Roy C. White,
Trisha Nelson, David E. Bishop, Michael A. Ford, and Barney L.
Shull; City Attorney James Reid and City Clerk Evelyn Phillips.
No one was absent.
There being a quorum present, Mayor Nix called the meeting
to order. Minutes of the 10 December 1984 regular session were
duly approved.
Councilman Bishop moved to authorize Mayor Nix to execute
a gas line easement between the City and Edward W. Hilderbrandt.
Seconded by Councilman Shull, motion passed unanimously.
Council read and discussed a petition signed by some 15
neighbors of Dan and Sandra Lee, 505 North Ingleside Street,
in protest of the Lee's installing a Beauty Shop in their
garage. Several of the neighbors were in the audience and
Mr. Lee was present. It was explained that, under the Home
Occupation provisions of the Zoning Ordinance, Mr. Lee was
in compliance and could operate the Shop so long as he did
not violate the strict provisions of that section of the Ordinance.
A point brought out in the discussion was that perhaps the
Zoning Ordinance should be changed so that home occupations
would not be allowed in R1 zones. Council agreed that this
matter should be studied and that an answer would be forthcoming.
Mr. Robert O'Shall asked the Council to consider having the
Police stop their practice of opening locked cars when asked
to do so and instead referring the matter to a locksmith.
Mr. O'Shall, and his friend Mr. Baker, both of whom are locksmiths,
pointed out that newer model cars can be damaged by the "slim
jim" device used by the police which could lead to damage claims
against the City. After some discussion, Mayor Nix summed up by
saying Fairhope is still small enough to tend toward helpfulness
and did not feel the Police should be asked to discontinue the
service; however, with the media's help, he and other members
of the Council would like to hear from the public on this
subject before considering any changes.
