HomeMy WebLinkAbout12-10-1984 Regular Meeting625 STATE OF ALABAMA X COUNTY OF BALDWIN X The City Council, City of Fairhope, met in regular session at 5:30 o'clock, P.M., Fairhope Municipal Complex Council Chamber, 161 North Section Street, Fairhope, Alabama 36532, on Monday. 10 December 1984. Present were Mayor James P. Nix; Councilmembers Roy C. White, Trisha Nelson, David E. Bishop, Michael A. Ford, and Barney L. Shull; City Attorney James Reid and City Clerk Evelyn Phillips. No one was absent. There being a quorum present, Mayor Nix called the meeting to order. Minutes of the 29 November 1984 regular session were duly approved. Mayor Nix declared a Public Hearing was now open, as requested and advertised by the Medical Clinic Board -East. There were no comments. Council reviewed an application for a Restaurant Liquor License by Patricia Scallio, dba SANTO'S ITALIAN CUISINE, located at 902 Morphy Avenue. There was police approval. No one present was opposed to the license. Councilman Shull moved for approval of the application. Seconded by Councilwoman Nelson, motion passed unanimously. Attorney Reid reported to Council that the lease between the City and Theatre 8:15, a corporation, was in full force and effect. Mr. Tom Pocase, as president,. and his Board of Directors have been replaced by Ms. Pat Miller as president and a new Board of Directors; however, the corporation remains the same. Councilman Ford moved to reject Mr. Pocase's offer to purchase the building leased to Theatre 8:15 and to state said building, located on the corner of Church Street and Morphy Avenue, to be not for sale. Seconded by Councilman Shull, motion passed unanimously. Councilman Bishop introduced, and moved for the adoption of, the following Resolution to contract with United Gas Pipe Line Company with the stipulation that the words "All of Buyer's requirements" must be deleted from Article I. Seconded by Councilwoman Nelson, motion passed unanimously: 10 December 1984 626 RESOLUTION NO. 142-84 BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FAIRHOPE ALABAMA, that the Mayor is authorized to execute a renewal of the City's contract with UNITED GAS PIPE LINE COMPANY, a Delaware Corporation, for the pur- chase of natural gas for resale and distribution through the City's Gas System serving the community of Fairhope, Baldwin County, Alabama, and its adjoining environs. This contract to became effective on January 1, 1985, and shall continue and remain in force and effect for a period ending at 7:00 a.m. on January 1, 2000. ADOPTED THIS loth DAY OF DECKER, 1984. Seconded by Councilman Shull, motion passed unanimously: RESOLUTION NO. 143-84 WHEREAS, the environs of the Bay area are rich in a variety of natural, commercial, recreational, industrial, and aesthetic resources of immediate and potential value to the present and future well-being of this area; and WHEREAS, the Bay area and the fish, shellfish, and other living marine resources'and wildlife therein are ecologically fragile and consequently vulnerable to destruction by man; and WHEREAS, there is an ever increasing demand upon the land, air and water of the Bay area caused by population growth and economic development; and WHEREAS, there is great concern about the potential damage that could result from the transportation, burning, and storage of hazardous waste material in the Bay area; NOW . REFORE BE IT RESOLVED that the Fairhope City Council, recognizing the potential damage that could result from an accident involving hazardous waste material, calls upon the State Legislature to adopt laws, rules, and regulations in co-operation with the Counties and Municipalities in the Bay area to prohibit hazardous waste material from being brought into the area for disposal b an method or storage. A.M., Friday, December 7th, and the following report made to Council: OEC Business Interiors Mobile, Al $ 285.00 Furniture only CampuMaster Daphne, Al $5,525.00 NEC Computer System (including $273.00 on furniture) Wayne Smith, Inventory Controller, recommended that the CompuMaster bid be accepted. So moved by Councilman White. Councilwoman Nelson seconded and motion passed unanimously. Sue Eubanks, Diane Upchurch, and Evelyn Glass made a written request for free use of the Civic Center on Christmas Day. They wanted to prepare and serve a Christmas Dinner to the elderly and the needy at no charge. Several of the councilmembers commended the ladies on this worthy project, however, they suggested that some other location be sought since the use of the Civic Center would require the presence of three or more City Employees thus depriving those employees of the one Holiday all employees plan to spend with their families. There would also be City expense, and both these situations might not be true at a local Church or Civic Hall. One of the ladies was present and she said she understood.. She said they had sought the use of the Civic Center first and would now contact other organizations. The Eastern Shore Chamber of Commerce made a written request to be placed in charge again this year for the Fourth of July festivities. Councilman White questioned whether the Chamber would participate'in the expense of the fireworks this year. After some discussion, Councilman Bishop moved to advise the Chamber that Council is receptive to the idea but would like to know if expense of the Fireworks could be shared. Seconded by Councilman Shull, motion passed unanimously. Councilman Bishop moved to authorize the Mayor to execute an extension of the SEPA.contract for one month (to 12/31/84) and for any future extensions until new contract is prepared. Seconded by Councilman Shull, motion passed unanimously. Mayor Nix advised that the November 17th City Auction was a success and $5,375.75 was added to the City's revenues. The Fairhope Garden Club has presented the "Yard of the Month" award to the City for it's plantings, reforestration, and general beautifi- cation efforts; and in particular, the Christmas decorations.
