HomeMy WebLinkAbout12-09-1984 Regular Meeting536 STATE OF ALABAMA X COUNTY OF BALDWIN X The City Council, City of Fairhope, met in regular session at 5:30 o'clock, P.M., Fairhope Municipal Complex, Council Chamber, 161 North Section Street, Fairhope, Alabama 36532, on Monday, 9 January 1984. Present were Mayor James P. Nix; Councilmembers Roy C. White, Trisha Nelson, David E. Bishop,, and Michael A. Ford; City Attorney James Reid and City Clerk Evelyn Phillips. Absent: none. Minutes of the 28 December 1983 regular session and the 5 January 1984 special session were duly approved. A duly advertised public hearing was held on a proposed Ordinance to amend Zoning Ordinance No. 557 by revising the uses prohibited in a B-2 General Business District. No one present offered any comment. Councilman White introduced the ordinance. An application for a Restaurant Liquor License by George A. Fadalla, dba FADALLA'S FAMILY RESTAURANT, located in the Baldwin Square Shopping Center, was considered. Applicant was approved by the Police Department. No one present was opposed. Councilwoman Nelson moved to approve the application. Seconded by Councilman Ford, motion passed unanimously. Mr. Nasser Parvirnouh made a written request to Council to waive Fee to use the Civic Center to present a demonstration of his exercise program for handicapped persons. After dis- cussion, Councilman Bishop moved to deny the request. Seconded by Councilman White, motion passed unanimously. Councilwoman Nelson introduced, and moved for the adoption of, the following Resolution. Seconded by Councilman Bishop, motion passed unanimously: 537 RESOLUTION NO. 101-84 VoRmEA.S, the City of Fairhope and the Fairhope Public Library, operated by the Library Board of the City of Fairhope, does have a nondiscriminatory policy of no discrimination on the basis of race, creed, color, sex, religion, national origin or physical handicap in employment, programs, activities and practicies, and WHEREAS, the Office of Revenue Sharing, under 31 CFR Part 51, paragraph 51.55, asks that a re�f3irmation of a nondiscriminatory policy on the basis of handicap be evidenced by a resolution and evaluation, THEN THEREFORE, BE IT RES(LVED BY THE MAYOR AND COUNCIL OF THE CITY OF FAIRHOPE, ALABAMA, as follows: 1. It shall be the policy of the City of Fairhope and of the Fairhope Public Library (recipient of all Revenue Sharing Funds) to comply with the above nondiscriminatory policy and especially 31 CFR Part 51,(51.55), which relates to discrim- ination on the basis of handicap. 2. The City of Fairhope requests that the Library Board, at its next regular meeting, evidence compliance with said policy by adopting a resolution stating that the Fairhope Public Library shall not discriminate on the basis of handicapped status in admission or access to, or treatment or employment in, its programs and activities; that the Director of the Fairhope Public Library be designated as coordinator of the Library's efforts to comply with 31 CFR Part 51,(51.55); and that any person who desires to file a complaint alleging violation of this policy should file such complaint, in writing, with said Fairhope Public Library Director. Any such complaint shall be presented to the Library Board at its next regular meeting for consideration and the person filing the complaint shall be given the opportunity to explain his position to the Board. BE IT FURTHER RESOLVED that this Resolution shall be presented to the Chairman of the Library Board, that it shall be published once in a newspaper of general circulation, announced once over a local radio station, and posted for 3 days at the Fairhope Public Library, the Fairhope City Hall, and the Fairhope Post Office. ADOPTED THIS 9th DAY OF JANUARY, 1984. ` 4 s AP.x, Mayor City erk 9 January 1984 538 A group of citizens from Covered Bridge Estates asked to be heard by the Council. Mr. Dennis Porter, spokesman, advised that he and 4 of his neighbors in one area of Covered Bridge Estates had been having problems with the copper pipe in their homes and they would like some of the City's utility personnel to come out and inspect the piping for a possible solution to the problem. All of them reported that small pinholes were appearing in the pipe with resultant water leaks and several plumbers had been unable to discover the reason. Supt. Rutherford was asked to investigate. Councilwoman Nelson moved to pay bills as presented. Seconded by Councilman Ford, motion passed unanimously. Mayor Nix opened the floor for nominations to fill the Council position, Place No. 5, vacated by Mr. Sam Box's resignation on January 5. Councilwoman Nelson nominated Mr. Barney L. Shull of 217 Pecan Avenue. Mr. Shull had served as a Councilman under two previous administrations and presently serves as Chairman of the Recreation Board. There being no further nominations, Councilwoman Nelson moved to appoint Mr. Shull. Seconded by Councilman White, motion passed unanimously. Meeting was duly adjourned. ff City �lerk
