HomeMy WebLinkAbout11-29-1984 Regular Meeting622 STATE OF ALABAMA X COUNTY OF BALDWIN X The City Council, City of Fairhope, met in regular session at 5:30 o'clock, P.M., Fairhope Municipal Complex Council Chamber, 161 North Section Street, Fairhope, Alabama 36532, on Monday, 29 November 1984. Present were Mayor James P. Nix; Councilmembers Roy C. White, Trisha Nelson, David E. Bishop, and Michael A. Ford; City Attorney James Reid and City Clerk Evelyn Phillips. Absent: Councilman Barney L. Shull There being a quorum present, Mayor Nix called the meeting to order. Minutes of the 12 November 1984 regular session were duly approved. Councilwoman Nelson moved for final adoption of Ordinance No. 751, an ordinance to amend Sick Leave regulations to allow retiring employees to use accumulated sick days prior to Retirement Date. Seconded by Councilman White, motion passed unanimously. Council reviewed an application for a Restaurant Liquor License by Norma Chevalier, dba EDWARDS'CAFE, 14 South Church Street. Ms. Chevalier had recently obtained a beer and a wine on -premises license, but patrons were requesting mixed drinks. There was police approval, no one present was opposed to the license. Councilman White moved for approval. Seconded by Councilman Ford, motion passed unanimously. Mayor Nix advised of a need toappointan alternate for the Board of Adjustments & Appeals, and also that he had been contacted by former Board member Clarence McCoy who said he would like to serve as an alternate. After some discussion, Councilwoman Nelson nominated Mr. McCoy. There being no other nominations, Councilman Bishop moved to close the nomi- nations. Seconded by Councilman Ford, motion passed unanimously. Mr. McCoy is appointed. In connection with this appointment, Councilman Ford introduced, and moved for the adoption of, the following Reso- lution. Seconded by Councilwoman Nelson, motion passed unani- mously: RESOLUTION NO. 141-84 WHEREAS, Clarence E. McCoy has served the City of Fairhope as a member of the Board of Adjustments & Appeals for over twenty years with dedication and distinction; and these years of service have been marked by exemplary and energetic leader- ship in the vital accomplishments of this Board; and WHEREAS, Mr. McCoy has announced his resignation as Chairman of this Board effective 1 October 1984; NOW THEREFORE 1 29 November 1984 623 Res. No. 141-84 continued: BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE CITY OF FAIRHOPE, that this Council, speaking on behalf of all our people, publicly goes on record as com- mending MR. CIARENCE MCCOY for his outstanding efforts and voicing our appreciation for his leadership in all areas of community improvement. ADOPTED THIS 29th DAY OF NOVEMM, 1984. �• J?IIA P. Nix, Mayor lxf=02 City 01 erk Councilwoman Nelson moved to authorize bid requests on a computer for the warehouse. Seconded by Councilman Bishop, motion passed unanimously. Members of the Council had received a written offer to purchase the Church Street Building presently under lease to Theatre 8:15. The building is also the location of the SR. AIDES -office and the office of the local ABC Board official. The offer to buy came from Mr. Thomas Pocase who was present. After some discussion, Council asked City Attorney Reid to first determine and advise them of the status of the lease before taking any action. Council discussed the renewal of the City's contract with United Gas Pipe Line Company. The new contract will run from 1 January 1985 to 1 January 2000. The contract had the approval and recommendation to adopt from Attorney Miller of the law firm in Washington which represents the United Municipal Dis- tributors Group (of which Fairhope is a member), however several questions about the contract could not be resolved. Councilwoman Nelson moved to table the contract renewal until the next reg- ular session. Seconded by Councilman Bishop, motion passed unanimously. At the last regular session of the Council, Mr. Sweeney of the Fairhope Elks' Club was promised an answer at this session to his request for permission to solicit funds for Baskets for the Needy at street intersections (Road Blocks). Consensus was to deny the request in keeping with a city policy established in 1981 which prohibits Road Blocks for any type of solicitation, even though each member of the Council expressed support of the project. Mr. Sweeney expressed understanding of the Council position, said the answer was expected, and said the Club had an alternate plan ready. 29 November 1984 624 Mayor Nix recognized visitors from the City of Chickasaw... Mayor E. W. Parker and Councilman Leroy Averette. Mayor Parker introduced Chickasaw's maritime consultant George Constantine who made a lengthy presentation of a plan to protect Mobile Bay from the proposed hazardous materials disposal by shipping said materials from the Port of Chickasaw down through Mobile Bay to the Gulf. Mr. Constantine wanted the City to adopt a resolution prepared by him however several of the Councilmembers objected to the wording of the resolution while assuring Mayor Parker and Mr. Constantine they were in favor of trying to do something about the hazardous materials problem. While Mr. Constantine's resolution was not adopted, the City will prepare and introduce a Resolution at the next regular session which will show our support of efforts to prevent hazardous materials disposals as presently planned and our willingness to adopt a joint resolution with other Bay counties and municipalities to that effect.
