The City Council, City of Fairhope, met in regular session
at 5:30 o'clock, P.M., Fairhope Municipal Complex Council Chamber,
161 North Section Street, Fairhope, Alabama 36532, on
Monday. 12 November 1984.
Present were Mayor James P. Nix; Councilmembers Roy C. White,
Trisha Nelson, David E. Bishop, Michael A. Ford, and Barney L.
Shull; City Attorney James Reid and City Clerk Evelyn Phillips.
No one was absent.
There being a quorum present, Mayor Nix called the meeting
to order. Minutes of the 22 October 1984 regular session were
duly approved.
Mr. Sweeney of the Elks Club addressed the Council to
request a waiver of the City's policy against allowing charitable
solicitations at street intersections. Mr. Sweeney asked for
this waiver on December lst and 8th so the Elks could solicit
funds for their Christmas Baskets for the Needy. He said the
road blocks would be at the intersection of Magnolia Avenue &
Section Street and at Morphy Avenue & Section Street. After
some discussion, Mr. Sweeney was told his request would be
studied and an answer given at the next regular session.
Councilwoman Nelson moved for the final adoption of
Ordinance No. 750, an ordinance changing city cigarette tax
to a per -cigarette basis without regard to the number of cigarettes
to a pack. Seconded by Councilman Shull, motion passed unanimously.
Mr. Lunsford presented a sketch of some proposed new signs
directing traffic to the Municipal Pier and Beach area. Council-
man Bishop moved to approve the plan, and the purchase of the
signs. Seconded by Councilman Shull, motion passed unanimously.
Councilman Bishop nominated Mr. Jim Merrihew (an alternate)
for a 3-year term on the Board of Adjustment & Appeals.
Mr. Merrihew would replace Mr. Clarence McCoy who had requested
not to be reappointed. There being no other nominations,
Councilman Shull moved the nominations be closed. Seconded by
Councilman Ford, motion passed unanimously. Mr. Merrihew is
appointed.
Last Tuesday, November 6, 1984, was the first time for
Fairhope and surrounding area citizens (Precinct 2) to cast
their ballots at the Civic Center instead of the Ft. Riel Armory.
This was a General Election (Presidential) and an unusual large
turn -out caused some difficulties. After some discussion,
Councilwoman Nelson introduced, and moved for the adoption of,
the following Resolution. Seconded by Councilman Ford, motion
passed unanimously:

RESOLUTION NO. 139-84
WHEREAS, on November 6th, approximately five thousand (5,000)
people voted in Precinct 2, Territory 4; which
caused extremely long waiting time in long lines; and
WHEREAS, there are over nine thousand (9,000) voters registered
to vote in Precinct 2, Territory 4; and
WHEREAS, the present number of voting machines (9) cannot
possibly accommodate the voters in Precinct 2,
Territory 4; THEN 'THEREFORE
BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE CITY OF FAIRHOPE
that the Baldwin County Commission be urgently requested to
purchase an additional six (6) Voting Machines for Precinct 2,
.Territory 4; bringing the total number of machines to 15; so as
to allow citizens to exercise their right to vote without the
extremely long waiting periods which occurred November 6th.

Councilwoman Nelson introduced, and moved for the adoption
of, the following Resolution. Seconded by Councilman Bishop,
motion passed unanimously:

BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE CITY OF
FAIRHOPE That the following Holiday Schedule will be
observed by all City personnel except emergency employees:
THANKSGIVING - Thursday & Friday
November 22 & 23, 1984
'CHRISTMA.S - 1 day on Monday, December 24, 1984
1 day on Tuesday,December 25, 1984

Councilman Shull moved to adjust the Council regular
sessions in November and December as follows:
November 26 session moved to November 29
December 24 session moved to December 27
Seconded by Councilwoman Nelson, motion passed unanimously.
Councilman White introduced an Ordinance to amend the
City's Sick Leave regulations which would allow a retiring
employee to use accumulated sick leave time immediately prior
to Retirement Date.
Councilman Bishop moved to authorize the Mayor to execute
an extension of the expiration date on the SEPA contract to
30 November 1984. Seconded by Councilman White, motion passed
unanimously.
Councilwoman Nelson moved to pay bills as presented.
Seconded by Councilman Shull, motion passed unanimously.
Meeting was duly adjourned.
