HomeMy WebLinkAbout10-08-1984 Regular Meeting614 STATE OF ALABAMA COUNTY OF BALDWIN X The City Council, City of Fairhope, met in regular session at 5:30 o'clock, P.M., Fairhope Municipal Complex Council Chamber, 161 North Section Street, Fairhope, Alabama 36532, on Monday, 8 October 1984. Present were Mayor James P. Nix; Councilmembers Roy C. White, Trisha Nelson, David E. Bishop, Michael A. Ford, and Barney L. Shull; City Attorney James Reid and City Clerk Evelyn Phillips. No one was absent. There being a quorum present, Mayor Nix called the meeting to order. Minutes of the 24 September and the 1 October 1984 sessions were duly approved. A public hearing was held on the rezoning request by John and Ella Robertson, and others, on property located on Nichols Avenue between Young and Mershon Streets. The property owners were requesting a change from R2 Residential to B1 Local Shopping. Councilman White reported that the Planning & Zoning Commission recommended approval of the request. No one present was opposed. Councilman Shull introduced an ordinance to rezone the property. Councilman White moved for 748, an ordinance setting time, T—or Council meetings. Seconded passed unanimously. final adoption of Ordinance No. place, and rules of procedure by Councilwoman Nelson, motion Councilman Bishop introduced, and moved for the adoption of, the following Resolution. Seconded -by Councilman Ford, motion passed unanimously: RESOLUTION NO. 137-84 WHEREAS, the City of Fairhope filed an application for fiords under Title I of the Housing and Urban Development Act of 1974 as administered through the State of Alabama Department of Economic and Community Affairs; and WHEREAS, the City has received notification of funding availability for said application prepared by Community Consultants, Inc., on the City's behalf; NOW, THEREFORE, BE IT RESOLVED by the Council of the City of FAirhope as follows: 1. That a contract for the preparation and administration of FY 1984 CDBG program be entered into between the City and Community Consultants, Inc. (Copy filed.) 2. That OMB Circular A-102 procurement standards requiring competitive negotiation does not apply due to the fact that Community Consultants, Inc., is and has been under contract to the City for similar services with a considerable back- ground and knowledge of local needs, data and circumstances. 8 October 1984 615 (Res. No. 137-84 continued:) The urgency of the situation does not permit delay incidental to negotiation. 3. That services to be rendered and compensation to be paid are consistant with other such contracts of the City. 4. That James P. Nix, in his capacity as Mayor, is authorized to execute said contract in behalf of the City of Fairhope. PASSED,APPROVED AND ADOPTED THIS 8th OF OCTOBER, 1984. O j, J P. Nix s , Mayor 'City erk Councilwoman Nelson moved to combine the offices of City Clerk and Treasurer. Seconded by Councilman Shull, motion passed unanimously. Councilman Shull moved to reappoint Mrs. Evelyn Phillips as City Clerk -Treasurer. Seconded by Councilwoman Nelson, motion passed unanimously. Councilwoman Nelson moved to reappoint Leo (Bud) Gilheart as Chief of Police. Seconded by Councilman Ford, motion passed unanimously. Councilman White moved to reappoint Marion E. (Tut) Wynne as Municipal Judge. Seconded by Councilman Shull, motion passed unanimously. This is a two-year term. Councilman Bishop moved to reappoint James H. Reid as City Attorney. Seconded by Councilwoman Nelson, motion passed unanimously. A budget hearing was held on proposed FY 1984-1985 budgets for the General Fund and the three Utility Systems (Gas, Electric, and Water & Sewer), including the appropriation of all Revenue Sharing funds to the Public Library. Mayor Nix went through all expected revenues and expenditures which totaled, for all funds: $10,357,134 revenue, $10,050,925 expense, and $306,209 excess revenue. After some discussion, Councilman Ford introduced, and moved for the adoption of, the following Resolution. Seconded by Councilman Shull, motion passed unanimously: 8 October 1984 616 RESOLUTION NO. 138-84 BE IT RESOLVED by the Mayor and Council of the City of Fairhope, Alabama, that the proposed Budget pre- sented and reviewed this 8th day of October, 1984, be hereby approved and adopted for FY 1984-1985; and BE IT FURTHER RESOLVED that Mayor James P. Nix is appointed Superintendent of Utilities at an annual salary of $7,200.00; payable $200.00 each month from the Electric Fund, $200.00 each month from the Gas Fund, and $200.00 each month from the Water & Sewer Fund; and BE IT FURTHER RESOLVED that the Annual Salaries of City Personnel shall be as shown on a list entitled "Annual Salaries of All City Personnel - Resolution No. 138-84"; said list filed in the Office of the Mayor, of the City Clerk, and of the Personnel Director; and BE IT FURTHER RESOLVED that employees receiving less than a total of six percent (6%) increase may be in- creased up to six percent (6%) upon the recommendation of their superintendent provided their performance has improved to justify the increase; and BE IT FURTHER RESOLVED that the Mayor be authorized to enter into a contract with the Eastern Shore Chamber of Commerce to promote the City of Fairhope. The contract shall be for one (1) year, 1 October 1984-30 September 1985, but may be canceled at any time. Contract shall call for a payment to the Eastern Shore Chamber of Commerce of $100.00 per month from the General Fund and $100.00 per month from each of the Utility funds; or $4,800.00 for the one-year term. Seconded by Councilman White, motion passed unanimously: Councilman Bishop moved to authorize the Mayor to execute a one -month (September) extension of the Southeastern Power Administration (SEPA) contract. Seconded by Councilman Ford, motion passed unanimously. 8 October 1984 617 Councilman Shull moved to pay bills as presented. Seconded by Councilman Ford, motion passed unanimously. Mayor Nix announced he would like to change some Committee Assignments made at the October 1 session. The appointments shall be: Gas, Water & Sewer - Shull Electric, Library - Bishop Recreation & Parks - Ford Finance & Audit - Nelson Streets, Court, & Fire - White Mayor Nix asked the news media to help publicize a recent problem with unknown persons who have opened fire hydrants in isolated areas causing a loss of water and endangering the community should a major fire occur while water pressure is down. Mayor Nix stated that this vandalism must stop, and if any persons are found guilty of tampering with fire hydrants, they will be prosecuted to the full extent of the law. Mr. John Matthews announced that the AARP is sponsoring a political forum on Thursday, October llth, in the Council Chamber at 10:15 A.M.
