COUNTY OF BALDWIN I
The City Council, City of Fairhope, met in regular session at
5:30 o'clock, P.M., Fairhope Municipal Complex Council Chamber,
161 North Section Street, Fairhope, Alabama 36532, on
Monday, 27 August 1984.
Present were Mayor James P. Nix; Councilmembers Roy C. White,
Trisha Nelson, David E. Bishop, Michael A. Ford, and Barney L.
Shull; City Attorney James Reid and City Clerk Evelyn Phillips.
Absent - none.
There being a quorum present, Mayor Nix called the meeting
to order. Minutes of the 13 August 1984 regular session were
duly approved.
Councilman Shull moved for approval of a Restaurant Liquor
License application by John Arvol Bishop for JULWIN'S, a restau-
rant located at 411 Fairhope Avenue. No one present was opposed.
There was police approval. Seconded by Councilman Ford, motion
passed by the following vote: AYE - White, Nelson, Ford, Shull.
NAY - none. ABSTAIN - Bishop.
Councilman Shull moved for final adoption of Ordinance No. 745,
an ordinance adopting the 1984 National Fire Code. Seconded by
Councilman Bishop, motion passed unanimously.
Councilman White moved for final adoption of Ordinance No. 746,
an ordinance amending Zoning Ordinance No. 557 by rezoning
Fairhope Single Tax property leased to C.E. and F.A. Bennett on
the corner of Pleasant Avenue and Prospect Street from R2 Medium
Density Single Family Residential to B2 General Business. This
approval based on a restrictive covenant attaching stipulations
imposed by the Council on recommendation from the Planning & Zoning
Commission which is to become part of the lease agreement for
present and future leasees. Seconded by Councilwoman Nelson,
motion passed unanimously.
Councilwoman Nelson introduced an ordinance to be known as
the Park and Street Tree Ordinance. The ordinance sets up•a
Park & Street Tree Committee, to be composed of the Mayor, two
Councilmembers, and three citizens, who will plan where, when,
and what type trees will be planted and/or removed in the City.
This is a step toward being named a Tree City, U.S.A.
Mr. Maxwell Killoch addressed the Council on the subject of
bike trails in the City. A committee, in 1972, set up bicycle
paths across the City for recreational purposes and for use by
students going to the various schools. Mr. Killoch presented a
diagram of the trails and an illustrated list of areas where the
trails need repair. He suggested a change should be made in the
trail from Fairhope Avenue to Magnolia Avenue - Summit Street
instead of Church Street. Councilman Shull advised that Mr. Killoch

had presented this information to the Recreation Board and
they recommended approval of the change and the maintenance as
presented. After discussion, Councilman Shull moved to take
the information under advisement and have the work done as
funds became available. Seconded by Councilman Bishop, motion
passed unanimously.
Councilwoman Nelson moved to hear the following business
not on the Agenda. Seconded by Councilman White, motion passed
unanimously:
Councilman Bishop read a letter to the City from Mrs. Marie
Lafferty of Myrtle Street which commended the City's Meter
Department Supervisor James Gillespie and Electrical Superintendent
Aaron Norris for their prompt and successful assistance when she
was having unusually high electrical costs. Mr. Gillespie and
Mr. Norris came to her home, inspected, and discovered a wiring
problem which was causing her electric heat and air conditioning
to operate at the same time.
Councilman White advised that Boy Scout Troop 261 had presented
a Life Preserver to the City in honor of Doug Berg's heroic act
last June when he saved a drowning man's life by diving off
the end of the Municipal Pier and pulling him to safety. The
preserver was turned over to Supt. Rutherford for attachment to
the Pier.
The meeting was duly adjourned.
