HomeMy WebLinkAbout07-23-1984 Regular MeetingSTATE OF ALABAMA X COUNTY OF BALDWIN X The City Council, City of Fairhope, met in regular session at 5:30 o'clock, P.M., Fairhope Municipal Complex Council Chamber, 161 North Section Street, Fairhope, Alabama 36532, on Monday, 23 July 1984. Present were Mayor James P. Nix; Councilmembers Roy C. White, Trisha Nelson, David E. Bishop, Michael A. Ford, and Barney L. Shull; City Attorney James Reid and City Clerk Evelyn Phillips. No one was absent. There being a quorum present, Mayor Nix called the meeting to order. Minutes of the 11 July 1984 regular session were duly approved. Councilman Shull moved to approve the Off -Premises Wine License application by Paula Watts, dba OBJECTS, located at 25 South Section Street. This is a new owner of an established business which had this type license. No one present was opposed; there was police approval. Seconded by Councilman White, motion passed unanimously. A petition for vacation of a city street was presented by the abutting property owners James E. Gaston, Jr., Willette D. Gaston, Lillian K. Green, Thomas E. Dyer, Sr., Louise G. Dyer, Charles F. LeeDecker, and Esther S. LeeDecker. After reading the Declaration of Vacation and some discussion, Councilman Bishop introduced, and moved for the adoption of, the following resolution. Seconded by Councilman Shull, motion passed unanimously: 23 July 1984 599 RESOLUTION NO. 131-84 WHEREAS, under Declaration of Vacation received the 23rd day of July, 1984, from JAMES E. GASTON, JR., Wlr,r,FTTE D. GASTON, LILLIAN K GREEN, THOMAS E. DYER, SR., LOUISE G. DYER, CHARLES F. LEEDECKER, and ESTHER S. LEEDECKER; and WHEREAS, in which and by which the above said parties have declared to be vacated that certain portion of HOYLE AVENUE legally described as follows: From the southeast corner of Section 29, T6S, R2E, run north along the east line of said Section 1320.4 feet to the centerline of Hoyle Avenue in the City of Fairhope, Alabama; thence run S 8911 43' 30" W along the centerline of Hoyle Avenue 458.59 feet to an iron pipe corner marker for a Point of Beginning: thence run N 000 12' 30" W, 208.74 feet; thence S 30 feet to a concrete and iron corner monument at the southeast corner of Greenwood Park subdivision (Map Book 8, Page 83, Probate Records, Baldwin County, Alabama); thence run S 001 08' 30" E, 30 feet; thence run S 89° 51' 32" E, 209.03 feet to an iron pipe corner marker; thence run N 000 12' 30" W, 30 feet to the Point of Beginning. Tract contains 0.2891 acres, and lies in the SE 1/4 of Fractional Section 39 T6S, R2E, Baldwin County, Alabama. and which property is within the corporate limits of the City of Fairhope, Alabama; and WHEREAS, the said parties have requested that the City of Fairhope acting by and through its City Council as the governing body thereof, assent to the said vacation of said street: NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FAIRHOPE, ALABAMA, AS FOLLOWS: 1. The City has and does hereby assent to the vacation of that portion of Hoyle Avenue described above. 2. Publication requirements have been met under Act No. 386, H. 1199, adopted 8/14/73, as per EASTERN SHORE COURIER issues 20 June 1984, 27 June 1984, and 4 July 1984, Fairhope, Alabama. 3. A certified copy of this Resolution shall be recorded in the Office of the Probate Judge of Baldwin County, Alabama. ADOPTED THIS 23rd DAY OF JULY, 1984. 23 July 1984 600 Bids were opened on a personal computer for the utility recorder system. Bids were received from Olensky Brothers, Fairhope; IBM Corporation, Mobile; Radix Corporation, Salt Lake City, Utah; and Baldwin Computer & Software, Foley. Due to the -technical nature of the bids, Councilwoman Nelson moved they be taken under advisement, studied, and a report made to Council at the next regular session. Seconded by Councilman Shull, motion passed unanimously. Fire Chief Don Walker reported only one bid was received on the Fire Pumper repairs - $12,731.38 by Fire Apparatus Specialists of River Ridge, Louisiana. Chief Walker stated the Volunteer Fire Department would pay up to 50% of the repair costs. After discussion, Councilman White moved to accept the bid. Seconded by Councilman Bishop, motion passed unanimously. Councilman Shull introduced an ordinance to prohibit certain truck traffic on residential streets in an area bound by Fairhope Avenue, Ingleside Street, Morphy Avenue, and Greeno Road. Councilman White moved to authorize bid requests on a load of pipe for the Gas Department. Seconded by Councilman Shull, motion passed unanimously. Mayor Nix opened the floor for nominations to fill an alternate position on the Board of Adjustments & Appeals. Councilman Bishop nominated Maxwell Killoch. There being no other nominations, Councilman Shull moved to close the nomi- nations. Seconded by Councilman Bishop, motion passed unanimously. Mr. Killoch is appointed. Councilwoman Nelson moved to hear the following two items of business not on the Agenda. Seconded by Councilman Ford, motion passed unanimously: The following bids were opened on fuel for city vehicles: Leaded Premium Regular Regular Unleaded Diesel Unleaded Fletcher Oil .8575 .8875 .788 - Merritt Oil .913 1.013 .925 .953 Delta Oil 1.01 1.04 1.0415 - Councilman White moved to accept the low bid, provided all speci- fications are met. Seconded by Councilwoman Nelson, motion passed unanimously. Councilwoman Nelson introduced Ordinance No. 743, an ordinance changing Airport Board member requirements to 1 City official, 3 city residents, and 1 city or police jurisdiction resident. In order to take immediate action, Councilman Shull moved to suspend the rules. Seconded by Councilman Ford, motion passed unanimously by the following vote: AYE - Nelson, Ford, Shull, White, Bishop and Nix. NAY - none. Councilwoman Nelson then moved for the 23 July 1984 601 final adoption of Ordinance No. 743. Seconded by Councilman Shull, motion passed unanimously by the following vote: AYE - Nelson," Ford, Shull, White, Bishop, and Nix. NAY - none. Mayor Nix opened the floor for nominations to the Airport Board due to the expiring term of Mr. Barnhill next month. Councilwoman Nelson nominated Mason McGowin. There being no other nominations, Councilman Ford moved to close the nominations. Seconded by Councilman Shull, motion passed unanimously. Mr. McGowin will serve a two-year term to August, 1986. Councilman Bishop moved to proclaim GASTON DAY" in Fairhope in honor of WW II B. Gaston who gave his life on 26 August a small village in France. The people of erected a monument in honor of Lt. Gaston each August 26th since they consider him village. Lt. Gaston destroyed seventeen going down.
