HomeMy WebLinkAbout06-11-1984 Regular Meeting585 STATE OF ALABAMA X i COUNTY OF BALDWIN X The City Council, City of Fairhope, met in regular session at 5:30 o'clock, P.M., Fairhope Municipal Complex Council Chamber, 161 North Section Street, Fairhope, Alabama 36532, on Monday, 11 June 1984. Present were Mayor James P. Nix; Councilmembers Roy C. White, Trisha Nelson, David E. Bishop, Michael A. Ford, and Barney L. Shull; City Attorney James Reid and City Clerk Evelyn Phillips. No one was absent. There being a quorum present, Mayor Nix called the meeting to order. The minutes of the 28 May 1984 regular session were duly approved. Councilman Shull introduced, and moved for the adoption of, the following Resolutions. Seconded by Councilman Ford, motion passed unanimously: 11 Jvne 1984 ... RESOLUTION NO. 1a� Yltl STATE OF ALABAMA COUNTY OF BALDWIN CITY OF FAIRHOPE WHEREAS, Sections 11-46-20 through 11-46-73 of the Alabama Code of 1975, as amended, provide for and regulate general and special elections in cities and towns of this state, except those cities and towns which have a Commission form of government; and WHEREAS, Section 11-46-43 prohibits write-in candidates in elections held under said Sections; and WHEREAS, Section 11-46-26 provides that if only one person has filed a statement of candidacy or has been nominated for an office for an election to be held pursuant to said Sections at the time the deadline for qualifi- cation has passed, then such person shall, for all purposes, be deemed elected to such office, and the Mayor or other chief executive officer shall not cause the name of such person or the office for which his candidacy was declared to be printed on the ballot, but he shall immediately file a written statement with the governing body of the municipality, attested by the Clerk, certifying the fact that only one person filed a statement of candidacy or was nominated for the office preceding the deadline set for an election of municipal officers of the municipality and setting forth the name of such person; and WHEREAS, said Section 11-46-26, as amended, provides that the governing body of the municipality, after receiving such statement, shall adopt a resolution declaring the person named in the statement duly elected to the office described in the statement, and shall issue a Certificate of Election to such person; and WHEREAS, the Mayor of the City of Fairhope, Alabama, has filed a written statement with the governing body of the municipality, attested by the Clerk, certifying the fact that only one person filed a statement of candidacy for the office of MAYOR prior to the deadline established in the notice of election and that the name of that person who filed such statement is JAMES P. (JIM) NIX NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FAIRHOPE that JAMES P. (JIM) NIX be and he is hereby declared duly elected to the office of MAYOR in the City of Fairhope for the term of office commencing on the first Monday in October, 1984; and BE IT FURTHER RESOLVED that the Mayor of the City of Fairhope, Alabama be and he hereby is directed to issue a certificate of election to JAMES P. (JIM) NIX for the office of MAYOR for such term pursuant to the provisions of Section 11-46-25, as amended. Seconded by Councilman White, motion passed unanimously: RESOLUTION NO. 128-84 WHEREAS, a regular municipal election has been called to be held on the loth day of July, 1984; and WHEREAS, Section 11-46-27 of the Alabama Code of 1975, as amended, provides, in part, that the municipal governing body, not less than 15 days before the holding of any municipal election, appoint from the qualified electors election officers to hold the election as follows: where voting machines are used, an inspector, a chief clerk, and a first and second assistant clerk for each voting machine; NOW, THEREFORE BE IT RESOLVED By the City Council of the City of Fairhope, Alabama, that the election officers for said election shall be: Chief Inspector: J. Nix, Mayor City ifterk 11 June 1984 The following bids were opened on miscellaneous equipment for the Volunteer Fire Department: Fyr-Fyter Sales & Service Mobile, Al Panama Fire Equipment Supply Panama City, Fla Slagle's South Boston, Va Harry'Harless Company Birmingham, Al Ellebracht Company Lake St. Louis, Mo $ 6,658.98 $ 7,651.10/Alt $7,591.10 $ 7,598.40/Alt $7,423.40 $ 6,727.00 Councilman White moved to accept the low bid, provided all speci- fications are met. Seconded by Councilwoman Nelson, motion passed unanimously. Councilman Shull moved to approve and authorize the Mayor to execute an Escrow Agreement between the'City; Major Homes, Inc.; and Southern Land Title, Inc., (Escrow Agent). This has to do with subdivision regulations and Covered Bridge Estates, Unit III. Seconded by Councilman Ford, motion carried by the following vote: AYE - Shull, Ford, Nelson, White. NAY - Bishop. Councilwoman Nelson introduced a Mr. Drinkwine who offered a suggestion on the Pier Street Boat Ramp. Mr. Drinkwine said soil wash -out at the ramp could be slowed by the use of paper felt or paper mesh, a material that would allow water to go through but retain sand. Mr. Drinkwine also suggested the County be contacted about the condition of their boat ramp at Mullet Point. This ramp is, according to Mr. 8rinkwine, inaccessible to passenger vehicles due to bad ground condition and this is resulting in heavier usage of the City ramps. Councilman Shull moved to reject all bids on the personal computor to be used with the utility recorder system and to request rebids on this item. Seconded by Councilman Bishop, motion passed unanimously. Councilman White moved to hear the following item not on the Agenda. Seconded by Councilwoman Nelson, motion passed unanimously: Councilwoman Nelson moved that the first regular Council session in July be rescheduled from July 9th to July llth at 10:00 o'clock, A.M. Seconded by Councilman Shull, motion passed unanimously. Councilman Bishop suggested an open house for the new City Hall be scheduled as soon as possible. j 11 June 19.84 590 I Councilwoman Nelson moved to pay bills as presented. Seconded by Councilman Ford, motion passed unanimously. Mr. Bill Haynes of the Volunteer Fire Department advised Council that application for a "3" rating for the City was being forwarded today.
