The City Council, City of Fairhope, met in regular session
at 5:30 o'clock, P.M., Fairhope Municipal Complex, Council
Chamber, 161 North Section Street, Fairhope, Alabama 36532,
on Monday, 23 January 1984.
Present were Mayor James P. Nix; Councilmembers Roy C.
'White, Trisha Nelson, David E. Bishop, Michael A. Ford, and
Barney L. Shull; City Attorney James Reid and City Clerk Evelyn
Phillips. Absent: none.
Mayor Nix and Council welcomed new member, Barney L. Shull.
A plaque was presented to former member, Sam E. Box, in appreciation
for his service. Mr. Box served from 1968 to his resignation on
5 January 1984.
Minutes of the 9 January 1984 regular session were duly
approved.
Councilwoman Nelson moved to hear the following business not
on the Agenda. Seconded by Councilman Bishop, motion passed
unanimously:
Mr. Harley Dupler presented a check from the Baldwin County
Electric Membership Corporation in the amount of $4,099.11 for
annual business license based on gross receipts in the Pi during
1983.
Councilman Ford moved for final adoption of Ordinance No. 735,
an ordinance amending the Zoning Ordinance by revising the uses
prohibited in B-2 General Business zones. Seconded by
Councilman Shull, motion passed unanimously.
Councilman White moved to reappoint Municipal Judge Marion E.
(Tut) Wynne, Jr. until end of present administration's term,
10/1/84. Judge Wynne's present term expires 1/27/84. Seconded
by Councilwoman Nelson, motion passed unanimously.
Councilman Bishop moved to authorize bid requests on 200
LP Gas Regulators and a 1-Ton Truck & Chassis for the Gas
Department. Seconded by Councilman Shull, motion passed unanimously.
Mrs. Tommie Werneth, administrator of the current CDBG pro-
ject, reported that two bids on curb & gutter work had been
received - Fairhope Paving Company at $64,650 and Valta Construction
at $66,150 - and asked Council to approve the acceptance of the
low bid from Fairhope Paving Company. So moved by Councilman
Bishop. Seconded by Councilman White, motion passed unanimously.
Councilman Ford introduced, and moved for the adoption of,
the following Resolution. Seconded by Councilman Shull, motion
passed unanimously:

RESOLUTION NO. 102-84
WHEREAS, the City of Fairhope did collect $26,645 for
Business Licenses from concerns located in
the Police Jurisdiction of the City, and
WIRES, the Fairhope Police Department did expend the
sum of $110,817.92 for police protection; and
the Fire Department did expend an additional
sum for fire protection; in the Police Juris-
diction of the City,
BE IT RESOLVED that the expense of Fire and Police pro-
tection in the Police Jurisdiction of the City of Fairhope,
Alabama, did exceed the revenue received from Business
Licenses issued to locations in said Police Jurisdiction.
ADOPTED THIS 23rd DAY OF JANUARY, 1984.

Mayor Nix called attention to the new City Seal emblem which
is now installed on the back wall of the Chamber. This emblem
was a gift to the Mayor from the City Hall Employees and Mayor
Nix wished to publicly express his thanks for the beautiful
addition to the Council Chamber.
Mayor Nix also advised that the 1982-1983 City Audit report
had been delivered and was available at City Hall for public
inspection. A copy has also been placed in the Public Library.
A report will be made at the next regular session on this audit.
