HomeMy WebLinkAbout12-28-1983 Regular Meeting533 STATE OF ALABAMA X COUNTY OF BALDWIN X The City Council, City of Fairhope, met in regular session at 5:30 p.m., Fairhope Municipal Complex, Council Chamber, 161 North Section Street, Fairhope, Alabama,Mon,Dec. 28, 1983. Present were Mayor James P. Nix; Councilmembers Sam E. Box; Michael A. Ford, Roy C. White, Trisha Nelson and David Ed Bishop; City Attorney James Reid and Acting City Clerk Betty Rivenbark. Minutes of the December 12, 1983 regular session were duly approved as written. Councilman White moved for final adoption of Ordinance No. 734 , an amendment to Section 4-2 City of Fairhope Code of Ordinances pertaining to Alcoholic Beverage Operating Hours. Seconded by Councilman Box, motion carried by the following vote: AYE -White, Box, Bishop, Nelson, Ford, Nix. NAY -none. The Mayor brought to Council's attention request from Magnolia Bar & Grill to stay open under the Alabama State Law closing hours that was carried over to give Mr. Calmetti time to talk to all residents within 200 ft. of property. Mr. Calmetti had presented evidence of no disapproval of his staying open. Councilman White moved based on letters presented to grant him privilege of staying open. Sam Box seconded and motion carried unanimously. There was request for permit to house a pony on Greeno Road on the Agenda, but due to illness of applicant this is postponed until further notice. Councilman Box moved to hear the following business not on the agenda. Seconded by Trisha Nelson, motion passed unan- imously: Mr. Walter Woodrow addressed the Council about his being assess- ed for water and sewer on his property on Middle Street on the current street improvement project, when he already has water and sewer on Ingleside(where house fronts). Further discussion led to a motion by Councilman Box to delete this water and sewer charge from his assessment, Councilwoman Nelson seconded. Motion passed with one nay vote by Councilman White, who stated that Mr. Woodrow had ample time to voice opinion at two public hearings and now is not the time to come up after everything is finalized bringing up things that could have been discussed openly in the public hearings. Mr. Woodrow also reported some washing on his property as a result of the paving of Middle St. Supt. Rutherford to get with him to see best solution for this problem.
