HomeMy WebLinkAbout11-21-1983 Regular Meeting519 STATE OF ALABAMA X COUNTY OF BALDWIN X The City Council, City of Fairhope, met in regular session at 5:30 o'clock, P.M., Fairhope Municipal Complex, 161 North Section Street, Fairhope, Alabama 36532, on Monday, 21 November 1983. Present were Mayor James P. Nix; Councilmembers Roy C. White, Trisha Nelson, David E. Bishop, Michael A. Ford, and Sam E. Box; City Attorney James Reid and City Clerk Evelyn Phillips. Absent - none. Minutes of the 14 November 1983 regular session were duly approved. Mayor Nix presented framed Distinguished Service Awards to members of the Fairhope Volunteer Fire Department in recognition of their many volunteer hours of service. Councilwoman Nelson moved to approve an application for an Off -Premises Wine License by David C. Stapleton, Sr., dba E-Z PIC, INC., located 859 Fairhope Avenue. Application has police approval. No one present voiced a protest against the issuance of this license. Motion seconded by Councilman Ford, motion passed unanimously. Councilman Bishop moved for final adoption of Ordinance No. 732, an ordinance to allow early beginning of required advertising of proposed ordinances on Zoning Ordinance amendments. Seconded by Councilman Box, motion passed unanimously. Councilman Ford introduced, and moved for the adoption of, the following Resolution. Seconded by Councilman Bishop, motion passed unanimously: RESOLUTION NO. 96-83 BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF FAIRHOPE, ALABAMA, THAT SAID GOVERNING BODY WILL HEAR AND RULE ON ANY WRITTEN OBJECTIONS PRESENTED AGAINST THE ASSESSMENTS TO BE ASSESSED FOR THE 82-83 PUBLIC IMPROVEMENTS PROJECT BY THE FOLLOWING RULES & REGULATIONS: 1. Each property owner of record will be sent a notice, by Certified Mail, advising of the date, time, and place of the Public Hearing, in addition to the required notice placed in a newspaper of general circulation in the City. 2. Said notice -by -letter shall be mailed not less than 20 days prior to the date of the Hearing. 3. At the Public Hearing, the Governing Body will read and rule upon any and all objections to the proposed assessments which have been filed in writing at or prior to the Hearing. 21 November 1983 520 (Res. The Governing Body will determine whether or not the objection presents proof as to whether or not property value has not increased to the value of the assessment and will rule as to any decreased assessment amount. 5. If the Governing Body determines to reduce an assess- ment, they will also resolve source of revenue to replace the amount of decreased assessment revenue, if this should be necessary for Bond repayment. 6. Once the Governing Body rules upon any and all objections, they will set the assessments by duly adopting the proper ordinance or resolution setting forth the assessment for each lot or parcel of assessed property, by reference to the Assessments Roll Book, and no lot or parcel shall be after- ward subdivided in any way without the full or remaining balance of its assessment, plus any accrued interest, being first paid in full. ADOPTED THIS 21st DAY OF VUVEMBER, 1983. 4 City Mr. Bob Pope, leasee of the IMuAicipal Pier Yardarm Restaurant and Marina, came before the Council to request the City have the Marina and channel dredged. After discussion, Mayor Nix appointed Councilman Box and Building Official Lunsford to a committee of two to investigate feasibility and estimated costs. They are to make a report as soon as possible. The following bids were opened on the re -bidding for the metal building to be used at the Fire Sub -Station: Base Alt. Net Kemko, Inc. Daphne, Al. $19,199 -$ 401 $18,798 ASCO Contract'g$20,714 -0- $20,714 Theodore, Al. Councilman White moved to accept the low bid, with Alternate #1, from Kemko, Inc., provided all specifications are met. Seconded by Councilwoman Nelson, motion passed unanimously. Councilman White moved to cancel the bid order placed with Griffin Municipal Supply for a pumper for a Fire Truck due to Griffin's inability to supply same; also to award the pumper order to Harry Harless Company, the next lowest bidder, because this pumper is now needed on an emergency basis. Seconded by Councilman Bishop, motion passed unanimously. 21 November 1983 61PAI Councilman White moved to declare Fire Truck, VIN #F70FV054101, surplus and to donate same to the Fairhope Volunteer Fire De- partment. Seconded by Councilman Box, motion passed unanimously. Councilman White commended Mr. Vern Bodden for obtaining new roofing shingles, and the city crew for refurbishing the gazebo on the corner of Magnolia and Fairhope Avenues.
