The City Council, City of Fairhope, met in regular session
at 5:30 o'clock, P.M., Fairhope Municipal Complex, 161 North
Section Street, Fairhope, Alabama 36532, on Monday, 14 November 1983.
Present were Mayor James P. Nix; Councilmembers Roy C.
White, Trisha Nelson, David E. Bishop, Michael A. Ford, and
Sam E. Box; City Attorney James Reid and City Clerk Evelyn
Phillips. Absent: None.
Minutes of the 24 October 1983 regular session and the
3 November 1983 special session were duly approved.
Mayor Nix presented framed Distinguished Service,Awards
to members of the Fairhope Police Auxiliary and the Fairhope
Search & Rescue Squad in recognition of their many volunteer
hours of service.
Mrs. Elsie Milham presented a petition to the Council from
a number of Downtown Merchants requesting traffic directional
signs be placed at the "Y" on Scenic 98 and at the Fairhope
Avenue and Greeno Road intersections indicating the direction
to downtown Fairhope for both north and south traffic. After
some dicussion, Electrical Supt. Aaron Norris was asked to
contact the State Highway Department as to what can be placed
at the intersections, whether the Highway Department will pro-
vide the signs, and other questions about installation and
lighting.
At the suggestion of Dr. Barry Boothe, Councilmember White
moved to have the Mayor write the Environmental Protection
Agency requesting information as to the impact on -our City
should an accident occur in the handling of hazardous waste
materials at the Port of Chickasaw and in Mobile Bay. Seconded
by Councilman Bishop, motion passed unanimously.
As recommended by Purchasing Agent Jack Kirk, Councilman
White moved to accept the Harry Harless Company bid of
$13,561.72 for Fire Pumper Truck equipment, provided all speci-
fications are met. Seconded by Councilman Box, motion passed
unanimously.
As recommended by Building Official Bob Lunsford, all bids
received and opened on 10 November for the Fire SubStation metal
building are rejected, new bids are to be requested for opening
on 18 November, with a report and recommendation to the Council
on 21 November. So moved by Councilman Box, the motion was
seconded by Councilwoman Nelson, and passed unanimously.
Councilman Bishop moved to accept the single bid received
on a pickup truck for the Electrical Dept, from Steber Chevrolet

Company, Daphne, Alabama, in the amount of $8,679.00, provided
all specifications are met. Seconded by Councilman White,
motion passed unanimously.
Councilman Box moved to change the November 28th regular
session to November 21st; and the December 26th regular session
to December 28th. Seconded by Councilman Bishop, motion
passed unanimously.
Councilwoman Nelson introduced, and moved for the adoption
of, the following Resolution. Seconded by Councilman Box,
motion passed unanimously:
RESOLUTION NO. 94-83
BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE CITY OF
FAIRHOPE THAT the following Holiday Schedule will be
observed by all City personnel except emergency employees:
THANKSGIVING - Thursday & Friday, November 24th and 25th
CHRISTMA.S - 1/2 Day on Friday, December 23, 1983
1 Day on Monday, December 26, 1983
ADOPTED THIS 14th DAY OF
Councilman Bishop introduced an Ordinance to allow the City
Clerk to begin required advertising for public hearings on
amendments to the Zoning Ordinance as soon as possible after
the Planning & Zoning Public Hearing.
Councilman White introduced, and moved for the adoption of,
the following Resolution. Seconded by Councilman Ford,
motion passed unanimously:

RESOLUTION NO. 95-83
WHEREAS, the City of Fairhope is implementing its FY 1982
Community Development Block Grant Drainage Improvements
Program ( Grant Agreement No. L-SP-PF-82-126), and
WHEREAS, program regulations provide the grant recipient to
amend the State approved budget without prior State consent
if the total of said amendment is less than 10% of the
total grant amount, and
WHEREAS, it has become necessary and desirable for the City
of F S_rhope to exercise this option on the above described
program to cover cost overruns with funds originally budgeted
into contingencies;
NOW THEREFORE, BE IT RESOLVED by the City Council of the City
of Fairhope, Alabama, as follows:
Section 1. That the budget of the FY 1982 Community Development
Block Grant Drainage Improvements Program (Grant Agreement No.
L-SP-PF-82-126) be amended; said amendment follows:

FY 1982 CDBG - PROGRAM
AMENDMENT No. 1
Overview
The purpose of this amendment is to reflect changes in adminis-
trative requirements of the program by using $8,000.00 in avail-
able contingencies for administrative purposes. The balance of
$6,040.00 originally budgeted into contingencies is being moved
to drainage improvements where it can be expected to be expended
by program completion.
Amendment Summary
Increase Drainage Improvements from $265,960.00 to $272,000.00.
Increase Administration from $20,000.00 to $28,000.00.
Decrease Contingencies from $14,040.00 to $0.00.
Section 2. That records and books maintained in conjunction with
program implementation be changed to reflect said amendment.
PASSED, ADOPTED AND APPROVED phis 14th day of November, 1983.

Councilwoman Nelson moved to authorize an auction of surplus
equipment. Seconded by Councilman Box, motion passed unanimously.

Mayor Nix announced that he had been advised by Mr. Geoff
Cain that Sea Coast Manufacturing of Faihope has been accepted
as an exhibitor by the New Orleans World's Fair, 1984.
Councilman Box moved to pay bills as presented. Seconded
by Councilwoman Nelson, motion passed unanimously.
