HomeMy WebLinkAbout09-26-1983 Regular Meeting504 STATE OF ALABAMA X COUNTY OF BALDWIN X The City Council, City of Fairhope, met in regular session at 5:30 o'clock, P.M., Fairhope Municipal Complex, 161 North Section Street, Fairhope, Alabama 36532, on Monday, 26 Sept 1983. Present were Councilmembers Trisha Nelson, Michael A. Ford, Sam E. Box, Roy C. White, and David E. Bishop; City Attorney James Reid and City Clerk Evelyn Phillips. Absent was Mayor James P. Nix. Councilwoman Nelson presided in the absence of Mayor Nix. Councilman Box moved that the minutes of the last regular session be approved. Seconded by Councilman Ford, motion passed unanimously. As advertised, a Public Hearing was held for the benefit of any interested parties who wished to discuss the City's plan for compliance with Section 210 of the Public Utility Regulatory Policies Act of 1978. No one present offered any input. No written communications had been received. Councilman Bishop moved for final adoption of Ordinance No. 729, an ordinance by the City undertaking to comply with certain FERC regulations on arrangements with qualifying cogeneration and small power.pro- duction facilities under Section 210 of the PURPAct of 1*978. Seconded by Councilman White, motion passed unanimously. As advertised, a Public Hearing was held for the purpose of receiving public input on the use of Revenue Sharing Funds. No one present offered any comment. No written communications had been received. Councilman Box moved to use any Revenue Sharing Funds received to support the Fairhope Public Library as has been the City's practice for years. Seconded by Councilman Ford, motion passed unanimously. It Mrs. Joan Hoffman, representing the local League of Women Voters, presented each Council member with a bumper sticker which stated "Democracy is not a spectator sport." Mrs. Hoffman also announced the stickers were on sale at $1.00 each and could be obtained by contacting a League member. Mr. Jerry Griffin, local Greer's manager, presented a petition to the Council containing approximately 1400 signatures requesting the City change the Section Street parking back to diagonal. After some discussion, Mayor Pro-Tem Nelson appointed Council - members White and Ford as a committee to meet with Greer's repre- sentatives to further discuss the parking and make a recommendation to the Council at the next regular session. Chief Don Walker advised the Council that the Fairhope Volunteer Firemen had obtained two 1961 Ford 750 GPM Fire Trucks, already ISO certified, which they would like to donate to the 26 September 1983 505 City of Fairhope. The keys were presented to the Council. Councilman White moved to authorize bid requests on some equipment needed for the new fire trucks. Seconded by Councilman Box, motion passed unanimously. Councilman -Box moved to authorize the Mayor to execute a renewal contract with South Alabama Regional Planning Commission on funding the shuttle bus in the Sr. Aides program. The Contract is for a total of $6,380--- $4,164 Federal Funds and $2,216 in City funds or in -kind services ---and is for a term of one year beginning 1 October 1983. Seconded by Councilman Box, motion passed unanimously. Councilman Box introduced Ordinance No. 730, an ordinance to amend Section 5.21 of the City Code by defining and expanding "Citation" (animal control section). In order to take immediate action, Councilman White moved to suspend the rules. Seconded by Councilman Box, motion passed unanimously by the following vote: AYE - White, Box, Nelson, Bishop, and Ford. NAY - none. Councilman Box then moved for final adoption of Ordinance No. 730. Seconded by Councilman White, motion passed unanimously by the following vote: AYE - White, Box, Nelson, Bishop, and Ford. NAY - none. Councilman Box moved to hear the following business not on the Agenda. Seconded by Councilman White, motion passed unan- imously: Mrs.' Tommie Werneth, CDBG Administrator, reported that bids on metal and concrete pipe for the 1982 drainage project under construction had been opened and recommended the low bid of $21,312 from Choctaw Pipe be accepted.
