The City Council, City of Fairhope, met in regular session at
5:30 o'clock, P.M., Fairhope Municipal Complex, 161 North Section
Street, Fairhope, Alabama 36532, on Monday, 12 September 1983.
Present were Mayor James P. Nix; Councilmembers Roy C. White,
Trisha Nelson, David E. Bishop, Michael A. Ford, and Sam E. Box;
City Attorney James Reid and City Clerk Evelyn Phillips. Absent -
none.
Minutes of the 22 August 1983 regular session were duly
approved.
Councilman White moved for the final adoption of Ordinance
No. 728, an ordinance to amend the Zoning Ordinance regarding
Zoning Enforcement Officer's duties (Odd -size lots). Seconded
by Councilman Box, motion passed unanimously.
Councilman Bishop introduced an ordinance undertaking to
comply with certain Federal Energy Regulatory Commission regulations
on arrangements with qualifying cogeneration and small power
production facilities. Councilman Bishop then moved to authorize
a public hearing on this ordinance at the next regular session.
Seconded by Councilman Box, motion passed unanimously.
An old quitclaim deed on a lot in Volanta SubDivision belonging
to E. W. Gable pertaining to the 1966 Public Improvements Project
was discussed by Council. According to the information reconstructed
by Attorney Reid and Mr. Dan Benton, Attorney, from old City Attorney
E. G. Rickarby's files, the deed was executed in error and never
corrected in the County Probate files. On advise of the attorneys,
another quitclaim deed was prepared deeding all of the city's
interest back to the owner. Councilman Bishop moved that this
action be taken. Seconded by Councilwoman Nelson, motion passed
unanimously.
Councilman Box moved to allow some surplus kitchen equipment
that is not being used, and most probably never will be used, by
the City to be used by the Fraternal Order of Police Lodge No. 43.
The equipment was. acquired by the City at no cost during Civic
Center construction and was not needed. The Lodge will have the
use of the equipment at no cost and will return it to the City
when no longer needed. Seconded by Councilman Ford, motion
passed unanimously.
Councilman Box introduced, and moved for the adoption of,
the following Resolution. Seconded by Councilwoman Nelson,
motion passed unanimously:

RESOLUTION NO. 90-83
BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE CITY OF
FAIRHOPE, ALABAMA, to request an extension on the AIRPORT
BOARD Note Payable No. 2128 to Central Bank of the South
in Fairhope, in the principal amount of $16,806.00, for
a One Year period at an annual interest rate of 9 per cent
(90), beginning 12 September 1983.
ADOPTED THIS 12th DAY OF SEPTEMBER, 1983.

Councilwoman Nelson reported to Council on her recent trip to
Montgomery to attend the Industrial Development Committee
Meeting.
Councilman Box moved to pay bills as presented. Seconded by
Councilman White, motion passed unanimously.
