HomeMy WebLinkAbout08-08-1983 Regular Meeting494 STATE OF ALABAMA X COUNTY OF BALDWIN X The City Council, City of Fairhope, met in regular session at 5:30 o'clock, P.M., Fairhope Municipal Complex, 161 North Section Street, Fairhope, Alabama 36532, on Monday, 8 August 1983. Present were Mayor James P. Nix; Councilmembers Roy C. White, Trisha Nelson, David E. Bishop, Michael A. Ford, and Sam E. Box; City Attorney James Reid and City Clerk Evelyn Phillips. No one was absent. Minutes of the 25 July 1983 regular session were duly approved. The following bids on a used Tractor with terrain -king mower were opened: Foley Tractor Co. Foley, Al $ 23,823.00 Joe Money Machinery Co. Birmingham, Al $ 19,625.00 Alt. $ 24,000.00 " $ 21,125.00 " $ 25,525.00 " $ 21,825.00 " $ 26,225.00 " $ 21,125.00 " $ 25,525.00 Meador Contracting Co. Mobile, Al $ 19,000.00 Port City Tractor Co. Mobile, Al No Bid Forestry Equipment Co. Prichard, Al No Bid Councilman Box moved these bids be taken under advisement for study and a recommendation be made at the next regular session. Seconded by Councilwoman Nelson, motion passed unanimously. Councilman Bishop advised Council about a new state associ- ation that is being formed by some 36 Alabama municipalities that own their electrical systems,for the mutually protective service of monitoring possibly harmful legislative actions. Councilman Bishop introduced, and moved for the adoption of, the following Resolution. Seconded by Councilman Box, motion passed unanimously: 8j August 1983 495 RESOLUTION NO. 87-83 WHEREAS, all municipal electric systems in Alabama share common goals and concerns; and WHEREAS, a state-wide association of these systems can much more efficiently accomplish those goals and address those concerns; and WHEREAS, a state-wide association of these systems to be known as "Electric Cities of Alabama" ("the Association") is being organized; NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FAIRHOPE, AIABAMA, that the City of Fairhope hereby declares its intention to join Electric Cities of Alabama and to pay dues for the initial year of operation of the Association based on the following formula: an amount equal to $150 plus $.005 multiplied times the total number of active consumer electric accounts maintained by the City Electric Department as of 31 December 1982; and BE IT RESOLVED FURTHER, that the City designates PHILL IP RUTHERFORD as its representative on the Board of Directors of the Association, to serve at the pleasure of the City. ADOPTED THIS 8th DAY OF Councilman Box moved to accept a "Marine Patrol",.a group of men who are doing some rescue work in the Bay, to serve voluntarily under the Police Department when needed to do work in boats, subject to said group preparing a set of By -Laws setting forth their duties which must be approved by the City Attorney. Seconded by Council- man Ford, motion passed unanimously. Council discussed the new traffic turn signs at the Post Office and the parking at Greer's across the street. Councilman White, Mayor Nix, and other members of the Council commended Councilwoman Nelson's work on this traffic problem. Councilman Ford moved to remove the turn signs at the Post Office and retain the Section Street parallel parking at Greer's. Seconded by Councilman White, motion carried by the following vote: AYE - Ford, White, Bishop. NAY - Box, Nelson. Councilman Box moved to hear the following business not on the Agenda. Seconded by Councilman Bishop, motion passed unanimously: Councilman White introduced two ordinances: Ordinance No. 725, an ordinance to amend Fairhope Code by increasing the maximum fines and imprisonment as provided by State law; and Ordinance No. 726, an ordinance to amend Fairhope Code by adopting all rules and regulations of the Alabama State Department of Public Safety now 8 August 1983 0 496 existing or hereafter enacted pertaining to traffic control that are misdemeanors under State law are now also violations of City Code. In order to take immediate action, Councilman Box moved to suspend the rules. Seconded by Councilwoman Nelson, motion passed unanimously by the following vote: AYE - Box, Nelson, Ford, White, Bishop, Nix. NAY - none. Councilman White then moved for final adoption of Ordinance No. 725 and Ordinance No. 726. Seconded by Councilwoman Nelson, motion passed unanimously by the following vote: AYE - Box, Nelson, Ford, White, Bishop, Nix. NAY - none. Councilman White introduced Resolution No. 86-83. In order to take immediate action, Councilwoman Nelson moved to suspend the rules. Seconded by Councilman Ford, motion passed unanimously by the following vote: AYE - White, Nelson, Ford, Bishop, Box, Nix. NAY - none. Councilman White then moved for final adoption of Resolution No. 86-83. Seconded by Councilwoman Nelson, motion passed unanimously by the following vote: AYE - White, Nelson, Ford, Bishop, Box, Nix. NAY - none: RESOLUTION NO. 86-83 WHEREAS, ROBERT GARY MITCHELL and wife, MARCIA R. MITCHELL and EASTERN SHORE BUILDERS, INC., an Alabama corporation, have filed with the Mayor and Council of the CITY OF FAIRHOPE, ALABAMA, a Declaration of Vacation to vacate so much of that certain 20-foot drainage and utility easement as described in the Amended Declaration of Vacation, which said drainage and utility easement is not now being used nor will it ever be used as such, located and described as follows: Lots 49, 50, 51, 52, 55, 54, 56, 53 Audubon Place as recorded as GREENWOOD PARK SUBDIVISION in Map Book 8, Page 83, and as amended in Miscellaneous Book 32, Pages 119-121, Baldwin County, Alabama Probate Records. The said owners desire that the same be vacated and do by these pre- sents file this Declaration of Vacation with the Mayor and Council of the City of Fairhope, Alabama, and WHEREAS, the CITY OF FAIRHOPE, has accepted the said Declaration of Vacation and that the said drainage and utility easement is not now in use nor ever will be in use as a drainage and utility easement. NOW THEREFORE, BE IT RESOLVED that the Mayor and Council of the City of Fairhope, do by these presents assent to such Declaration of Vacation, and it be, and the same is hereby vacated in accordance with Title 23-4-20 of the 1975 Code of Alabama. He says he has been unable to locate property owner. Council advised that the City could act if lot was a health or safety hazard and Building Official Lunsford is to look into the matter.
