The City Council, City of Fairhope, met in regular session at 5:30 o'clock, P.M., Fairhope Municipal Complex, 161 North Section Street, Fairhope, Alabama 36532, on Monday, 11 July 1983. Present were Mayor James P. Nix; Councilmembers Roy C. White, Trisha Nelson, David E. Bishop, Michael A. Ford, and Sam E. Box; City Attorney James Reid and City Clerk Evelyn Phillips. Absent - none. Minutes of the 27 June regular session and the 29 June 1983 special session were duly approved. Councilman Bishop moved for final adoption of Ordinance No. 724, an ordinance making a U-turn illegal where posted and defining "U-turn" as any turn greater than 900. Seconded by Councilman Box, motion passed unanimously. Council considered an application for an Off -Premises Beer License by Delta Oil Company for THE DELTA MART, 150 South Section. Mr. Glen Boom, President of Delta Oil, addressed Council about the many reasons the application should be approved. The minister and a member of the United Methodist Church, located across the street from The Delta Mart, voiced their objections. After some discussion, Councilwoman Nelson moved to approve the application. Seconded by Councilman White, motion was denied by the following vote: AYE - Nelson and White. NAY - Bishop, Ford, and Box. The following bids were opened on a Fire Pump for the Fire Department: WOW103 Harold's Sales & Service Mariette, Ga Griffin Munc. Supply Mobile 2 bids: Dowling Fire Equipment Ocala, Fl Turner Supply Co Mobile $ 5,700.00 $ 5,835.00 - Waterous $ 5,687.50 - Hale $ 7,114.00 $ No Bid Councilman White moved to accept the low bid, provided all speci- fications are met. Seconded by Councilman Box, motion passed unanimously. Seconded by Councilman Ford, motion passed unanimously. Councilman Box introduced, and moved for the adoption of, Resolution No. 84-83, a resolution replacing Resolution No. 44-82 setting forth the Rules and Regulations for the operation of the Civic Center Complex. This Resolution changes some minor wording, increases use -hour charge from $5.00 to $7.50 per hour, sets use - hour charge for City holidays at $22.50 per hour, and offers an optional clean-up charge of $150.00. Those people already on the calendar would not be affected by these increased charges. Councilman White seconded the motion which passed by unanimous vote. Council discussed building a Fire Sub -Station on city property (about 1 acre) on Ingleside Street south of Thomas Hospital. This station would house "Bear" (the big fire truck), one pumper, and one woods -fire truck; construction cost to be about $25;000-$28,000. Councilman White moved to authorize the removal of obsolete equipment now on the property and the construction of the sub -station. Seconded by Councilman Box, motion passed unanimously. Mayor Nix advised that an appointee has been requested from the City of Fairhope to possibly serve on the Baldwin County Board of Equalization. Each Baldwin County Municipality is to nominate one person, the largest municipality to nominate three, and from these nominees the Board will be chosen. Nominations will be considered at the next regular session. 11 July 1983 491 Councilwoman Nelson reported on her work to correct some traffic problems on Section Street between Greer's and the Post Office. Councilwoman Nelson moved to have signs installed to allow "right turn only" at the Post Office Exit and to allow parallel parking only at Greer's along Section Street. Seconded by Councilman Box, motion passed unanimously. Councilman Box introduced, and moved for the adoption of, the following Resolution. Seconded by Councilman Bishop, motion passed by the following vote: AYE - Box, Bishop, White, and Nelson. NAY - none. ABSTAIN - Ford..: RESOLUTION NO. 85-83 WHEREAS, the City of Fairhope is in the process of making drainage improvements to Fairland Avenue with Community Development Block Grant Funds, and WHEREAS, it will be necessary to acquire permanent easements from three property owners for said improvements, and WHEREAS, in conformance to requirements of the Uniform Relocation Assistance and Real Property Acquisition Act of 1970, the City of Fairhope has had appraisals performed on each parcel, and WHEREAS, said Act requires the City to establish just compensation for said easements prior to making a written offer for the same; NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the City of Fairhope, Alabama, as follows: Section One. That, based on the appraisal of C.W. Coleman and Asso- ciates, the fair and equitable compensation for permanent easements to be acquired for Fairland Avenue approvements are as follows: Elizabeth Minnich $234.00 Luther Shiver $ 31.00 Archie Lawrence/ Deborah Quaites $ 90.00 Section Two. That James P. Nix, in his capacity as Mayor, is hereby authorized and directed to take such actions as are necessary to acquire said permanent easements. PASSED, ADOPTED, AND APPROVED this 14th day of July, 1983. Councilwoman Nelson moved to pay bills s presented. Seconded by Councilman Ford, motion passed unanimously.
