The City Council, City of Fairhope, met in regular session at 5:30 o'clock, P.M., Fairhope Municipal Complex, 161 North Section Street, Fairhope, Alabama 36532, on Monday, 27 June 1983. Present were Mayor James P. Nix; Councilmembers Sam E. Box, Michael A. Ford, David E. Bishop, Trisha Nelson, and Roy C. White; City Attorney James Reid and City Clerk Evelyn Phillips. Minutes of the 13 June 1983 regular session were duly approved. Councilman White moved for final adoption of Ordinance No. 719, an ordinance to amend Zoning Ordinance No. 557 by rezoning Mrs. Clyde Morris' property,at 55 South Bayview Street, from R2 Medium Density Single Family Residential to R4 Low Density Multi Family Residential. Seconded by Councilman Box, motion passed unanimously. Councilman Bishop moved for final adoption of Ordinance No. 720, an ordinance to correct codification error in City of Fairhope Code of Ordinances Section 4-47, Liquor and Wine Tax. Seconded by Councilman Box, motion passed unanimously. Councilwoman Nelson moved for final adoption of Ordinance No. 721, an ordinance regulating hours of sale of alcoholic beverages. Seconded by Councilman White, motion carried by the following vote: AYE - Nelson, White, Ford, and Box. NAY - Bishop. Councilwoman Nelson moved for final adoption of Ordinance No. 722, an ordinance establishing usage allowed at City Dump; residency and decal requirements. Seconded by Councilman Ford, motion passed unanimously. Mr. Wes Stapleton addressed Council in regard to drainage problems on his, Mr. Chester Billies, and Mrs. Bobbie Thomas' land near Colonial Acres Drive and Washington Drive. Mr. Stapleton feels water is washing away his property due to runoff from the Volanta Park Pool, Ball Fields, and Football Stadium. After some discussion, Mayor Nix appointed Councilmen White and Ford and Supt. Phil Rutherford and Building Offical Bob Lunsford to serve as a committee to study the situation and make a recommendation to the Council. Councilwoman Nelson moved to remove from the table the question regarding additional depositories for City funds. Seconded by Councilman Box, motion passed unanimously. Council- woman Nelson then introduced, and moved for the adoption of, the following Resolution. Seconded by Councilman Bishop, motion passed unanimously: 27 June 1983 r,; RESOLUTION NO. 83-83 BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE CITY OF FAIRHOPE THAT, under Section 2-8 of the Code of Ordinances of the City of Fairhope, all local, licensed financial institutions are hereby designated Depositories and may be used for the deposit of City Funds provided such institutions meet all security requirements mandated by the Code of Alabama, Title 11, and Section 2-9 of the Code of Ordinances, City of Fairhope. ADOPTED THIS 27th DAY OFJUNE, 1983. �. Mayo City Cgerk Councilman White moved to authorize the Mayor to write to Governor George Wallace and to the State Highway Department Director and request consideration be given to four-laning Greeno Road. Seconded by Councilwoman Nelson, motion passed unanimously. Councilwoman Nelson and Councilman Bishop reported that they were working on some recommendations regarding traffic problems. Ms. Nelson is concentrating on the Section Street area in front of the Post Office and will give a later report after meeting with the Postmaster who has been away on vacation. Councilman Bishop introduced an Ordinance to add a section to the Traffic Chapter of the Code of Ordinances specifically naming U-Turns as an unlawful act and defining a U-Turn as any turn exceeding 90°. Mayor Nix reported a reply had been received from the Corps of Engineers regarding the Beach erosion matter brought up several meetings back. The Corps has some 50/50 matching funds available but more study would have to be done before such a project could be undertaken. Mayor Nix also made several other announcements: There will be"a 8.7% reduction in Gas rates effective with the June 30th Billing Cycle (due to a reduction to the City by its supplier), an electrical refund will be given to customers over the next four months through fuel adjustment credits (due to a court — ordered rate refund to City by Alabama Power Company), and a special meeting of the'Council is scheduled for Wednesday, 27 June 1983 29 June 1983, at 5:30, p.m., for business relating to perm- anent financing on the 1982 Public Improvements Project. Councilman White asked that he be allowed to state an observation before adjournment. Mr. White said it was his observation that Taxpayers cannot pay to control beach erosion and gully erosion in our area ... vast amounts of money are spent just to maintain the status quo..."enough" money just cannot be obtained. A lady in the audience thanked the Council for having the "no -right -turn -on -red" signs removed from the traffic signals at Magnolia and Section Street intersection. Meeting was duly adjourned.
