HomeMy WebLinkAbout06-13-1983 Regular MeetingM: 1 STATE OF ALABAMA X COUNTY OF BALDWIN X The City Council, City of Fairhope, met in regular session at 5:30 o'clock, P.M., Fairhope Municipal Complex, 161 North Section Street, Fairhope, Alabama 36532, on Monday, 13 June 1983. Present were Mayor James P. Nix; Councilmembers Sam E. Box, Michael A. Ford, David E. Bishop, Trisha Nelson, and Roy C. White; City Attorney James Reid and City Clerk Evelyn Phillips. No one was absent. Minutes of the 23 May 1983 regular session and the 2 June 1983 special session were duly approved. A Public Hearing on the rezoning request of Mrs. Clyde M. Morris, 55 South Bayview, was held as advertised. The Planning and Zoning Board recommended approval of the request. No one present was opposed. Councilman White introduced the Ordinance to change 55 South Bayview from R2 Medium Density Single Family Residential to R4 Low Density Multi Family Residential. The following bids were opened on pipe for the Gas Dept: 2"xtru coat 3/4" xtru coat per ft per ft Empire Pipe, Birmingham 1.2178 .55 2%, 10 days Superior Pipe, Pelham 1.33 .5918 Net Jeffrey Steel, Mobile 1.96 .76 1%, 10 days M.T. Deason, Birmingham 1.29 .78 2%, 10 days Councilman Box moved to accept the low bid, provided all specifi- cations are met. Seconded by Councilman Bishop, motion passed unanimously. The following bids were opened on an automobile for the General Superintendent: with trade-in Chris Myers Pontiac, Daphne $9,020.58 Gaston Ford, Fairhope No Bid Steber Chevrolet, Daphne $8,426.42 Alternate, In Stock Unit $8,912.25 Councilman Bishop moved to accept the low bid, provided specifi- cations are met and delivery can be made. Seconded by Council- woman Nelson, motion passed unanimously. 481 13 June 1983 The following bids were opened on a pickup truck for the Water & Sewer Department: Gaston Ford, Fairhope $8,840.00 w/o air conditioning $8,190.00 Steber Chevrolet, Daphne $8,175.99 Councilman Box moved to accept the low bid, provided specifications are met and delivery can be made. Seconded by Councilwoman Nelson, motion passed unanimously. Councilman Box moved for final adoption.of Ordinance No. 717, an Ordinance to amend Ordinance No. 713 by removing Sections III and IV (permit fee and penalty for noncompliance in reference to digging near utility lines). Seconded by Councilman Ford, motion passed unanimously. Councilman White moved for final adoption of Ordinance No. 718, an Ordinance pertaining to Technical Codes on wiring,etc. Seconded by Councilman Bishop, motion passed unanimously. Councilman Bishop introduced, and moved for the adoption of, the following Resolution. Seconded by Councilman Box, motion passed unanimously: RESOLUTION NO. 82-83 The City Council of the City of Fairhope, Alabama, in regular session this 13th day of June, 1983, having considered and found acceptable a contract with Southeastern Pacer Administration, dated as of 31 May 1983, for the purchase of power, hereby ratifies and confirms the execution of said con- tract with the Southeastern Pacer Administration on behalf of the City of Fairhope, Alabama, by Mayor James P. Nix. ADOPTED THIS 13th DAY T JUNE, 1983. 11 City ,or Councilman Box introduc�!e an Ordinance to correct a codi- fication error in the City's Code of Ordinances having to do with tax on liquor and wine. Councilman White introduced an Ordinance to change the closing hours of establishments retailing alcoholic beverages to be the same as the State Closing Hours Law excepting Licensees located within 200 feet of a residentially -zoned area. These establishments will continue to operate under the present hours. 482 13 June 1983 Councilman Box introduced an Ordinance to amend the City Code by specifying that DECALS must be current and affixed to the vehicles of citizens who use the City land fill area (City Dump). The Council was advised that two of the new banks in town were asking to be named City Depositories. After some discussion, Councilman White moved to name AmSouth and SouthTrust Banks as Depositories. Mr. White was advised that this action required an Ordinance. Councilwoman Nelson then moved to table the question until it could be more fully studied, saying she would hate to have to pass an Ordinance for each Bank in town. Since the motion to table takes precedence, Mayor Nix called for consideration of Councilwoman Nelson's motion. Councilman Bishop seconded and motion carried by the following vote: AYE - Nelson, Bishop, Box and Ford. NAY - White. Supt. Phil Rutherford advised Council that a lot of Yard Sale signs were appearing on utility poles and street sign posts and asked that all citizens be made aware, through the news media, that it was illegal to affix signs to utility poles and to block the view at intersections. Signs are also to be removed after the sale. Councilwoman Nelson moved to hear the following business not on the Agenda. Seconded by Councilman Box, motion passed unanimously: Councilman White moved to request bids on a tractor with sidearm and a straight -pull tractor for the Street Department. Seconded by Councilman Bishop, motion passed unanimously. Councilman White moved to request bids on a skid pump with an independent motor for the Firemen. Seconded by Councilman Ford, motion passed unanimously. Councilman White moved to establish the following Reserved Parking Spaces for use by Handicapped Persons: 1. On Fairhope Avenue, in front of The Harbor Shop. First space to the left of M&F Bank Drive-Thru Exit. 2. On Fairhope Avenue, in front of Village Square. First space east of Church Street. 3. On Oak Street, in front of Eastern Shores Art Center. 4. First space in front of Fairhope Public Library, west end. 5. Two spaces directly in front of entrance to Civic Center. 6. On Section Street, in front of King Arthur Clock Company. Seconded by Councilman Ford, motion passed unanimously. Councilman Bishop asked that the diving board at the Munic- ipal Pool be checked for safety. Mayor Nix appointed Councilman Bishop and Councilwoman Nelson to study and make recommendations 483 13 June 1983 to the Council about various traffic problems, at the next regular session. Councilman Ford requested that the Probate Judge office be asked to provide Driver License Tests, if possible, in Fairhope. Councilman Ford moved to pay bills as presented.
