STATE OF ALABAMA
COUNTY OF BALDWIN
The City Council, City of Fairhope, met in regular session
at 5:30 o'clock, P.M., Fairhope Municipal Complex, 161 North
Section Street, Fairhope, Alabama 36532, on Monday, 23 May 1983.
Present were Mayor James?. Nix; Councilmembers Sam E. Box,
Michael A. Ford, David E. Bishop, Trisha Nelson, and Roy C.
White; City Attorney James Reid and City Clerk Evelyn Phillips.
Mayor Nix called the meeting to order and Councilman
Bishop gave the invocation.
Minutes of the 9 May 1983 regular session were duly approved.
Mrs. Verona Bieser, of The Colony Shop, addressed the
Council on the subject of her proposed plan for the front of her
new shop location on Section Street. Mrs. Bieser asked for per-
mission to place four wrought iron columns on the edge of the
street with a canopy over the sidewalk. Council agreed the plan
would approve the appearance of the storefront but advised that
the City would not be responsible for possible damage to the
columns by cars parking directly next to them. Councilwoman
Nelson moved to have General Supt. Rutherford and Building Official
Lunsford work with Mrs. Bieser on this matter. Seconded by
Councilman Bishop, motion passed unanimously.
Mayor Nix opened the floor for nominations to the Library
Board, Councilman Bishop's term and Dr. H.B. Shepherd's term'
having expired. Councilman Bishop did not wish to be reappointed.
Councilman Box nominated Dr. Shepherd for reappointment (5-yr
term). Councilman Bishop nominated Mr. Jack Cromwell for appoint-
ment (5-yr term). There being no further nominations, Councilman
Box moved the nominations be closed. Seconded by Councilman
Ford, motion passed unanimously. Councilman White and the Coun-
cil commended Councilman Bishop for his service on the Board.
Mayor Nix appointed Councilman White and Supt. Rutherford
as a special committee to study the need for Handicapped Parking
Spaces and to make a recommendation to the Council.
Mr. Walter Scott, of McCrory & Williams, Engineers, requested
a sewer tap fee from the Council for Camp Cullen as required
by Ordinance No. 715. After some discussion, Councilman Box
moved to set the fee at $6,500 with the provision that there is
to be no change in land use or in the size of the pump station.
Should a need arise for a change, Camp Cullen will have to
reapply for sewer service to the Council before any changes can
be made. Seconded by Councilman White, motion passed unanimously.
Councilman Box introduced an Ordinance to amend recently
adopted Ordinance No. 713. This Ordinance would void Sections
III and IV (permit fee and fine for noncompliance) since this
cannot be enforced.

Councilman White introduced an Ordinance having to do
with Technical Building Codes.
After some discussion, Council again decided to withhold
action on the Hoyle Street vacation request until the parties
involved can have a chance to reach an agreement.
Councilman Bishop introduced, and moved for the adoption of,
the following Resolution. Seconded by Councilwoman Nelson, motion
passed unanimously:
RESOLUTION NO. 77-83
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FAIRHOPE IN
THE STATE OF ALABAMA AS FOLLOWS:
That the City Council is opposed to proposed House Bill
No. 512 and Senate Bill No. 349, the territorial bill that
would fix pernament boundaries of electric service terri-
tories for electric suppliers and prohibit municipal electric
systems from extending electric service to their citizens that
live in areas that are incorporated into such municipalities
in the future;
That the City Council is further opposed to this or any
other legislation that, under any circumstance, would prohibit
a municipality from providing electric service to any of its
citizens to whom it provides other municipal services or that
would deny to such persons, who are required to support the
municipality financially, the benefits of the various services
which came from annexation to the municipality; and
That the Mayor is requested to make the resolve of this
Council known to our legislators in order that the adoption of
this legislation be discouraged.

Councilman Box introduced, and moved for the adoption of,
the following Resolution. Seconded by Councilwoman Nelson,
motion passed unanimously:
RESOLUTION NO. 78-83
WHEREAS, the Greyhound Bus Lines Company has publicly announced
plans to abandon certain routes and stops in Baldwin
County, and
WHEREAS, we feel the discontinuance of this bus service would be
• detrimental to the health, well-being, and established
order of life for many Baldwin County citizens,
THEN, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY

OF FAIRHOPE, ALABAMA, that the Mayor be authorized to advise
the Greyhound Bus Lines Company of the opposition of this
body of elected representatives of the people to the proposed
plan to discontinue their service as reported in the media.

Councilman Ford introduced, and moved for the adoption of,
the following Resolution. Seconded by Councilman White, motion
passed unanimously:
RESOLUTION NO. 79-83
WHEREAS, under Resolution No. 62-82 of November 22, 1982,
a $357,000 General Obligation Note was established
as temporary financing for the 1982 Public Improve-
ments Assessments Project, and
WHEREAS, inclement weather has delayed the construction on
this project to the point of only 60% completion
during the past six-month period and a possibility
of more adverse weather conditions does exist,
THEN, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF FAIRHOPE, ALABAMA, that an extension of this note be requested
for a period of six months, at the same rate of interest.

Councilman Box moved to hear the following business not on
the Agenda. Seconded by Councilwoman Nelson, motion passed unanimously:
Councilman Ford introduced, and moved for the adoption of,
the following Resolution. Seconded by Councilwoman Nelson, motion
passed unanimously:
RESOLUTION NO. 80-83
WHEREAS, the 1983 Fairhope Pirates Baseball Team and its Coach
Mickey Hudson brought pride and honor to the City by becoming
the State 4 A Champions, and
WHEREAS, these individuals displayed their ability as a winning
team and showed strength of character and good sportsmanship, and
WHEREAS, we wish to publicly acknowledge this added accomplishment
by the youth in our area

THEN THEREFORE, BE IT RESOLVED, That we hereby proclaim
the week of May 23rd through 29th as "PIRATES WEEK" in
the City of FAirhope in recognition of the tremendous
effort put forth by this team and its Coaches.

Mayor Nix advised that he would like to appoint Mrs. Mary D.
Foreman to the Planning & Zoning Board to complete the unexpired term
of Mr. Dick Sanderson who resigned to go to Saudi Arabia. Council-
woman Nelson so moved. Seconded by Councilman Box, motion passed
unanimously.
Councilman White commended and recognized recent accomplish-
ments of two City employees, Gene Fuqua and Mike Rejczyk, and a
Volunteer Fireman, Ted Gauntney. Mr. Fuqua is the new President of
the Alabama Firemen's Association, Mr. Rejczyk is the District Vice
President, and Mr. Gauntney has been appointed to the State Forestry
Commission.
Mr. and Mrs. Thomas Dekle displayed a number of photographs
to show the Council an apparently severe erosion of the beach in
the White Avenue Pier area. After some discussion, Councilwoman
Nelson moved to contact the Corps of Engineers, advise them of the
matter, ask for an investigation and a recommendation as to what can
be done. Seconded by Councilman Ford, motion passed unanimously.
