HomeMy WebLinkAbout04-11-1983 Regular Meeting459 STATE OF ALABAMA X COUNTY OF BALDWIN X The City Council, City of Fairhope, met in regular session at 5:30 p.m. Fairhope Municipal Complex, 161 North Section Street, Fairhope Alabama, on Monday, 11 April 1983. Present were Mayor James P. Nix;.Councilmembers Roy C. White, Trisha Nelson, David E. Bishop, Michael A. Ford, and Sam E. Box; City Attorney Jim Reid and City Clerk Evelyn Phillips. Mayor Nix called the meeting to order and introduced the Reverend Marcus Smith of the Fairhope United Methodist Church. Reverend Smith gave the invocation. Minutes of the 28 March 1983 regular session were duly approved. Mayor Nix commended Councilman Roy White for his devo- tion and dedication.... Mr. White is scheduled to undergo open-heart surgery tomorrow. Mr. Charlie Smith asked to address Council as a repre- sentative of the ASA Softball Association but failed to appear. Councilman Box moved to authorize the fees -for five firemen to attend Fire School. Seconded by Councilman White, motion passed unanimously. Councilman Box moved to remove the Pope Beer & Wine License Application(The Yardarm Restaurant) from the table for discussion. Seconded by Councilman Ford, motion passed unanimously. After discussion and audience participation, Councilman Box moved to deny approval of the application. Seconded by Councilman Bishop, motion carried by the following vote: AYE - Box, Bishop, White. NAY - Nelson, Ford. Councilman White advised he wished to withdraw the Resolution he introduced at the last regular session wherein the City would lease the former Library Building on Summit Street to Faulkner Junior College and Baldwin County Probate Judge. Mr. White said other facilities have been found for the Probate Office and Faulkner has agreed to work out a use schedule which would allow the Institute of Life-long Learning to also use the building. Councilman White then offered the following motion: to authorize the Mayor to execute an agreement with Faulkner Junior College for the use of the entire building with a provision that Faulkner would provide a use schedule for the Institute. Seconded by Councilman Box, motion passed by the following vote: AYE - Box, White, Nelson, Ford. NAY - none. ABSTAIN -Bishop. 11 April 1983 460 The following bids were opened on two Police Cars: w/o trade trade allowance LESS Gaston Ford 10,170 ea $750 on #23 ('77) New '83 LTD, 4D $2000 on #14 ('80) Steber Chevrolet 19,928 ea $500 on #23 New '83 Impala, 4D $1400 on #14 Councilman Bishop moved to accept the low bid, provided all specifications are met. Seconded by Councilwoman Nelson, motion passed unanimously. The following Bids were opened on Gas Meters: AL175 AL250 1" GMI Singer American 41.00 50.40 5.68 Equipment Controls 59.15 60.15 NB Councilman Box moved to accept the low bid, provided all speci- fications are met. Seconded by Councilman White, motion passed unanimously. Councilman Bishop introduced, and moved for the adoption of, the following Resolution after a call for audience comment produced no response. Seconded by Councilman Box, motion passed unanimously: RESOLUTION NO. 72-83 WHEREAS, pursuant to Act No. 549, Acts of Alabama 1963, page 1166, a petition was presented to the Council of the City of Fairhope, Alabama, requesting permission for the destruction of certain listed public records, and WHEREAS, Resolution No. 70-83 was adopted by the Council ordering a public hearing on the question of whether of not the public records listed shall be ordered destroyed, and directing that notice thereof be given, and WHEREAS, a public hearing was held as directed on Monday, 11 April 1983, in the Council Chamber of the Fairhope Municipal Complex, at 5:30 o'clock, P.M., having been duly advertised in the EASTERN SHORE COURIER, a newspaper published in and of general circulation in the CITY OF FAIRHOPE, on March loth and March 17th, and WHEREAS, the City Council of the City of Fairhope is satisfied that all interested persons were given ample opportunity to be present and to be heard; that the records listed below are not presently involved in or connected with any pending litigation; that they are obsolete and their destruction will not prejudice the rights of the public or any person or corporation; that they are no longer needed for any public purpose; and that they have been kept for the minimum retention periods required by law, NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FAIRHOPE that the City Clerk as custodian of the records of the city is hereby directed to 11 April 1983 461 carry out the destruction of the following records: THROUGH: Utilities Billing Records & Accts Receivable 9-30-72 Meter Reading Books 9-30-72 Paid Utility Stubs 9-30-80 Bank Statements & Reconciliations 9-30-72 Check Stubs, Cancelled Checks & Deposit Slips 9-30-72 Redeemed Bonds & Interest Coupons 9-30-75 Expired Insurance Policies & Surety Bonds 9-30-75 Record of accidents, claims & adjustments 9-30-75 Terminated contracts, leases & agreements 9-30-72 Record of formal bids, ads for bids on contract & purchases 9-30-75 Purchase Orders 9-30-72 Departmental Requisition Orders 9-30-75 Business License applications and receipts 9-30-77 Terminated Employees Individual Personnel Records 9-30-72 Payroll records of time worked 9-30-77 General Correspondence 9-30-77 Also, the following obsolete records not specifically covered by law: Miscellaneous receipts & applications, paid invoices 9-30-77 BE IT FURTHER RESOLVED that the City Clerk of the City of Fai_rhope, Alabama, is hereby absolved from any further responsibility for the records specified above. ADOPTED THIS llth DAY OF APRIL, 'O4' � V�L 0- Clrty Cle 11 April 1983 462 Councilman Box addressed Council on the subject of the present moratorium on sewer connections outside the city limits. Councilman Box reminded them that the moratorium was used in order to study the present system and treatment plant capacity; that presently the plant can process wastewater for approximately 15,000 people; and that the current load is approximately 7,200 people. After some discussion, Councilman Box introduced an Ordinance to establish a connection fee and users rate for sewer service outside the city limits, to provide penalty for illegal taps, and to establish a special revenue account for future replacements and improvements. This Ordinance will be considered for final adoption at the next regular Council session. Councilman White moved to approve final payment to Fair - hope Paving Company on both contracts on the Public Improve- ments Assessments Project. Seconded by Councilman Ford, motion passed unanimously. Councilman White reported to Council on the Boyington request for rezoning. The Planning & Zoning Board recommends denial. Councilman White moved to hold the Council Public Hearing as soon as the proposed Ordinance can be properly advertised(May 9th). Seconded by Councilman Box, motion passed unanimously. Councilman Box moved that, due to the anticipated absence of several members of the Council on April 2Sth(who will be attending the annual League of Municipalities Convention in Huntsville), the regular Council session be postponed from the 2Sth to the 28th of April, regular time and place. Seconded by Councilman Bishop, motion passed unanimously. Councilman Box moved to authorize a letter be written to the Baldwin County Commissioners about the issuing of Building Permits within the S-mile Planning $ Zoning juris- diction of Fairhope. Seconded by Councilman Ford, motion passed unanimously. Councilwoman Nelson moved to hear the following business not on the Agenda. Seconded by Councilman Box, motion passed unanimously: 11 April 1983 463 Mayor Nix showed the Council a map he had received from the State Highway Department. The map represented the City with the State Highway path hi -lighted thereon. The Department requested the Council to sign the map and return it. Coun- cilman White moved to comply with the request. Seconded by Councilman Box, motion passed unanimously. Councilman Box moved to pay bills as presented as -funds are available. Seconded by Councilman Ford, motion passed unanimously.
