HomeMy WebLinkAbout03-28-1983 Regular Meeting457 STATE OF ALABAMA X COUNTY OF BALDWIN X The City Council, City of Fairhope, met in regular session at 5:30 p.m. Fairhope Municipal Complex, 161 North Section Street, Fairhope, Alabama 36532, on Monday, 28 March 1983. Present were Mayor James P. Nix; Councilmembers Sam E. Box, Roy C. White, Trisha Nelson, David E. Bishop, and Michael A. Ford; City Attorney Jim Reid and City Clerk Evelyn Phillips. Mayor Nix called the meeting to order and Councilman White gave the Invocation. Minutes of the March 14, 1983 regular session were duly approved. Councilman Bishop moved for final adoption of Ordinance No. 710 an ordinance rezoning Robert Van Iderstine's property on Nichols Avenue and Oswalt Strlet from R-2-to R-3. Seconded by Councilman Box, motion passed by the following vote: AYE - Bishop, Box, Nelson, White, and Ford. NAY -none. Councilman Box moved for final adoption of Ordinance No. 711, an or- dinance authorizing the slae of leasehold and improvements and authorizing the Mayor to execute a Bill of Sale, on City Administration Building, 387 Fairhope Avenue, to Farmers & Merchants Bank of Foley. Seconded by Council- woman Nelson, motion passed by the following vote: AYE - Box, Nelson, White, Bishop, and Ford. NAY - none. Councilman Box moved for final adoption of Ordinance No. 712, an ordinance authorizing the sale, and the Mayor to execute a deed, on real property owned by the City(lot adjoining Fairhope Yacht Club) to the Yacht Club. Seconded by Councilman Bishop, motion passed by the following vote: AYE- Box, Bishop, Nelson, Ford, and White. NAY - none. Councilman Box introduced Ordinance No. 713, an ordinance to minimize damage to the natural gas lines, provide a penalty, and establish a permit and fee. In order to take immediate action, Councilman Bishop moved to suspend the rules. Seconded by Councilwanan Nelson, motion passed by the following vote: AYE - Box, Bishop, Nelson, White, Ford & Nix. NAY - none. Councilman Box then moved for final adoption of Ordinance No. 713. Seconded by Councilwoman Nelson, motion passed by the following vote: AYE - Box, Bishop, Nelson, White, Ford and Nix. NAY - none. No bids were received on two police cars. Councilman Box moved to extend the opening to the next regular session. Seconded by Councilman White, motion passed unanimously. Mr. Bob Pope presented an application for an on/Off Premises Beer and an on/Off Premises Wine License for his restaurant, the Yardarm Restaurant, located on the Municipal Pier. After a lengthy discussion, Councilwoman Nelson moved to approve the application. Notion was seconded by Councilman Ford. Councilman Box then moved to table the application until the next regular session. Seconded by Councilman Bishop, motion to table passed by the following vote: AYE - Box,Ford, Bishop. NAY - Nelson, White. 28 March 1983 Mr. John Nelson of the Eastern Shore Chamber of Commerce thanked the Council, Mayor and all City departments for their help and cooperation during the Arts & Crafts Festival March 18-20. A lengthy discussion was held on the use of the former Library location at 10 Summit Street. The Baldwin County Probate Judge, the Institute of Lifelong Learning, and Faulkner Junior College have requested use of the building. Councilman White introduced a Resolution to allow the Probate Judge to use the Marie Howland wing and Faulkner to use the remaining portion. Council- woman Nelson moved to table the Resolution for further study. Notion to table was seconded by Councilman Ford and carried by the following vote: AYE - Nelson Ford, and Nix. NAY - White Box. Mr. Sluder's request to hold a religious service each Saturday afternoon from 3:00 p.m. to 4:30 p.m. at the Municipal Pier area was discussed. City Attorney Reid said this would be permissable. Councilman White said he had reservations -about approving a singular use of a public area on a continuing basis and moved to deny the request. Seconded by Councilman Box, motion passed unanimously.
