HomeMy WebLinkAbout03-14-1983 Regular Meeting454 I STATE OF ALABAMA COUNTY OF BALDWIN The City Council, City of Fairhope, met in regular session at 5:30 p.m., Fairhope Municipal Complex, 161 North Section Street, Fairhope, Alabama 36532, on Monday, 14 March, 1983. Present were Mayor James P. Nix; Councilmembers Roy C. White, Trisha'Nelson, David E. Bishop, Michael A. Ford, and Sam E. Box; City Attorney Jim Reid and City Clerk Evelyn Phillips. Mayor Nix called the meeting to order and introduced the Reverend Michael S. Brown of the Fairhope Assembly of God Church. Reverend Brown gave the invocation. Minutes of the 28 February regular session and the 10 March 1983 special session were duly approved. The following Fairhope High School students, and sponsor. Ms. Mary J. Hansen, were introduced. These students had been elected as the Mayor and Council during Student Government Week and were attending the Council session to observe how their real -life counterparts conducted a session: Jeff Rawson - Mayor Rene Marques - Place 1 Shane Mason - Place 2 Michelle Smith - Place 3 Rodney Hobbs - Place 4 Keith Connell - Place 5 A public hearing was held on the Robert Van Iderstine rezoning request. No one present was opposed to the rezoning of Mr. Van Iderstine's property from R-2 Medium Density Single Family Residential to R-3 High Density Single Family Residential. Property is located on the corner of Nichols Avenue and Oswalt Street and this rezoning would allow Mr. Van Iderstine to turn his lots to face a paved street instead of an unpaved one. The Planning & Zoning Commission recommendation was to approve the request. After some discussion, Councilman White introduced an Ordinance to rezone the property which will be acted upon at the next regular session. Councilman White moved to place 4-way stop signs at the intersection of Pier Avenue and Satsuma Street. Seconded by Councilman Box, motion passed unanimously. Only one bid was received on the proposed sale of the City Hall building at 387 Fairhope Avenue: $127,751.00 from Farmers & Merchants Bank of Foley, Alabama. Councilman Box moved to accept this bid, subject to approval of leasehold transfer by the Fairhope Single Tax Corporation, and said he would introduce the necessary Ordinance for the sale of this property. Seconded by Councilman Bishop motion passed unanimously.. March 14, 1983 455 The Fourth of July Celebration was discussed. Mr. Bill Milham said he would be willing to co-ordinate the festivities in return for reimbursement of expenses. This will be further discussed at the next regular session. Councilman Box moved that bid requests be issued for the purchase of two Police Cars, with and without trade-ins. Seconded by Councilwoman Nelson, motion passed unanimously. A Mr. Sluder requested permission to hold a religious service on the beach each Saturday afternoon from 3:00 to 4:30. After some discussion, Councilwoman Nelson moved to take this request under advisement for further study before taking action. Seconded by Councilman Box, motion passed unanimously. Councilman Bishop announced that the April 18th free Symphonic Band Concert would be in observance of the 75th anniversary of the incorporation of the City of Fairhope (April 25, 1908) and he hoped the media would advertise this. Councilman Box advised that, after several meetings with rep- resentatives of the Fairhope Yacht Club, a settlement had been reached as to the termination of the lease between the Club and the City. Councilman Box said that Councilman White had served as secretary at these meetings and asked Mr. White to outline the recommendation the committee would now like -the Council to consider. Councilman White said that he, Councilman Box, Councilman Bishop nad Building Official Bob Lunsford had spent several months working out an agreement with the Yacht Club. The lease called for an 18-month notice of termination (which had been given by the City to the Club 18 months ago). and that, at termination, the City was to pay the Club for all im- provements, on the leased property(used as boat rental slips). In response to the Club's request for some $70,000+ to cover these improvements, the City was going to offer them an adjoining lot(66') (for which an offer of $35,000 had been received) and allow them to retain all 1983 boat slip rental fees(approximately $6900). Councilman Box then introduced an Ordinance to cover the conveyance of this property to the Yacht Club plus the fees in exchange for the improvements to finalize the lease termination. This Ordinance will be acted upon at the next regular session. City Attorney Reid requested that the minutes show that Yacht Club members - Mayor Nix, Councilmembers Nelson and Ford - did not and have not participated in any of these negotiations, on the City's side, so they will be able to vote on the final passage of the necessary Ordinance. Councilwoman Nelson reported that she, Mayor Nix, and Council - member Ford, did meet with Congressman Jack Edwards while in Washington, D.C. last week on the question as to whether or not funds might be available for the possible purchase of the Dyas Triangle property for reservation as an "open green space". At this time, no funds are available. March 14, 1983 456 Councilman Bishop announced the Grand Opening of the new location in the Fairhope Municipal Complex will be held next Sunday, March 20th, at 3:00 p.m. Mayor Nix announced that permits had been issued for $449,017 of new construction this year. Councilman Box moved to pay bills as presented upon receipt of necessary funds. Seconded by Councilman Ford, motion passed unanimously. Several citizens stated complaints about the enforcement of the Dog Ordinance. Meeting was duly adjourned. v�Lt�-- e . City C1 k
