HomeMy WebLinkAbout12-20-1976 Special MeetingSTATE OF ALABAMA COUNTY OF BALDWIN The City Cobtncil of the City of Fairhope met in special session at the City Administration Building, 387 Fairhope Avenue, on Saturday, December 20, 1975 at 10:00 A.M. with the following members present: Mayor James P. Nix, Councilmen: David E. Bishop, H. G. Bishop, Sam E. Box and 011ie E. Deese. Councilman Barney L. Shull being absent. Mayor Nix stated that the purpose of the meeting was to meet with property owners on Blue Island Avenue pertaining to their paving assessment. Each Council member present waived notice of the calling of the special meeting. Mr. Claude Arnold, Engineer on the project, outlined the steps taken on the project which were according to the law governing Paving Assessments. The cost of Blue Island Avenue was higher than the estimated cost and price quoted at the meeting did not include the cost of sewer.construction although property owners were told that the cost of sewer was included in the price. Property owners requested that an Ordinance be adopted requiring the Council to notify all property owners by registered mail of the actual cost of street paving after bids have been opened. An Ordinance requiring property owners to pay cost of Engineering if they drop out of paving after bids have been opened and actual cost is too high.was discussed but no action taken at this time. Councilman 011ie Deese introduced the following Ordinance: ORDINANCE NO. 5-44 AN ORDINANCE REPEALING THAT SECTION OF ORDINANCE NO. 560 AFFECTING BLUE ISLAND AVENUE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAIRHOPE, ALABkU, that due to errors and defects, that portion of Ordinance No. 560, (AN ORDINANCE DETERMINING ALL OBJECTIONS AND DEFENSES TO ORDINANCE NO. 543 AND ASSESSING THE COST OF SAID IMPROVfIENTS UPON THE PROPERTY SPECIALLY BENEFITTED THEREBY) pertaining to Blue Isla Avenue is hereby repealed. This�Ordinance shall be effective immediately upon its adopt ion and publication as required by law. Adopted this the 20th day of December, 1975. Attest: er Approved yor Councilman 011ie Deese moved that all rules governing the council which might, unless suspended, prevent the passage and adoption of the ordinance at this meeting, be and the same are hereby sus- pended for the purpose of permitting the said ordinance to be finally passed and adopted at this meeting. Councilman Sam Box seconded the motion and on roll call the vote was as follows: For: Councilmen: David E. Bishop, H. G. Bishop, Sam E. Box and 011ie E. Deese. Councilman Barney Shull being absent. Against: None. Motion adopted by unanimous vote of the members present. Councilman 011ie Deese then moved that the said ordinance be finally passed and adopted as introduced. Councilman Sam Box seconded the motion and on roll call the vote was as follows: For: Councilmen: David E. Bishop, H. G. Bishop, Sam E. Box and 011ie E. Deese. Against: None. NOTICE TO PROPERTY OWNERS Notice is hereby given that the Assessment Roll, prepared in accordance with the law in such cases made and provided, under a Resolution To Provide For Certain Improvments on Blue Island Avenue in the City of Fairhope, adopted on the 9th day of Septem- ber, 1974 and confirmed on the 14th day of October, 1974 by STREET IMPROVEMENT ORDINANCE No. 543, by the City Council of the City of Fairhope, Alabama, has been delivered to me and is open fo: inspection in the office of the City Clerk of the City of Fairhope Alabama the person authorized to make collections of assessments for improvements constructed under said Ordinance, and that the City Council of the City of Fairhope, Alabama, will meet on the 31st day of January, 1976 at 10:00 o'clock A.M. at the City Administration Building to hear and determine any objections, pro- tests or defenses that may be filed to such proposed assessments or the amounts thereof. The general character of the improvements constructed under said Ordinance consists of a 20 foot bituminous concrete pave- ment 12 inches thick compacted, primed, granular soil base constructed between 2.5 foot wide 6 inch portland cement concrete valley gutters; together with brick manholes and catch basins where necessary with metal or contrete covers, concrete culverts, concrete pipe, drop inlets, grading, clearing, grassing and sodd- ing as necessary for erosion control and effective completion and protection of said streets. Blue Island Avenue, from the north edge of the existing pavement on Fairhope Avenue northwardly 1840 feet to the existing pavement on Blue Island Avenue at Winn Lane, shall be improved by the construction of all of the construction items listed above together with such additional metal pipe and concrete pipe culverts necessary to substantially control erosion along said street and also including construction of the 1285 linear feet of 8 inch vitrified clay sanitary sewer (with standard manholes and laterals) that will connect to the Fairhope Avenue Sewer line by gravity flow. The streets, avenues, alleys or other highways or portions thereof which said improvements have been constructed and terminal points of said improvements are as follows, to -wit: BLUE ISLAND AVENUE, from the north edge of the existing pavement on Fairhope Avenue northwardly 1840 feet to the existing pavement on Blue Island Avenue at Winn Lane. CITY OF FAIRHOPE y c ier Motion adopted by unanimous vote of the members present and the Ordinance finally passed and adopted as introduced. It was duly moved, seconded and carried that the meeting adjourn. COUNCILMAN STATE OF ALABAMA COUNTY OF BALDWIN We, the undersigned members of the Fairhope City Council hereby waive notice of a Special Meeting for the purpose of meeting with the Recreation Board, appoint member to the Board of Zoning Adjust- ment and Appeals and appoint member to the Planning and Zoning Commission, and do consent that said meeting be held at the City Administration Building, 387 Fairhope Avenue in the City of Fairhope, Alabama at 5:30 P.M. on the 15th day of December, 1975. ounci man Council meeting,Saturday, Dec. 20, 1975 at 10:00 A.M.
