STATE OF ALABAi'A COUNTY OF' BALDWIN The City Council of the City of Fairhope, Alabama met in regular session on Monday, November 22, 1976, at 7:00'P.i., at the City Administration Building, 387 Fairhope Avenue, Fairhope, Alabama with the following members present: Mayor James P. Nix, Councilmen: David E. Bishop, Sam E. Box, Jack A. Stipes and Billy Don Wiggins. T-Iembers absent: Councilman H.G. Bishop. The minutes of the November 8, 1976 meeting were approved. .% "This `being, the date ',se,t for the opening of bids on the Garbage Contract,.the`�following,bid was received: Eugene+ `Bosby, `` 5,500.00 Per Month r� Councilman Sant E.' Box moved, seconded by Councilman Billy Don Wiggins to°accept the bid on the Garbage Contract as submitted by Mr,' Eugene' ;Bosby .- °11otion carried. Councilman Sam E. Box moved, seconded by Councilman Jack A. Stipes, that the City of Fairhope contribute to the Baldwin County Mental Health Program at fifty cents (.50G ) per person. Motion carried. Councilman Jack A. Stipes moved, seconded by Councilman Sam E. Box for final adoption of Resolution for vacation of alley, introduced at the November 8, 1976 meeting of the Fairhope City Council. Upon being put to vote the following vote was recorded: AYES: David E. Bishop, Sam E. Box, Billy Don Wiggins, Jack A. Stipes. 14AYES: NONE. Motion carried. Mr. Posey of Owen Posey and Associates, came before the Council to discuss the possibility of a feasibility study on additional sources of gas for the City of Fairhope. Councilman Sam E. Box moved, seconded by Councilman Billy Don Wiggins, to authorize Owen Posey and Associates to give the City of Fairhope an estimate on the cost of a feasibility study in order to acquire additional sources of gas for the City. Motion carried. This being the date set for Public Hearing on the rezonin of property from R-2 Medium Density Single Family Residential District to R-3 Limited Multi -Family Residential District, for Mr. Sam Irby and Mr. S. Starke Irvine, for Lots 15 & 16, Block 16, Volanta Subdivision, located on the north side of Perdido Avenue, the following area residents voiced their opposition to the rezoning of this property: Roy Crass 305 Perdido Al Nonkes 606 North Mobile Sally Maloney 565 North Mobile Mrs. Albert Nonkes 606 North"Mobile Mrs. Gertrude Mallory 358'Perdido M Councilman David E. Bishop moved, seconded by Councilman Jack A. Stipes that the application for rezoning be denied. Upon being put to vote the following vote was recorded: AYES: David E. Bishop, Sam E. Box, Jack A. Stipes, Billy Don Wiggins. NAYES: NONE. December 24 December 31 Councilman Sam E. Box moved, seconded by Councilman Jack -A. Stipes to open,bids as received on a new gas truck. Motion carried. The following bids were received: Gaston Motor Company --------------------- 7,527.71 ( with power steering ) 7,774.21 Bill Steber Chevrolet -------------------- 7,340.08 ( with power steering, dual brake system and automatic brake adjustments ) 7,903.76 Councilman Billy Don Wiggins moved, seconded by Councilman Jack A. Stipes to accept the low bid on the purchase of a new truck for the gas department providing it -meets specifica- tions. Motion carried. Councilman Jack A. Stipes moved to introduce the follow- ing amendment to SECTION 2-10 (a), CODE OF ORDINANCE' OF THE CITY OF FAIRHOPE, ALABAMA. SEC. 2-10(a) Vacations and sick leave for salaried city employees; contract provisions, is hereby amended to read as follows: 6. Employees can not be paid for accumulated sick leave, unless the employee retires on disability; in such case as the employee retires on disability he must furnish the City of Fairhope a certificate from his physician before he can receive pay for his accumulated sick leave. Stipes moved to nominate Mr. Vince Valentim to the Board,of Adjustments and Appeals. ' e'Councilman Sam E. Box moved to nominate Mr. Clint Fortenberry to the 'Board of Adjustments and Appeals. Nix, Councilmen David Bishop and Sam Box. Mr. Clint Fortenberry was appointed to the Board of Adjust- ments.and Appeals. Councilman Sam E. Box moved to appoint Mrs. Ruth Rockwell to fill the unexpired term of Dr.`E.C. Dillabough, which expires in January of 1977, on the Parking Authority. Motion carried. Councilman Jack A. Stipes stated that he would like to see a member of the City Council appointed to the Harbor Board. Councilman David E. Bishop nominated Councilman Jack A. Stipes as the Councils representative to the Harbor Board. Councilman Sam E. Box nominated Mr. A.J. Koppersmith to serve on the Harbor Board. Councilman Sam E. Box moved that the nominations be closed, seconded by Councilman Jack A. Stipes. Motion carriec Upon being put to vote the following vote was recorded: Councilman Jack A. Stipes: AYES: David E. Bishop, Jack A. Stipes, Billy D. Wiggins. Mr. A.J. Koppersmith: AYES: Mayor James P. Nix and Councilman Sam E. Box. Councilman Jack A. Stipes was elected to serve as a member of the Harbor Board. Councilman Sam E. Box nominated Mr. Charlie Carpenter to the Harbor Board. Councilman Jack A. Stipes nominated Mr. Bill Gable to the Harbor Board. Councilman David E. Bishop moved, seconded by Jack A. Stipes that the nominations be closed. Upon being put to vote the following vote was recorded: Charlie Carpenter: AYES: Mayor James P. Nix and Council - Sam E. Box. Bill Gable: AYES: David E. Bishop, Jack A. Stipe: Billy Don Wiggins. Mr. Bill Gable was elected to serve on the Harbor Board. :o J'0 Councilman Sam E. Box moved, seconded by Councilman Billv on Wiggins to adopt the`following Resolution, and a copy of this-RResolution'be sent to'`the Fairhope Single Tax Corporation and _the Parking Authority., Motion carried. RESOLUTION BE IT RESOLVED, that a very special thank -you be given to the r-090PE SINGLE TAX CORPORATION for providing the financial assistance in acquiring and constructing the downtown parking area. ALSO, to the FAIRHOPE PARKING AUTHORITY, for their time and untiring efforts in seeing this project through to its completion. ALSO, to -the many other individuals that contributed to this project. Councilman Sam E. Box moved, seconded Councilman Billy Don Wiggins to enter the.following report as submitted by Fire Chief Walter Mack Yohn into the minutes of this meeting. Motion carried. FA,,...HOPE VOLUNTEER FIRE DEPARTMI POST OFFICE BOX 626 FAIRHOPE, ALABAMA 36532 - - - - PHONE 928-2371 20 November 1976 Honorable Mayor and Council City of Fairhope Fairhope, Alabama 36532 Dear Mayor and Council, The Fairhope Volunteer Fire Department submitts the following infor- mation as requested. 1. The Primary purpose and responsibility of this department is the protection from,Loss of Life and Property, in that order. 2. The area of prime responsibility is: a. Inside the city-11mits and it's police jurisdiction. b. To any organized fire department (Mutual Aid), who request assist- ance. c. To any area outside of the city limits and it!s police jurisdict- ion where there is no fire protection. This area is located west of Fish River to Mobile Bay; North from Mary Ann Beach to the City Limits of Daphne, utilizing the following equipment. (1) To a house fire - Respond with One Pumper, Civil Defense Tank Truck and the Forest Department's Tank Truck. (2) To a grass fire - Respond with the Civil,.Defense Tank Truck and the Forest Department's Tank Truck. 3. The plans and policies for assistance to neighboring departments as well as departments beyond the neighboring departments within the County - All the fire.departmenta located in Baldwin County have a Mutual Aid Agree- ment to assist each other upon request by a department. To this request we will respond with One Pumper plus the Forest Department's Tank Truck if there are no fire hydrants located in the area of the fire or emergency. 4. The policy for recovering our cost for out of jurisdiction calls - We will receive mutual aid in the same fashion as we give to other departments. Also this yeax we received five hundred dollars (3500.00) from the Baldwin County Commission for rural fire protection. The money for this year was used to purchase equipment for our Civil Defense Tank Truck which is used both inside and outside of the city limits and itto police jurisdiction. It is anticipated that we will receive the same amount or more each year from the County Commission for rural fire protection. 20 November 1976 5. Decisions for any action not covered above will rest with the Fire Chief or with the Officer in Charge at the time of the emergency. Nix requested that Councilman Jack A. Stipes as head of the Street Committee look into the situation of the sidewalks in the Ingleside area and report his recommendations back to the Council in regards to the repair of the sidewalks. Councilman Jack A.aStipes stated that Miss Sheree Smith of Fairhope had won the title of Baldwin Couritys Junior Miss and would represent Baldwin County iri the State finals of,"the,Junior Miss Pageant, in Montgomery. Councilman Stipes asked that •the -Mayor `Proclaim the day of the State finals of the Junior Miss Pageant as Sheree Smith day in the City of Fairhope and that:the Mayor issue a proclamation to Miss Smith to be presented to her at the December 13, 1976 meeting of the City Council. Councilman Sam E. Box told the Mayor and Council that the Volanta Street Committee has reported that they have all of the property signed up for sewer line with the exception of two and a half lots. Councilman Sam E. Box moved, seconded by Councilman Jack A. Stipes for the City to accept the money of the property owners in escrow and buy the materials to install the sewer line on Volanta Street. Motion carried. Councilman Sam E. Box moved, seconded by Councilman Billy Don Wiggins , that the Gas Department of the City of Fairhope retain Jordon Don Odom as an employee after his CETA runs out on January 20th, 1977. Motion carried. J. Russell Kilgore, Chairman of the Airport Board came before the Mayor and Council and informed them that the Department of'Transportation had notified him that there were no discretionary funds available at this time for the repairs needed at the -Airport. Mr. Kilgore stated that the situation was serious and needed immediate attention. Mayor Nix asked Councilman Wiggins to meet with the Airport Board and getjestimates on the cost of'resurfacing and report his findings back,to the Council as soon as possible, and if necessary a special meeting of the Council would be called in order to correct the situation.
