HomeMy WebLinkAbout10-25-1976 Regular Meetingi STATE OF ALABAMA COUNTY OF BALDWIN The City Council of the City of Fairhope, Alabama met in regular session on Monday, October 25, 1976, at 7:00 P.M., at the City Administration Building, 387 Fairhope Avenue, Fairhope, Alabama with the following members present: Mayor James P. Nix, Councilmen: David E. Bishop, H.G. Bishop, Sam E. Box, Jack A. Stipes and Billy D. Wiggins. The minutes of the October 11, 1976 meeting were approved. Councilman Henry G. Bishop moved, seconded by Councilman Sam E. Box, to set the salary of the City Clerk -Treasurer and Accountant at $ 12,000.00 a year. Motion carried. Councilman Sam E. Box moved, seconded by Councilman David E. Bishop,,,for final adoption of the resolution authorizing the Mayor to act as Superintendent of the Utilities. Motion carried. Councilman David E. Bishop moved, seconded by Councilman Billy D. Wiggins for final adoption of Ordinance # 582, an Ordinance establishing the electric rates for electric service furnished by the Electric Distribution System of the City of Fairhope, Alabama, and repealing any and all Ordinances in con- flict therewith. Motion carried. Councilman David E. Bishop moved, seconded by Councilman Jack A. Stipes to introduce the following Resolution. Motion carried. RESOLUTION WHEREAS, The properties located within the City Limits of the ten (10) Municipalities in Baldwin County produce a major portion of the property tax for Baldwin County; WHEREAS, The County Commission are elected to serve all citizens of Baldwin County on a fair and equitable basis; WHEREAS, County funds are primarily being spent for projects, maintainence and services located outside of the Corporate Limits of the ten (10) Municipalities in Baldwin County; NOW THEREFORE BE IT RESOLVED, that the County Commission be requested to rpovide on a fair and equitable basis, the same benefits that are made available to County residents. Box moved, seconded by Councilman Don Wiggins that all rules governing the Council which might, unless suspended, prevent the passage and adoption of the Resolution establishing the pay scale for all City Employees, be and the same are hereby suspended, for the purpose of said Resolution to be finally passed and adopted at this meeting. YEAS: David E. Bishop, Henry G. Bishop, Sam E. Box, Jack A. Stipes and Billy D. Wiggins.NAYES: None. Councilman Sam E. Box moved that the said Resolution be finally passed and adopted as introduced. David E. Bishop seconded the motion. Upon being put to vote the following vote was record- ed: AYES: David E. Bishop, Henry G. Bishop, Sam E. Box, Jack A. Stipes and Billy D. Wiggins. NAYES: None. Councilman Sam E. Box moved, seconded by Councilman Billy D. Wiggins to open the two (2) bids.received on a new Police car. Motion carried. The following bids were received: Bill Steber Chevrolet: 5,080.07 Gaston Ford Company 5,147.00 Councilman Jack A. Stipes moved, seconded by Councilman David E. Bishop to reject the above bids and ask that bids be resubmittec in accordance with City specifications. Motion carried. Mayor James P. Nix informed the Council of the Ethics Commis- sion requirements, and stated that all Councilmen need to file a report with the Commission if they have not already done so for this year. Councilman Jack A. Stipes informed the Mayor and Council of his findings on the license requirements of Air -Conditioning and Heati , and forwarded a copy of the City of Mobiles Ordinance regarng Air -Conditioning and Heating , to the City Inspector and the City Attorney for their inspection and recommendations. Councilman Sam E. Box.gave a report to the Mayor and Council regarding his findings on the petition for a sewer line on Volanta Avenue. Mr. Isadore Reynolds was present to represent the petition. Mr. Box reported on what would be involved in running a sewer line on Volanta, along with the approximate cost of said line. Mr. Isadore Reynolds said that he would see if he could get a majority of the people willing to pay for the installation of the sewer line and report back at the next meeting of the Council. Councilman Don Wiggins moved, seconded by Councilman Jack A. Stipes, to pay the final contractors estimate , as submitted by Sumlin & Sumlin in the amount of $ 71,195.20, for the new football stadium. Motion carried. Councilman David E. Bishop asked Councilman Don Wiggins to contact Recreation Board member David Stapleton concerning Mr. Stapleton's absenteeism from Recreation Board meetings. Mr. Camp of WABF Radio came before the Mayor and Council and offered a five minute program on Sunday afternoons, in order for the Mayor and Council to inform the citizens of City.business. No action was taken at this time. 0 Mr. Scaggs came before the Mayor and Council and asked that reconsideration be given to his request for a gas service line due to the health of his wife. Councilman David E. Bishop moved, seconded by Councilman Jack A..Stipes, that as a matter of human principle Mr. Scaggs be allowed to have a gas line installed, providing that his wifes physician provide the City with a certificate stating that his wifes health requires this type of heating. Motion carried. Councilman Jack A. Stipes moved that the City discontinue providing free telephone service to all elected or appointed City employees. The motion died for lack of a second. Councilman Billy D. Wiggins moved, seconded by Councilman Sam E. Box, to retain the five (5) CETA employees until January 1; 1977, with instructions to the heads of the departments for which they work to either,find ways to tighten their belts to help take care of these employees, or else find out how other people already employed by the City can handle their jobs. Motion carried. Councilman David E. Bishop moved, seconded by. Councilman Billy D. Wiggins, to equalize the basic charge for telephone service for all City Supervisors on 24 hour call in the amount of�$ 10.55 plus tax for all employees. Upon being put to vote the following vote was recorded: AYES: David E. Bishop, Henry G. Bishop, Sam E. Box and Billy D. Wiggins. NAYES: Jack A. Stipes. Motion carried. After a discussion on the budget for the 1977 Fiscal Year, Councilman Sam E. Box, moved seconded by Councilman David E. Bishop to accept the budget until the City receives the annual Audit Report, at which time the budget will be reviewed again. Councilman Sam E. Box moved that the Chief of the City of Fairhopes Fire Department,,with the aid of his staff and Officers or neighboring departments draw up a map of our area showing: 1. The area of prime responsibility 2. The limits of jurisdiction where a fire call will be answered, and submit written plans and procedures r for the following: 4 a. The plan(s) for assistance to neighboring departments. b. The policy of assistance to Departments beyond the next neighboring department. C. The policy for recovering our cost for out of jurisdiction calls. The motion was seconded by Councilman Jack Stipes. Motion carried It was duly moved, seconded and passed that the meeting adjourn. 1 AP ATTEST: t e Mayor James P. Nix reported to the Council that the City had been notified by officials of the CETA Program that they would be losing seven (7) of the CETA Employees. Councilman Jack A. Stipes moved, seconded by Councilman Henry G. Bishop, that that the employees be retained until the October 25th, 1976 meeting of the Fairhope City Council, in order to see if there are other means of funding the employees. Motion carried. Councilman Jack A. Stipes asked that a decision on the Parking area be continued in order for him to further look into the situation and report back to the Council.
