COUNTY OF BALDWIN
The City Council of the City of Fairhope, Alabama met in
regular session on Monday, October llth, 1976, at 7:00 P.M.,
at the City Administration Building, 387 Fairhope Avenue,
Fairhope, Alabama with the following members present:
Mayor James P. Nix Councilmen: David E. Bishop,, H.G. Bishop,
Sam E. Box, Jack A. Stipes, and Billy D. Wiggins.
The minutes of the October 4, 1976 meeting were approved.
Mr. Henry G. Bishop nominated Mr. Sam E. Box to represent
the City Council on the Planning and Zoning Commission.
Mr. David Bishop moved that the Nominations be closed, seconded
by Mr. H.G. Bishop. Motion carried.
y Mr. Jack A. Stipes moved, seconded by Mr. Sam E. Box to combine
the job of City Clerk -Treasurer. Motion carried.
Mr. Henry G. Bishop moved, seconded by Mr. Sam E. Box that
Airs. Carolyn Adams be appointed City Clerk -Treasurer. Motion
carried.
Councilman Billy D. Wiggins recommended that the salary of the
City Clerk -Treasurer be held over for two (2) weeks, until the
next regular meeting of the Council.
Air. H.G. Bishop moved, seconded by Mr. Sam Box that the salary
of the City Clerk -Treasurer be set at the next regular meeting
of the City Council. Motion carried.
Councilman Sam E. Box moved that Leo Gilheart be appointed
Chief of Police at his present salary. Mr. Ed Bishop seconded
the motion. Motion carried.
Mr. Sam E. Box moved, seconded by Mr. Henry G. Bishop that
Mr. E.J. Kirk be appointed General Superintendent, at -his present
sa-lar"y.. , Motion carried.
Motion by Sam E. Box, seconded by H.G. Bishop that the followi
resolution be adopted. Motion carried.
RESOLUTION
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FAIRHOPE
ALABAMA, that James P. Nix, Mayor of the City of Fairhope, Ala-
bama, be and he is hereby required to act as Superintendent of
the Municipal Water System, Municipal Light and Power System,
and Municipal Gas System, and as such he shall see that the
systems are kept in proper repair and operation and have inform-
ation relative to such systems available for the City Council.
BE IT FURTHER RESOLVED, that in addition to the salary now
fixed and paid to aid Mayor of the City of Fairhope under the
general law of the State, there shall be paid to James P. Nix,
as Superintendent of the Utilities, the sum of THREE HUNDRED
DOLLARS ( $300.00 ) per month..

The City Council of the City of Fairhope may at any regular
meeting or special meeting called therefore, discontinue the
services of the Mayor as Superintendent of Utilities, and in the
event of such discontinuance of his services as Superintendent

of Utilities, all compensation authorized as Superintendent
shall lapse.
This resolution shall become effective on October 1, 1976,
and shall expire on October 1, 1980, and sooner if the present
Mayor shall vacate office.

Councilman Sam E. Box moved, seconded by Councilman Billy
D. Wiggins, to appoint Roy C. White City Judge at a salary of
$ 250.00 per month until December 31, 1977. Motion carried.
Councilman Sam E. Box moved, seconded by Mr. David E.
Bishop to appoint Mr. John V. Duck City Attorney. Motion
carried.
Councilman Billy D. Wiggins moved, seconded by Councilman
Jack A. Stipes, to authorize the City Judge and Radio Operators
to sign warrants of arrest. Motion carried.
Councilman David E. Bishop moved, seconded by Councilman
Sam E. Box to authorize the City Judge, The Mayor and the Chief
of Police to set appearance bonds. Motion carried.
A Paving Bond for Gene Earl McKenzie was discussed. The
City Attorney recommended to the Council that Mr. McKenzie
reappear before the Fairhope Planning and Zoning Commission in
order to establish a time and amount on the Paving Bond. The
Council agreed with the City Attorneys recommendation.
Coundilman Henry G. Bishop moved for final adoption of
Ordinance No. 581, an Ordinance.i_ntroduced at the September 27,
1976,meeting of the Fairhope City Council, annexing property
contiguous to the City Limits of the City of Fairhope. Council-
man Sam E. Box seconded the motion. Motion carried.

Mayor and City Council, Fairhope, Alabama
We the undersigned property owners residing or preparing to build homes
on West Volanta Avenue are hereby requesting that the City of Fairhope
install a sewer collection system on West Volanta Avenue.
It should be noted that some of the property owners now living or now
preparing to build homes on this street have been paying taxes over
thirty years on subject street and all property has been taxed by the
City every since Fairhope first started collecting ad valorem taxes.
It should also be taken into consideration that plans for sewer system
with pumping station at bay end of street have been made and appaAhtly
approved by the city because it is understood that Moore Engineering -
has been paid for completion of subject plans.

A petition from nine (9) or ten (10) people on West
Volanta Avenue for sewer service was presented to the Mayor
and Council. After. a discussion between the Mayor -and Council
and the people present representing the petition, the matter
was turned over to Councilman Sam E. Box for study and to come
up with recommendations to the City Council to see what can be
done regarding sewer service in that area.
The City of Fairhope s General Fund, Electric Fund, Gas Fund,
and Water Fund budgets were looked over by the Mayor and Council
for the Fiscal Year beginning October 1, 1976 and ending Septem-
ber 30, 1977. After a discussion about the annual budgets,
Councilman Billy D. Wiggins moved, seconded by Councilman Jack
A. Stipes that the council carry the proposed budgets over until
the October 25th, 1976 meeting of the City Council in order for
them to further study budgets. Motion carried.
The Electric Rate study as prepared by St. John's Engineers
was looked over by the Mayor and Council members.
After a discussion Councilman Henry G. Bishop moved to
introduce the following Ordinance:

FURNISHED BY THE ELECTRIC DISTRIBUTION SYSTEM OF THE CITY OF
FAIRHOPE, ALABAMA, AND REPEALING ANY AND ALL ORDINANCES IN CONFLI
THEREWITH.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY COUNCIL OF
THE CITY. OF FAIRHOPE, ALABAMA THAT THE FOLLOWING SCHEDULE.OF RA
FOR ELECTRIC SERVICE FURNISHED FROM THE ELECTRIC DISTRIBUTION

ADOPTED.
I. RATE FOR DOMESTIC RESIDENTIAL ELECTRIC SERVICE
System.
AVAILABILITY
Available in all areas served by the City owned Electri
APPLICABILITY
Applicable to single residences, mobile homes where suc
are individually metered, and individual family apartments where
cost of service is paid by the occupant.
CHARACTER OF SERVICE
Single or three-phase service at 120/240.volts 60 Hertz
MONTHLY RATE - $3.00 minimum
First 50 KWH per month at 6.0 cents, plus
next,200 KWH per month at 4.0 cents, plus
next .750 KWH per month at 3.0 cents, plus
all over 1000 KWH/month at 2..3 cents for months of
October to April, and
all over 1000 KWH/month at 3.0 cents for months of
May through September.
Plus, preceding month's Alabama Power Company Fuel Adder
billed, if above Zero.
MINIMUM BILL
The minimum monthly bill shall be $3.00.
TAXES
The above rate is that .charged by the City of Fairhope,
and any additional charges levied by .the State or Federal author-
ities such as sales taxes, will be passed on to the consumer in
addition to the above rate schedule.

Bills for service rendered hereunder are payable with
ten (10) days from due date and if not paid within such period,
shall be increased by a delinquent fee of.5% of total bill.
TERM OF :CONTRACT 5-
Service hereunder shall be for an initial period of twelve
(12) months and thereafter from month to month until terminated
by proper authorization.
II. RATE FOR GENERAL ELECTRIC SERVICE - COMMERCIAL
AVAILABILITY
Available in all areas served by the City of Fairhope-owned
Electric System.
APPLICABILITY
Applicable for non-residential lighting and power service
where.the maximum 15-minute,integrated demand does not exceed
49 KW.. Service to more than one premises not to be combined,
nor shall it be shared with or resold to others.
CHARACTER OF 'SERVICE
Single or three-phase service, or combination of both, at
the nominal .secondary voltage, or at the available primary distri
bution line voltage in special cases. Any consumer receiving
service at two different voltages will be considered as two
separate consumers. The type of metering is to be specified by
the City.
MONTHLY RATES
First 50 KWH per month at 6.5 cents, plus
Next 150 KWH per month.at 5'.5 cents, plus
Next 1800: KWH per month at 4.8 cents, plus
Next 3000 KWH per month at 4..3.cents, plus
Next 700.0. KWH per month at 1.5 cents, plus
All over 12,000 KWH/month at 3.0 cents, plus
Preceding month's Alabama Power Company Fuel Adder Billed to Cityl
if above Zero.
MINIMUM BILL
The minimum monthly bill shall be $3.25.
TAXES
The foregoing rate is that charged by the City and any addi-I
tional charges levied by State or Federal authorities, such as
sales taxes, will be passed on totheconsumer in addition to thel
above .schedule.
PAYMENT
Bills for service rendered hereunder are payable within TEN
(10). days from due date, and if not paid within such period, shall
be increased by a delinquent fee of,5o of total bill.

TERM OF SERVICE
Service hereunder shall be for an initial period of twelve
months, and thereafter from month to month until terminated by
proper authorization.
TEMPORARY OR SEASONAL SERVICE
Where service is provided hereunder for a period of less
than one year, continuously), or where services is seasonal or
temporary, a surcharge of 25% shall be added to each month's bill
after the bill has been computed in accordance with the rate. In
view of the surcharge being paid while service is being rendered,li
no monthly minimum or other charge is to be made to seasonal
customers during the period that service has been disconnected.
For each non -reoccurring temporary service where it is necessary
for a temporary sercice pole to be set and/or a temporary service
drop to be run from existing utility lines, the City may make a
service to cover the cost of installing and removing such service
This charge is to be set by the Electrical Superintendent.
III. INDUSTRIAL ELECTRIC RATES
AVAILABILITY
Available in all areas served by the City -owned Electric
System.
APPLICABILITY
Applicable for lighting, power, and miscellaneous electric
service whose integrated 15-minute demand is 50 KW or more, where
the entire electrical requirements of the consumer are furnished
by the City. Service to more than one premises shall not be
combined, nor shall it be shared with or resold to others.
CHARACTER OF SERVICE
Three-phase service, or combination of single and three-phase
at the voltage of the available primary or secondary distribution
lines of the City. Any Consumer receiving service at two differ-
ent voltages will be considered as two separate consumers. The
type of metering is to be specified by the City. This rate is
based on ownership of transformation facilities by the City (for
primary voltage ratings of 13 KV and below); however, ownership
of such by the consumer is subject to negotiation by and with
the City.

TERM OF CONTRACT
Service hereunder shall be for an initial period of two
(2) years and thereafter from month to month until terminated
by thirty (30) days written notice.
TEMPORARY OR SEASONAL SERVICE
Where service hereunder is provided for a period of less tha
/or
one (1) year,(continuously) at the request of the consumer,/where
service is seasonal or temporary, a surcharge of twenty-five (25%1
percent shall be added to each month's bill after the bill has
been computed in accordance with the rate.
MONTHLY RATE
DEMAND: First 20,000 KWH per month at 3.0 cents, plus
Next 80,000 KWH per month at 2.4 cents, plus
Next 100,000 KWH per month at 2.0 cents, plus
All over 200,000 KWH/month at 1.7 cents, plus
preceding month's Alabama Power Company Wholesale Fuel Adder bill d,
if above Zero.
DETERMINATION OF BILLING DEMAND
The demand for billing purposes shall be the maximum measur
integrated 15 minute interval demand during each billing period
of approximately thirty (30) days, measured in KW (kilowatts);
provided, however, that no demand shall be taken at less than

seventy-five percent (75%). of the maximum demand'established dur
any of the eleven (11) preceding months, nor less than 38 KW.
MINIMUM BILL
The minimum bill shall not be less than computed from a
seventy-five (75%) percent of the larges demand in KW established
during the preceding eleven (11) months, nor less than $102.60.

be increased by a delinquent fee to be set by the Electrical
Superintendent.
TAXES
The foregoing rate is that charged by the City, and any
additional charges levied by State and Federal authorities, such
as sales taxes, will be passed on to the consumer in addition to
the above rate schedule.

IV. MISCELLANEOUSIRATESCHEDULES
SCHOOLS
To both public and private primary and secondary schools,
regardless of the size of their electrical requirements, the
following monthly rate shall apply:
For all KWH used during each monthly period at 2.6 cents
per KWH, with no monthly minimum or demand charge, plus
a Fuel Cost Adjustment adder. The registration of two or
more meters may be combined each month for billing purposes.
The other rate schedule provisions of the industrial power
rate shall apply to schools.
PRIVATE ATHLETIC FIELDS
Electric service to lighted athletic fields where the light-
ing installation is financed and maintained by private ownerships
shall be billed on the following basis for such months as the
field is in use:
All KWH used during each monthly period at 5.0 cents per
KWH, with no monthly minimum or demand charge, and no
charges to be made furing months when the field is not
in use, plus a fuel cost adjustment adder.
SECURITY LIGHTS
For 175 W mercury vapor security lights with photo -electric
control when installed by the City for private use, where its
electricity is furnished by the City „ and where the luminaire ands
control are maintained by the City, the monthly rate shall be a
flat charge of $4.25. Ownership of such lights is to reside in
the City.

All electricity used by the various City departments shall
be accounted for monthly and a report made monthly to the Mayor
of the KWH used by the following:
City Hall
Police and Fire Station
City Warehouse & Shops
Electric Substation Use
Civic Buildings
Water Pumps
Sewer Plants and Lift Stations
Firemans' Club
Street Lights & Pier Lighting
Traffic Lights
Lighted Athletic Fields
All electricity used by the above shall be valued at 2.4 ceni
per KWH.

All churches are to be billed on the residential rate.
V. FUEL COST ADJUSTMENT
The product of the monthly KWH used times a fuel cost
adjustment factor shall be added to the foregoing Miscellaneous
Schedules where indicated.
This Fuel Cost Adjustment Factor shall be the latest
energy cost adjustment factor billed to the City at wholesale
by the Alabama Power Company, or Zero, whichever is greater.
ALL OTHER ORDINANCES IN CONFLICT HEREWITH ARE HEREBY
REPEALED.
This Ordiance shall take effect upon its adoption and
publication as required by law.
