HomeMy WebLinkAbout10-04-1976 Organizational MeetingSTATE OF ALABAMA COUNTY OF BALDWIN Minutes of the City Council of the City of Fairhope, of the meeting held on October 4, 1976, being the first Monday in October, the same being the Organizational meeting of the said Council held at the City Administration Building, 387 Fairhope Avenue in the City of Fairhope at 7:00 P.M. Present at said meeting: Mayor James P. Nix, duly elected as Mayor and David E. Bishop, H.G. Bishop, Sam E. Box, Jack A. Stipes and Billy Don Wigginsduly elected Councilmen at the General Municipal Election, each of whom subscribed to the oath of office in words and figures as follows: STATE OF ALABAMA COUNTY OF BALDWIN CITY OF FAIRHOPE I, , solemnly swear that I will support the Constitution of the United States and the Constitution of the State of Alabama so long as I continue a citizen thereof; and that I will honestly and faithfully discharge the duties of the office upon which I am about to enter, to the best of my ability, so help me God. Signed Sworn to and subscribed before me this the 4th day of October, 1976. Signed Notary Public Rev. H.B. Shepherd gave the invocation. The Mayor and City Council having been duly elected and qualifies and all being present, the Mayor called the meeting to order and announced that the first order of business was the election of a Temporary Clerk and Treasurer. Mayor Nix nominated Carolyn Adams.to serve as Acting Clerk and Treasurer., there being no other nomination, Mr. Henry Bishop moved, seconded by Mr. Sam Box that Carolyn Adams be elected Acting C1erk,Treasurer. Motion carried: Mr. Henry Bishop nominated Mr. Sam E. Box as Mayor Protem. Mr. Henry Bishop moved, seconded by Mr. Don Wiggins that the nominations be closed. Upon being put to vote the following vote was recorded: AYES: Mr. Henry Bishop NAYES: Mr. David Bishop, Mr. Jack Stipes, Mr. Don Wiggins. ABSTAIN: Mr. Sam Box Motion by Jack Stipes, seconded by Don Wiggins, that Mayor Protem be as follows: Mr. Sam E. Box First Year Mr. David Bishop Second Year Mr. Don Wiggins Third Year Mr. Jack Stipes ,Fourth Year Motion carried. David E. Bishop moved to adopt the following Ordinance: f ORDINANCE NO. BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FAIRHOPE, ALABAMA, that the order of procedure in all instances from meetings of the Council shall be as follows: SECTION I. That the rules or order of procedure herein contained shall govern deliberations and meetings of the Council of the City of Fairhope, Alabama. SECTION II. Regular meetings of the Council shall be held on the following dates: The 2nd and 4th Monday nights of each month at 7:00 P.M. SECTION III. Special meetings may be held at the call of the Mayor by serving notice on each member of the Council not less than TWENTY-FOUR (24) HOURS before the time set for such Special Meeting; or Special Meeting may be held as provided by SECTION 430, Title 37, of the Alabama Code of 1940, whenever two Councilmen ( or the Mayor ), reques`t in writing that the Presidi Officer call such meeting; upon the failure or refusal of the Presiding Officer to call such meeting when requested, the two 1 Councilmen ( or the Mayor ), making the request shall have the right to call such meeting. SECTION IV. A Quorum shall be determined as provided by SECTION 429, of Title 37, of the Alabama Code of 1940 as recompiI- ed in 1958. SECTION V. All regular meetings shall convene at the Administration Building at the City Hall and all meetings, regula and Special, shall be open to the public. SECTION VI. An Agenda shall be prepared by the City Clerk fo all business to come before each regular meeting, and all busines: to be transacted shall be put°on the Agenda not later than Friday Noon before the next regular Council meeting on the following Monday night. r ► SECTION VII. The order of Business shall be as follows: (1) The call to order (2) Roll Call ' (3) Approval of minutes (4) Reports of Standing Committees (if any) (5) Reports of Special Committees (if any) (6) Report of Officers (if any) (7) Reading of Petitions, applications, complaints, appeals, communications, etc. (8) Auditing Accounts (9) Resolutions, Ordinances, Orders, and Other Business SECTION VIII. No Member shall speak more than twice on the same subject without permission of the Presiding Officer. SECTION IX. No person, not a member of the Council, shall be allowed to address the same while in session without the permissi of the Presiding Officer. SECTION X. Every Officer, whose duty it is to report at the regular meeting of the Council, who shall be in default thereof, may be fined at the discretion of the Council. SECTION XI. Motions shall be reduced to writing when required by the Presiding Officer of the Council or any -Member of the Counci All resolutions and ordinances shall be in writing. SECTION XII. Motions to reconsider must be by a member who voted with the majority, and at the same or next succeeding meeting i of the Council. SECTION XIII. Whenever it shall be required by one or more members the "yeas" and "nays" shall be recorded; and any member y call for a division on any question. SECTION XIV. All questions of order shall be decided by the Presiding Officer of the Council with the -right of appeal to the , Council by any member,. SECTION XV. The Presiding Officer of the Council, may, at his discretion, call any member to take the chair to allow him to address the Council, make a motion, or discuss any other matter at 'issue. SECTION XVI. Motions to lay any matter on the table shall be first in order; and on all questions, the last amendment, the most distant day, and the largest sum shall be first put. SECTION XVII SECTION XVIII SECTION XIX All meetings of the Council shall be public. A Motion for adjournment shall always be in I order. i The rules of the Council may be altered, amende , or temporarily suspended by a vote of two-thirds of the members resent. SECTION XX. The Chairman of each respective committee, or Councilman acting for him in his place, shall submit or make all eports to the Council when so requested by the Presiding Officer or any member of the Council. SECTION XXI. All ordinances, resolutions or porpositions submitted to the Council which require the expenditure of money shall lie over until the next regular meeting; provided, that such ordinances, resolutions, or propositions may be considered earlier by unanimous consent of the Council; and provided further, that this rule shall not apply to the current expenses of, or contracts previously made with, or regular salaries of Officers, or wages of employees of the City. SECTION XXII. The City Clerk, City Engineer,: City Attorney, and,.Chief...of Police, -and Superintendent of Utilities, and such other Officers or employees of the City of Fairhope, shall, when requested, attend all meetings of the Council and shall remain in the Council room for such length of time as the Council may direct. SECTION XXIII. No ordinance or resolution of a permanent nature shall be adopted at the meeting at which it is introduced unless unanimous consent be obtained for the immediate considera- tion of such ordinance or resolution, such consent shall be by droll call and the vote thereon spread on the Minutes. SECTION XXIV. This ordinance shall go into effect upon the ('passage and publication as required by law. Approved this the day of Passed and approved 1976. 1976 vi Mayor Nix appointed Council members to departments as follows: F H.G. Bishop Sam Box David Bishop Jack Stipes Billy Don Wiggins Finance Committee Water and Sewer Committee Electric Committee Street Committee Recreation Committee Motion by Councilman H.G. Bishop, seconded by Councilman Don Wiggins, that all administrative officers and employees of the Municipality shall continue in their respective duties temporaril3 pending such time as the Council shall make permanent appointment: Motion carried unanimously. Councilman Sam Box moved, seconded by David Bishop, that the Merchants National Bank of Mobile, and the First National Bank of Fairhope be designated as the official Municipal Depositories. Motion carried. Mr. H.G. Bishop moved, seconded by Mr. David Bishop that provisi be made for the bonding of officers and employees as required. Motion carried. Motion by Councilman Sam E. Box, seconded by Councilman David E. Bishop that Councilman H.G. Bishop be designated to sign checks in the absence of either the Mayor or the City Clerk. Motion carried. Sam Box moved, seconded by Don Wiggins , that the second and fourth Monday of each month , at 7:00 P.M., at the City Adminis- tration Building, 387 Fairhope Avenue, Fairhope, Alabama be the established time, place and date for regular meetings of the City Council of the City of Fairhope.
