COUNTY OF BALDWIN
(he City Council of, the City of Fairhope, Alabama met on Wednesday,
August 11, 1976 at 11:30 A.M. to canvass the results of the
general election for the City of Fairhope held on August 10, 1976.
Present: James P. Nix, Mayor, Councilmen: David E. Bishop, H. G.
Bishop, Sam E. Box, 011ie E. Deese and Barney L. Shull.
Motion by Councilman H. G. Bishop seconded by Councilman Barney
Shull that the following Resolution be adopted. Motion carried.
RESOLUTION
WHEREAS, the general election for the City of Fairhope, Ala-
bama was duly and legally held on August 10, 1976, as provided by
law, and ) '
WHEREAS, the municipal governing body of the City of Fairhope
met on this llth day -of August, 1976, all members thereof being
present, at ll,:30 A.M. and has canvassed the returns, and has
ascertained and determined the number of votes received by each
candidate, and ,
WHEREAS, the said municipal governing body has ascertained
and determined the results of said election as follows:

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF FAIRHOPE, ALABAMA, as follows:
1. That JAMES P. NIX received a majority of the votes
cast for the office of Mayor and is hereby declared duly elected
to that office for the term beginning on the first Monday in
October, 1976.
2. That DAVID E. BISHOP received a majority of the votes
cast for the office of Councilman, Place No. 1 and is hereby
declared duly elected to that office for the term beginning on
the first Monday in October, 1976.
3. That DON WIGGINS received a majority of the votes cast
for the office of Councilman, Place No. 2 and is hereby declared
duly elected to that office for the term beginning on the first
Monday in October, 1976.
4. That no candidate received a majority of the votes
cast for the office of Councilman Place No. 3, and that EDWIN A.
ERNEST, III and JACK A. STIPES received the most and sec on most
votes cast for that o ice, t erefore a runoff election between
said candidates is hereby ordered to be held on Tuesday, Septem-
ber 14, 1976, pursuant to the requirements of Act No. 663, Reg-
ular Session of the Legislature 1961, as amended.
5. That SAMUEL E. BOX received a majority of the votes
cast for the ofFice of Councilman, Place No. 5 and is hereby
declared elected to that office for the term beginning on the
first Monday in October, 1976. ti

motion was duly made, seconded and carried that the meeting
adjourn.
