COUNTY OF BALDWIN
The City Council of the City of Fairhope met in regular session
at the City Administration Building, 387 Fairhope Avenue, Monday
July 12, 1976 at 7:00 P.M. with the following members present:
Mayor James p. Nix, Councilmen: David E. Bishop, H. G. Bishop, Sam
Box, 011ie E. Deese and Barney L. Shull.
Minutes of the previous regular meeting were approved.
This being date set for Public Hearing on rezoning from R-2
Medium Density Single Family District to B-4, Business and Profess
ional Office District, Lot 16, 17, 20 and 21, Block 16 of Volanta
Subdivision, Mr. Irby presented plans for proposed building. A
number of residents from the area were present requesting that the
rezoning be denied and submitted a petition with approximately
forty names of surrounding residents. Planning Commission had re -
recommended to the Council that the rezoning be approved subject
to no ingress or egress of traffic off of Section Street and with
final plans to meet with the approval of the Building Inspector.
After a general discussion Councilman David Bishop moved, seconded
by -Councilman H. G. Bishop that the request be denied. Motion cam
led unanimously.
Mr. Rick Gambino met with the Council requesting approval of the
City. -for Club License at Gambino's Restaurant. After general
discussion, Councilman H. G. Bishop moved, seconded by Councilman
Sam Box that the request be denied. Motion carried.
Motion by Councilman Box seconded by Councilman David Bishop that
Ordinance # 577, repealing Ordinance #421 granting franchise to
TelePromter Co., be adopted as introduced at the regular meeting

f June 28, 1976. Motion carried.
Motion by Councilman Barney Shull seconded by Councilman Sam Box
that the following Resolution be adopted.
RESOLUTION
WHEREAS, Act. No. 663, Regular Session of the Alabama Legis-
lature, 1961, provides for and regulates general and special
elections in cities and towns of this state, except those cities
and town which have a Commission form of government, and
WHEREAS, said act prohibits write-in candidates in elections
held under said act, and
WHEREAS, Act No. 404 of the Regular Session of the Alabama
Legislature, 1965, provides that if only one person has filed a
statement of candidacy or has been nominated for an office for
an election to be held pursuant to Section 6 of said Act 663,
at the time the deadline for qualification has passed, then such
person shall, for all purposes, be deemed elected to such office,
and the Mayor or other chief executive officer shall not cause
the name of such person or the office for which his candidacy
was declared to be printed on the ballot, but he shall immediately
file a written statement with the governing body of the municipal-
ity, attested by the Clerk, certifying the fact that only one
person filed a statement of candidacy or was nominated for the
office preceding the deadline set for an election of municipal
officers of the city and setting forth the name of such person,
and
WHEREAS, said Act No. 404 provides that the governing body
of the munciipality, after receiving such statement, shall adopt
a resolution declaring the person named in the statement duly
elected to the office described in the statement, and shall issue
a Certificate Of Election to such person, and
WHEREAS, the Mayor of the City of Fairhope has filed a writ-
ten statement with the governing body of the municipality, attest-
ed by the Clerk, certifying the fact that only one person filed
a statment of candidacy for the office of Councilman Place No. 4
prior to the deadline established in the notice of election and
that the name of that person who filed such statement was H. G.
Bishop;
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the
City of Fairhope that H. G. Bishop be and he is hereby declared
duly elected to the office of Councilman Place No. 4 in the City
of Fairhope for the term of office commencing on the first
Monday in October, 1976, and
BE IT FURTHER RESOLVED, that the Mayor of the City of Fair -
hope be and he hereby is directed to issue a certificate of
election to H. G. Bishop for the office of Councilman Place No. 4
for such term pursuant to the provisions of Act No. 404 of the
Regular Session of the Legislature of Alabama 1965.

Upon being ut to vot , the results were as follows: Voting For:
Councilmen: David E. Bishop, Sam E. Box, 011ie E. Deese and Barney
L. Shull. Voting Against: None. Councilman H. G. Bishop abstained
from voting. Motion carried and Resolution duly adopted.
Motion by Councilman Sam Box seconded by Councilman Barney Shull
that permission be granted for Shrine parade in Fairhope on July 2,
1976. Motion carried.
Motion by Councilman David Bishop seconded by Councilman Barney
Shull that Jubilee -By -The -Bay be granted a variance from the
Swimming Pool Ordinance concerning fencing on the bay side which
is already four feet high subject to the approval of the Building
Inspector. Motion carried.
Motion by Councilman H. G. Bishop seconded by Councilman Barney
Shull that Actual Revenue Sharing Report of $35,796.58 to the
Public Library and $4,000.00 to Streets be approved. Motion carr-
ied.
Motion by Councilman Barney Shull seconded by Councilman Sam Box
that the accept recommendation of the Recreation Board and award
contract to Baldwin Fence Company, Silverhill, Ala. for fencing at
the new stadium and authorize the recreation board to check on
additional fencing. Motion carried.
Motion by Councilman H. G. Bishop that the following Ordinance be
introduced:
ORDINANCE NO. 578
WHEREAS, MATTHEW P. DIAL, JR., DORIS DIAL, WALTER 0. POSER
and ELEANORE H. POSER are the owners of all the land abutting a
certain street within the City of Fairhope, Alabama, which said
!street is described as follows, to -wit:
That certain street 50 feet in width which lies West of
Lots 6 and 7 of the Hoyle-Worchester Addition to Fairhope
as recorded in Map Book 1, Page 1, of the Probate Records
of Baldwin County, Alabama, and lies immediately East of
Fairhope, running South from Nichols Street 346 feet,
more or less, all according to plat of Hoyle-Worchester
Addition to Fairhope, as recorded in Map Book 1, Page 1,
of the Probate Records of Baldwin County, Alabama.
WHEREAS, MATTHEW P. DIAL, JR., DORIS DIAL, WALTER 0. POSER
and ELEANORE H. POSER, as owners, have executed a declaration of
vacation, vacating all of the land constituting said street as
above described and desire to divest any and all right which the
public may have in and to that portion of said street and the use
thereof by virtue of the - establishment of same; and
WHEREAS, it is reported to the City Council of the City of
Fairhope, Alabama, that convenient means of ingress and egress is
afforded to all property owners in the area in which this street
is located by remaining streets, alleys and avenues therein loca-
ted,
NOW, THEREFORE, BE IT ORDAINED by the City Council of
the City of Fairhope, Alabama, that the vacation of
the street above described in the City of Fairhope,
Alabama, 'is hereby assented to, acquiesced in and
authorized by the City Council of the City of Fairhope,
Alabama.
