COUNTY OF BALDWIN
The City Council of the City of Fairhope met in regular
session at the City Administration Building, 387 Fairhope Avenue
Fairhope, Alabama on Monday April 12, 1976 at 7:00 P.M. with
the following members present: Mayor James P. Nix, Councilmen:
David E. Bishop, H.G. Bishop, Sam E. Box, 011ie E. Deese and
Barney L. Shull.
The minutes of the previous regular meeting were approved.
Motion by Councilman Sam E. Box, seconded by Councilman
Barney L. Shull that Ordinance # 572, AN ORDINANCE TO PROHIBIT
MOTORCYCLES, MOTOR SCOOTERS, AND OTHER MOTORIZED TWO -WHEEL
VEHICLES FROM ENTERING ON THE PRIVATE PROPERTY OF OTHERS
WITHOUT WRITTEN PERMISSION, introduced at the regular meeting of
March 23, 1976 be adopted as introduced. Motion carried.
Motion by Councilman Barney L. Shull, seconded by Councilman
Sam E. Box that Ordinance # 573, AN ORDINANCE TO REPEAL ORDINANCE
# 191, AN ORDINANCE REQUIRING LICENSE FOR EVERY PERSON, FIRM,
CORPORATION OR MOTOR TRANSPORTATION WHICH DELIVERS, UNLOADS,
DISTRIBUTES OR DISPOSES OF ANY GOODS, WARES, MERCHANDISE IN THE
CITY OF FAIRHOPE, ALABAMA, introduced at the regular meeting of
March 23, 1976, be adopted as introduced. Motion carried.
Motion by Councilman Barney L. Shull, seconded by Councilman
Sam E. Box, that the application of Rocco J. and Rick Gambino
for a beer and liquor permit at Gambino's Restaurant, formerly
Baron's Restaurant be approved. Motion carried.
Motion by Councilman David E. Bishop, seconded by Councilman
011ie E. Deese to authorize the purchase of shells for the
resurfacing of the beach road. Motion carried.
Motion by Councilman 011ie E. Deese, seconded by Councilman
Barney L. Shull that the City finance the sending of five-(5)
men to one week in fire school. Motion carried.
Councilman Sam E. Box introduced the following Ordinance:
ORDINANCE NO. 574
AN ORDINANCE TO ADOPT THE NATIONAL FIRE CODES, VOLUMES ONE THROUGI
SIXTEEN PUBLISHED BY THE NATIONAL FIRE PROTECTION ASSOCIATION AND
REPEALING ANY AND ALL ORDINANCES IN CONFLICT THEREWITH.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAIRHOPE ,
ALABAMA:
1. There is hereby adopted, for the purpose of prescribii
regulations governing conditions hazardous to life and property
from fire or explosion, that certain code known as " THE NATIONAL
FIRE CODES" containing sixteen volumes, of 1976, and printed by
the National Fire Protection Association and the whole thereof,
save and except such portions as are hereinafter deleted, modifier
or amended,of which one copy has been and is now on file in the
Office of the City Clerk, and the same is hereby adopted and
incorporated as fully as if set out at length herein.
2. Any and all Ordinances in conflict herewith,be, and ti
same are hereby repealed.

Motion by Councilman David E. Bishop, seconded by
Councilman Barney L. Shull to advertise the rezoning of
the Carrie Young property from R-2 Medium Density Single
Family District, to B-4, Business and Professional District,
with the exception of a 150 foot strip fronting on Morphy
Avenue, for a public hearing. Motion carried.
This being date set for opening of bids on one 3/4
Ton Pick-up Truck the following bids were received:
Gaston Motor Company $ 4,095.00
Bill Steber Chevrolet $ 3,973.50
Motion by Councilman Barney L. Shull seconded by Councilman
Sam E. Box to acknowledge the receipt of the bids with
Bill Steber the apparent low bidder of $ 3,973.50, providing
it meets specifications. Motion carried.
Motion by Councilman H.G. Bishop, seconded by Councilman
Barney L. Shull that the bills for the month be paid as
presented. Motion carried.
Mr. Albert Nonkes requested that the City look into
the situation at the V F W and see if the building was
in safe condition. Mayor James P. Nix said that he would
have the Fire Inspector check and see if the V F W building
is in order.
On a motion duly made, seconded and carried, the meeting
was adjourned.
