COUNTY OF BALDWIN
The City Council of the City of Fairhope met in regular session
at the City Administration Building, 387 Fairhope Avenue, Monday,
March 23, 1976 at 7:00 P.M. with the following members present:
Mayor James P. Nix, Councilmen: David E. Bishop, H. G. Bishop,
Sam E. Box, 011ie E. Deese and Barney L. Shull.
Minutes of the previous regular meeting were corrected to read:
Dowsey Air Conditioner bid was for a 5T unit instead of 72 T.
Ingersoll bid on 72 T. Compressor only, which bid was accepted
in the amount of $786.98.
Minutes approved as corrected.
Councilman Sam Box introduced the following Ordinance:
ORDINANCE NO. 5 73
AN ORDINANCE TO REPEAL ORDINANCE NO. 191, AN ORDINANCE
REQUIRING LICENSE FOR EVERY PERSON, FIRM, CORPORATION
OR MOTOR TRANSPORTATION WHICH DELIVERS, UNLOADS, DISTRIBUTES
OR DISPOSES OF ANY GOODS, WARES, MERCHANDISE IN THE CITY OF
FAIRHOPE, ALABAMA.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAIRHOPE,
ALABAMA, that Ordinance No. 191, adopted on the lst day of May,
1949 be, and the same is hereby repealed.
This Ordinance shall take effect upon its due adoption and
publication as required by law.

Application for Beer License for proposed Square Rigger Restaur-
ant on Highway 98 next to Pappagello's, by Wallace W. Milham
was brought up for discussion. Attorney for the Milhams stated
that they were requesting a letter from the Council indicating
that the Council would act favorably on a Beer License when the
building is completed. Motion by Councilman Sam Box seconded by
Councilman Barney Shull that a Beer License be issued to Mr. and
Mrs. Milham if and when the Square Rigger Restaurant is built on
Highway 98 next to Pappagello's. A group of residents from the
area voiced their objections to the issuing of another Beer licen e
in the area. After a general discussion, Mayor Nix called for a
vote on the motion on the floor with the following results: Votin
For: Councilmen:H. G. Bishop, Sam E. Box and Barney L. Shull.
Voting Against:Councilmen David E. Bishop and 011ie Deese and
Mayor James P. Nix. Mayor Nix then cast a second vote to break
the tie and the motion was defeated.
Motion by Councilman David Bishop seconded by Councilman Sam Box
that Ordinance #571, AN ORDINANCE TO ESTABLISH TESTING OF ALL
PERSONS WHO SHALL OPERATE AS LICENSED ELECTRICIANS WITHIN THE
CORPORATE LIMITS OF THE CITY OF FAIRHOPE, ALABAMA, introduced
at the regular meeting of March 8, 1976 be adopted as introduced.
Motion carried.
Councilman Sam Box introduced the following Ordinance:
ORDINANCE NO. 572
AN ORDINANCE TO PROHIBIT MOTORCYLCES, MOTOR SCOOTERS, AND
OTHER MOTORIZED TWO -WHEELED VEHICLES FROM ENTERING ON THE PRIVATE
PROPERTY OF OTHERS WITHOUT PRIOR WRITTEN PERMISSION, TO PROHIBIT
MOTOR SCOOTERS AND MOTORCYCLES AND OTHER MOTOR DRIVEN TWO -WHEELED
VEHICLES FROM RACING IN COMMERCIAL PARKING LOTS, OTHER THAN THE
LAWFUL INGRESS AND EGRESS IN AND ABOUT THE ORDINANRY COURSE OF
BUSINESS.
ARTICLE I.
SECTION 1. It shall be unlawful for any person to operat
a motorcycle, motor scooter or other motor driven two -wheeled
vehicle upon private or public property of others, or upon desig-
nated bicycle trails, without the prior written permission of the
owner of said property.
SECTION 2. It shall be unlawful for any person to operate
a motorcylce, motor scooter, or any other motor -driven two -wheeled
vehicle upon a commercial parking lot except for the normal ingress
and egress and parking thereon in the ordinary course of business.
SECTION 3. Any person convicted for violation of this
Article shall be punished by fine of not less than one nor more
than TWO HUNDRED ($200.00) DOLLARS, or by imprisonment for hard
labor for not more than 6 months, or by such fine and
imprisonment at the discretion of the Court.
THIS ORDINANCE shall take effect on its due adoption and
publication as required by law.

Motion by Councilman David Bishop seconded by Councilman Barney
Shull that the City ask for bids on pick-up truck. Motion carried
Mr. Kashew had requested that the City install railroad ties
every three feet in front of his property on N. Section Street
to avoid collision of cars into his property. Motion by Council-
man Sam Box seconded by Councilman H. G. Bishop that the request

Mayor Nix reported that Dr. E. C. Dillabough had resigned from the
Library Board and asked for nominations to replace Dr. Dillabough.
Councilman H. G. Bishop nominated Mr. Wm. B. McGregor, Councilman
David Bishop seconded the nomination. Councilman Sam Box moved
that the nominations be closed. Upon being put to vote the vote
was unanimous in favor of Mr. McGregor to fill the unexpired term
of Dr. Dillabough which expires in May, 1978.
Motion by Councilman Shull seconded by Councilman Box that Mayor
Nix be authorized to enter into agreement with the State Highway
Department for upgrading of the existing signal at the intersectic
of Section Street and Fairhope'Avenue with a new fully -actuated
three phase controller and new.signal heads at a cost of $6193.80.
Motion carried.
Dr. Ernest, representing the Jaycees, requested unlimited use of
the beach for the 4th of July celebration and that any requests
concerning use of beach be referred to the jaycees. Motion by
Councilman Barney Shull seconded by Councilman H. G. Bishop that
the request be granted and that the Jaycees be commended for thei
efforts in sponsoring the July 4th celebration. Motion carried.
A request from the Air Conditioner dealers for a license law to
be adopted by the Council was discussed. Motion by Councilman Sam
Box seconded by Councilman Barney Shull that the Electric Supt.
and City Attorney draw up Ordinance for Council approval. Motion
carried.
It was duly moved, seconded and carried that the meeting adjourn.
