COUNTY OF BALDWIN
The City Council of the City of Fairhope, met in regular
session at the City Administration Building, 387 Fairhope
Avenue, Fairhope , Alabama , on March 8, 1976 at 7:00 P.M.,
with the following members present: Mayor James P. Nix,
Councilmen: David E. Bishop, H.G. Bishop, Sam E. Box,
011ie E. Deese and Barney L. Shull.
The minutes of the previous meeting were approved as
recorded.
Councilman Sam Box moved for the adoption of Ordinance
# 570 , amending the So. Standard Gas Code, introduced
February 23, 1976. 011ie Deese seconded the motion. Motion
carried.
Bids were received for Creosote Poles and Quartzlites
for the Little League Baseball Field. The bids were turned
over to the Recreation Board for opening at the March 10,
1976 Special Meeting of the Recreation Board.
The following bids were received for replacing the
Air Conditioning Units at the City Hall and the City
Garage:
CITY GARAGE:
1. Romac and Company------------ 400.00
2. Dowsey's--------------------- 488.00
3. Ingersoll's------------------ 366.00
CITY HALL:
1. Dowsey's--------------------- 1,148.00
2. Ingersoll's------------------ 1,253.95
David Bishop moved to accept Ingersoll's Refrigeration
and Air Conditioning as being the lowest bid for replacing
the Air Conditioner at the City Garage. Barney Shull seconded
the motion. Motion carried.
David Bishop moved to accept the lowest bid providing it
meets specifications , on replacing the Air Conditioning Unit
at City Hall. Barney Shull seconded the motion. Motion
carried.
Mrs. Sally Maloney was present to discuss the trash problem
on North Mobile Avenue. Mayor Nix assured Mrs. Maloney that if
the VFW did nothing to correct the problem, the City would be
sure to take care of it.
Mr. Phil Rutherford Superintendent of the Electrical
Department, requested to send three ( 3 ) men to meter
school. Motion made by David Bishop, seconded by Barney Shull,
to accept Mr. Rutherford's request to send three ( 3 ) men
to meter school. Motion carried.
Councilman Davd Bishop introduced the following Ordinance:
ORDINANCE NO. %I
AN ORDINANCE TO ESTABLISH TESTING OF ALL PERSONS WHO SHALL
OPERATE AS LICENSED ELECTRICIANS WITHIN THE CORPORATE LIMITS
OF THE CITY OF FAIRHOPE, FAIRHOPE, ALABAMA.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAIRHOPE
ALABAMA AS FOLLOWS:
1. There is hereby established examinations for all persons
who shall operate as licensed electricians within the City Limits
of the City of Fairhope, Alabama.
2. That the said examination shall be conducted by the
Superintendent or Foreman of the Electrical Department of the
City of Fairhope, and shall be given all persons who make a
request therefor and shall be given at such times and places as
the Superintendent of the Electrical Department shall designate.
3. Examination shall be composed of true and false questions
and shall be taken from Ordinance No. 552, and Ordinance No.
adopting the National Electric Code 1975.
4. No person, shall operate as an electrician within the
confines of the Corporate Limits of the City of Fairhope, without
first applying for, taking, and passing the said Electrical Test.
5. Any person, violating the provision of this Ordinance
shall be fined not less than $ 1.00 nor more than $ 200.00, at
the discretion of the Court.
6. This Ordinance shall take effect upon its due adoption
and publication as required by law.
ADOPTED THIS THE 3 h. DAY OF 1976.

Sam Box moved, seconded by David Bishop, to accept a
Performance Bond on Phillip Stenzel, for the water main, on
the subdivision of his property on the eastside of Blue Island, in
the amount of $ 3,000.00. Motion carried.
Motion by Councilman H. G. Bishop seconded by Councilman
David E. Bishop that the Volunteer Fire Department discontinue
the practice of answering fire calls outside the Police Juris-
diction of the City unless it it is a house fire or asked for
mutual aid from another fire department. Motion carried.
Councilman Sam Box introduced the following Ordinance:
ORDINANCE NO. 570
AN ORDINANCE TO AMEND THE SOUTHERN STANDARD GAS CODE, KNOWN
AS ORDINANCE NO. OF THE ORDINANCES OF THE CITY OF FAIRHOP
ALABAMA.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAIRHOPE:
1. That the Southern Standard Gas Code be, and the same is
hereby amended to read as follows:
1. Under Section 205 Piping Materials and Workmanship,
there shall be added Section 205.1(a) Metallic Pipe.
Section 205.1(a) METALLIC PIPE: Consumers gas piping
shall be wrought iron or steel pipe complying with ANSI
standards for Wrought -steel and Wrought -iron pipe, B36.10-
1970. Where approved by the administrative authority, copp-
er or brass pipe in iron pipe sizes assembled with threaded
fittings of -the same material may be used with gases not
corrosive to such materials.
No tubing of copper or brass will be used in gas
piping of houses, except that copper pipe or flex tubing
may be used as a tail piece not to exceed over 4 feet in
length from gas cock before flex or tubing.
No plastic pipe of any description shall be used as gas pip-
ing in or outside of any houses or buildings.
2. All other provisions of the Southern Standard Gas Code,
be, and the same is hereby RATIFIED AND CONFIRMED except as
amended herein.
THIS ORDINANCE SHALL BECOME EFFECTIVE UPON ITS DUE ADOPTION
AND PUBLICATION AS REQUIRED BY LAW.

Only one bid was received on metal poles for light fixtures
at new stadium, bid being from Union Metal Co., Canton, Ohio in
the amount of $,737.00 for prime painted pole. Bid taken under
advisement until next regular meeting of the Council.
Mayor Nix wele_omed the exchange students visiting in Fair
for two weeks.
Councilman David Bishop gave the following report:
Whereby, the City of Fairhope has received a letter from
the Alabama League of Municipalities, stating that donations
to such causes as the current Band Project was illegal for a
municipality, David Bishop worked up a possible alternate plan
and presented it to Mr. Thad Ingram. This plan would allow the
City to give money to the Band for a service rendered, such as
picking up trash along the highways, or cleaning up the parks, etc,
Mr. Ingram said that the band rejected Mr. Bishop's plan for
the following four ( 4 ) reasons:
1. The Band had a lot of the members out of town for
AEA Holidays, and it would be hard to get everyone
together.
2. The danger involved in picking up trash on the side of
the road.
3. The fear that the plan may not be accepted by the Mayor
and Council.
4. The Mayor and Council already had their opportunity to
do something, and they didn't.
A letter from Mr. Ed Beard requesting the property south
of Dun Romin Apartments be annexed into the City Limits was
presented. Henry Bishop moved, seconded by Sam Box, to accept
Mr. Beard's application for annexation, subject to the approval
of the City Attorney. Motion carried.
Mr. Henry Bishop moved, seconded by Sam Box, to approve
the bills for payment as the monies become available. Motion
carried.
It was noted for the record that Well No. 2 has been accepted
by the Engineers, and the Health Department, and that the final
estimate will be paid.
Motion duly made, seconded and carried, the meeting adjourned.
