COUNTY OF BALDWIN
The City Council of the CITY OF FAIRHOPE met in regular
session at the City Administration Building, 387 Fairhope Avenue,
Fairhope, Alabama Monday February 9, 1976 at 7:00 P.M. with the
following members present: Mayor James P. Nix, Councilmen:
David E. Bishop, H.G. Bishop, Sam E. Box, 011ie,E. Deese and
Barney L. Shull.
Minutes of the previous regular meeting were approved.
Motion by Councilman H. G. Bishop,Seconded by Councilman
David E. Bishop that ORDINANCE #568, AN ORDINANCE SETTING SALARIF
OF MAYOR AND CITY COUNCILMEN FOR TERM BEGINNING THE FIRST MONDAY
IN OCTOBER 1976, introduced at the regular meeting of January 26,
1976 be adopted as introduced. Motion carried.
Motion by Councilman David Bishop, Seconded by Councilman
H.G. Bishop that Mayor Nix be authorized to purchase electric
lines in Dun-Romin from Riviera Utilities for $6,157.04, four
times annual revenue. Motion carried.
Upon Motion by Councilman Shull, Seconded by Councilman
011ie Deese, .the following Resolution was passed:
"WHEREAS, the CITY OF FAIRHOPE is desirous of negotiating
with the FIRST NATIONAL BANK OF FAIRHOPE for a temporary
loan in order to start on the Recreation Complex as the
loan from Farm Home Administration will not be available
until July, and
WHEREAS, the CITY OF FAIRHOPE is desirous of borrowing
from the FIRST NATIONAL BANK OF FAIRHOPE, for a term of
six months, the sum of.ONE HUNDRED SEVENTY-FIVE THOUSAND
($175,000.00) DOLLARS, plus interest at six (.60) percent
per annum on the unpaid balance, and
WHEREAS, the Mayor and City Council of the CITY OF FAIR -
HOPE do hereby acknowledge receipt of a commitment dated
February 4, 1976 from the FIRST NATIONAL BANK OF FAIRHOPE,
which commitment requires the said BANK to lend $175,000.00
to the CITY OF FAIRHOPE, to be repaid at the date of
maturity of a six months' General Obligation Note which
will be given to the BANK by the CITY, and
WHEREAS, the CITY desires to assure the BANK that the Note
will be paid at maturity,
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
CITY OF FAIRHOPE, ALABAMA, that the Mayor and City Clerk
be authorized to execute a General Obligation Note to the
First National Bank of Fairhope, Alabama, in the amount
of $175,000.00, plus interest at the rate of 6% per annum
on the unpaid balance for a period of six months.
BE IT FURTHER RESOLVED by the City Council of the CITY
OF FAIRHOPE, ALABAMA that in the event it becomes nec-
essary for the CITY to acquire longer .term financing
to repay the said Note, then the CITY OF FAIRHOPE will
take the required action necessary, and will issue and
sell General Obligation Warrants to procure the funds
needed to repay the aforementioned Note of $175,000.00.
ADOPTED and approved this the 9th day of February 1976."

Upon being put to a vote, the following vote was recorded:
Voting for: Councilmen David E. Bishop,.011ie E. Deese, Sam E.
Box and Barney L. Shull. Councilman H.G. Bishop abstained from
voting, Motion carried; Resolution adopted.
This being date set for Public Hearing on $150,000.00
Community Development Grant, Mr. Don Pruitt of South Alabama
Regional Planning, outlined procedure for application for grant.
If grant is approved the City plans to extend sewer line to servE
the southeast section of the City. Grant is based on population
of area, percentage of people classified in low income bracket
and percentage of sub -.standard housing. The next public hearing
will be on Saturday, February 14, 1975 at 10:00 A.M. at
the City Administration Building.
Mrs. Sally Maloney met with Council concerning erosion be-
tween her property and the. V.F.W. Held for study and report at
the next regular meeting of the Council.
Motion by Councilman David Bishop, Seconded by Councilman
Barney Shull that .the application of Mr. James D. Fender for
beer and liquor permit at Baron's Restaurant be approved. Motior.
carried.
Motion by.Councilman H.G. Bishop, Seconded by Councilman
Barney Shull that 3/4 year license be refunded to former operator
of Baron's.Restaurant. Motion carried.
Councilman Sam Box introduced the following Ordinance:
ORDINANCE NO. 569
BE IT ORDAINED BY. THE CITY COUNCIL OF THE CITY OF FAIRHOPE,
ALABAMA that there is herebyestablished a TEN DOLLAR($10.00)
Service Charge for calls made by the City of Fairhope gas de-
partment outside the City Limits of Fairhope when interruption
of service is not the fault of the City of Fairhope.
BE IT FURTHER ORDAINED that there is hereby established
an EIGHT DOLLAR ($8.00) service charge for calls made by the
CITY OF FAIRHOPE Gas Department in the City Limits of Fairhope
when interruption of service is not the fault of the City
of Fairhope.
This Ordinance shall take effect upon its due adoption
and publication as required by law.

Motion by Councilman Barney Shull, Seconded by Councilman
H.G. Bishop that City accept Performance Bond of Paddock Estates
#2 as presented. Motion carried.
Purchase of tranquilizer gun for catching stray dogs was
taken under advisement.
Motion by Councilman H. G. Bishop seconded by Councilman Sam
Box that bills be approved for payment as funds are available.
Motion carried.
It was duly moved, seconded and carried that the meeting
adjourn.

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAIRHOPE,
ALABAMA, as follows:
SECTION 1. That, for the term beginning the first Monday
in October, 1976, the Mayor of the City of Fairhope, Alabama,
shall receive for performance of his duties as mayor an annual
salary of $_aLpp .p11 , payable in equal installments out of
the City Treasury.
SECTION 2. That, for the term beginning the first Monday
in October, 1976, each member of the City Council of the City of
Fairhope, Alabama, shall receive an annual salary of $ /,SOU.° °
payable in monthly installments out of the City Treasury.
