COUNTY OF BALDWIN
The City Council of the City of Fairhope met in regular
session at the City Administration Building, 387 Fairhope Ave.,
Monday, August 28, 1972 at 7:30 P.M., with the following mem-
bers present: Mayor R. C. Macon, Councilmen: James P. Nix,
Henry G. Bishop and Sam E. Box. Councilmen John Robertson and
Robert Cowen being absent.
Minutes of previous regular meeting were corrected as
follows:
'Ira Steele, Chief of Volunteer Fire Department, requested
permission from Council to appear before Baldwin County Com-
mission with request for funds in the amount of 6 675.00 for
additional fire truck to be used mainly for forest fires. Coun-
cil signed letter of request to be presented to County Commis-
sion.
Minutes approved as corrected.
Property owners in Fly Creek area requested aid of City
Council in getting the U. S. Corps of Engineers to place the
spoil from the dredging at Fly Creek directly on the beach
north of the entrance to the creek instead of making sand bars
out in the bay. Letter read and general discussion followed
on placing of spoils.
Motion by Councilman Bishop seconded by Councilman Box
that City reimburse Volunteer Fire Department on accident in-
surance policy in the amount of $738.51..Motion carried unani-
mously.
Motion by Councilman Nix seconded by Councilman Box
that Volunteer Fire Department be authorized to purchase litera-
ture to be given to school children for Fire Prevention Week,
October 8th through October 14, 1972, cost not to exceed $100.00.
Motion carried.
The following bids were received on three police cars:
Steber Chevrolet

Net trade difference $9,943.00
Motion by Councilman Nix seconded by Councilman Box that
City accept low bid of Steber Chevrolet, provided cars meet
specifications. Motion carried.
Motion by Councilman Nix seconded by Councilman Box that
City Attorney be authorized to start proceedings to have buil-
ding on S/W Corner of Nichols and S. Section Street meet re-
quirements of Southern Standard Building Code. Motion carried.
Motion by Councilman Bishop seconded by Councilman Box
that City Attorney be authorized to draw up necessary deeds
for exchange of property with Mr. L. D. Littleton, Sr., Motion
carried.
Motion by Councilman Box seconded by Councilman Nix that the
following Resolution be adopted: Motion carried.
RESOLUTION
WHEREAS, there has been filed with the Government in

plicant) an application, Project Number PFL-Ala-196, dated
April 28, 1972, for.`Federal assistance under the Public Facility
Loans Program, Public Law 345, 84th Congress, as amended, and
the United States of America, Secretary of Housing and Urban
Development, has transmitted the Applicant for acceptance an
Offer dated July 11, 1972 of Federal assistance in connection
with the Project referred to in said application and described
in said Offer; and
WHEREAS, said Offer has been fully considered in ac-
cordance with all pertinent rules of procedure and legal re-
quirements, and made a part of the Applicants public records;
and
WHEREAS, it is deemed advisable and in the public in-
terest that said Offer be accepted;
NOW, THEREFORE, be it Resolved by THE CITY COUNCIL
that the_said Offer, a true and correct copy of which, including
the Special Conditions, Bond Specifications and the Terms and
Conditions, is hereto attacd3hhed, be and the same hereby is ac-
cepted without reservation or qualification.
Passed by the aforementioned governing body of the Ap-
plicant on the 28th day of August, 1972.

Motion by Councilman Bishop secoded by Councilman Box
that request of Leo Keller for vacation pay be taken under ad-
visement. Motion carried.
Motion by Councilman Box seconded by Councilman Nix that
Ordinance No. 493, An Ordinance To Repeal Sub -Section (1) of
Section 10-9 (a) of Ordinance No. 478 Adopted the 1st Day of
January, 1972 be adopted as introduced. Motion carried.
Motion by Councilman Nix seconded by Councilman Box that
City employ Moore Engineering Company to draw up necessary plans
for the City's Land fill to bring it in accordance with Solid
Waste Act No. 771. Motion carried.
Motion by Cpuncilman Bishop seconded by Councilman Nix
that City of Fairhope use the County land fill on a temporary
basis until the City's land fill can be brought in compliance
with State law No. 771. Motion carried.
Upon the recommendation of Mayor Macon, Councilman :..
Bishop moved, seconded by Councilman Nix that Harold Mason be
appointed Acting.Foreman of the Street Department at $3.00 per
hour. Motion carried.
Mayor Macon recommended to the Council that due to the
rapid growth and increase in participation in various activities
supervised by the Recreation Board that Council seriously con-
sider adding the remaining 215 of beer tax to their annual bud-
get.
Motion by Councilman Box seconded by Councilman Nix that
City ask for bids on one load Cast Iron Pipe, assorted sizes.
Bids to be opened at next regular meeting. Motion carried.
It was duly moved and seconded that meeting adjourn.
